4. Contractor does not knowingly employ or contract with an unauthorized alien, nor retain any
employee or contract with a person that the Contractor subsequently teams is an unauthorized alien.
Contractor agrees that he/she/it shall enroll in and verify the work eligibility status of all of Contractor's
newly hired employees through the E-Verify Program as defined by I.C. 22-5-1.7-3. Contractor's
documentation of enrollment and participation in the E-Verify Program is included and attached as part of
this bid/quote; and
5. Contractor shall require his/her/its subcontractors performing work under this public contract to
certify that the subcontractors do not knowingly employ or contract with an unauthorized alien, nor retain
any employee or contract with a person that the subcontractor subsequently learns is an unauthorized alien,
and that the subcontractor has enrolled in and is participating in the E-Verify Program. The Contractor agrees
to maintain this certification throughout the term of the contract with the City ofSouth Bend, and understands
that the City may terminate the contract for default if the Contractor fails to cure a breach of this provision
no later than thirty (30) days after being notified by the City.
b. Persons, partnerships, corporations, associations, or joint venturers awarded a contract by the City
of South Send through its agencies, boards, or commissions shall not discriminate against any employee or
applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions,
or privilegcs of employment, or any matter directly or indirectly related to employment because of race, sex,
religion, color, national origin, ancestry, age, gender expression, gender identity, sexual orientation or
disability that does not affect that person's ability to perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any
combination of the foregoing including, but not limited to, public works contracts awarded under public
bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards,
or commissions may consider the Contractor's good faith efforts to obtain participation by those Contractors
certified by the State of Indiana as a Minority Business ("MBE") or as a. Women's Business Enterprise
i ("WBE") as a factor in determining the lowest, responsible, responsive bidder.
In no event shall persons or entities seeking the award of a City contract be required to award a subcontract
to an MBE/WBE; however, it may not unlawfully discriminate against said WBE/MBE. A finding of a
discriminatory practice by the City's MBE/WBE Utilization Board shall prohibit that person or entity from
being awarded a City contract for a period of one (1) year from the date of such determination, and such
determination may also be grounds for terminating the contact for which the discriminatory practice or
noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination commitment shall be made

The items in this addendum are to become a part of the original documents as if included therein, Only the noted items are affected
and the remainder of the original contract document is to remain in its entirety.
This Addendum modifies the Contract Documents as follows:

PART 1— GENERAL CLARIFICATIONS
1. REVISE Bid Due date to Sept 12, 2017 at 9:30 AM
2. Nan -Mandatory site visit dates are Tuesday August 241' at 10:30 AM and Wednesday Aug 25, at 10:00 AM.
3. Contractors are required to bid all Alternates
4. Alternate #1. Deduct Flex Space. Does this mean to keep the existing walls? No addition but it will get a new roof'? Do the
exterior elevations stay the same? Yes, keep existing walls, no addition, yes new roof, yes existing exterior elevations stay
the same.
5. Alternate #3. Gym Room 102. Does this mean to not build the footings, walls and roof? If deduct this then the Maintenance
Storage room 103 will remain and have a 4" exterior wall on the west. Also, would door 102 be eliminated? Yes, no
footings, walls or roof, 4" wall at maintenance would change to 8" exterior wall, yes door 102 would be eliminated.
6. Alternate #4. Storage Room 103. Same problem what about the east wail? Do we eliminate doors 103A and 103b? Exterior
wall would change to 8", yes eliminate 103A and 103B.
7. Alternate #7. Bike Shop. Are we to delete the exterior wall, roof and doors? Or just not do any work inside the room? Yes,
delete exterior walls, footings, roof and doors.
8. Vestibule 120. What size of floor mat is required? 5'-0" x 8%0" (Include allowance of $500 for Charles Black Logo in floor
mat. (Logo provided by owner at later date)
9. Are there any fire extinguishers or cabinets for them? Fire extinguishers are shown on Life Safety Sheet A041.
10. What are the locations of any expansion joints? Will be issued on updated elevation sheet in Addendum L Use Fiber cement
panel manufacturer guidelines for expansion joint detail.
11. Room finish schedule A601. Weight room has Rub/Matt. What material is required for this? American Floor mats `fit lock'
rubber tiles 3/8" thick 2' x 2' rubber interlocking 10 % blue. {Include allowance of $1,000 for Charles Black Logo in floor
mats. (Logo provided by owner at later date)
12. Is water repellant required integral in the block as well as applied after? No integral water repellant is sufficient.
13. The Charles Black Center will be closed to public and unoccupied during construction.
14. Alternate #6 Concession Room and Equipment. Rough in for plumbing and electric shall be part of base bid.
15. Alternate #5 New HVAC Unit curb and flashing and electrical supply shall be part of base bid. The RTU and duct work shall
be alternate.

Duct System, Make-up Air System and Hood Fire System. The "basis of design" is Captive -Aire, however, other
fully integrated systems meeting specifications can be submitted for approval during bidding. Systems provided
as various components that are not the responsibility of a single hood system supplier are not acceptable.

6. There is an allowance of $ 5,000,00 for brick/block repointing, That dollar figure would be for all exterior restoration work.
There is a note on plan sheet A101 to clean and repair control joint in the gym. Should this cost be included in the $5,000.00
or should we add money for it? Money for cleaning/repairing existing expansion joints should be separate of tuck pointing.
7. What manufacturer is to be used for the metal detector$?
CEIA HI -PE Plus 32" wide (for wheel chair) with dolly for movability.

immediately upon receipt of bill from owner, any and all damage to gas or electrical service is the responsibility of the
contractor.
6. Owners items in Weight room and flex space will be cleared out prior to Notice to Proceed.

to include in price for alternate.
10. Climbing rope in gym shall be Porter 00115-16 or equal.
11. The final Soil management plan is attached and is to be included in contract bid as an itemized price.
12. The roofing/ insulation and roof structure over the existing restroom/storage area is to be removed down to load bearing
walls and replaced with new structure and roof/insulation per sheets D 102 and S 101.
13. Existing Restrooms in locker rooms may be used by contractors until removed. The two restrooms next to Community Room
may be used during construction but toiletries must be supplied by contractor and any damage or misuse of the restrooms is
the responsibility of the contractor. Also the rest rooms must be cleaned prior to issue of substantial completion.
14. All Fire Rated Glass shall be Pyran Platnum L or equal.
15. Doors 009, t04A, I I IA, I I I and openings K, L, M, and N shall be Hollow metal in lieu of Aluminum.
