To whom it may concern,
Request to vacate or restrict access to alley east of 313 W. Madison St.
The purpose for the request to vacate or restrict access to this alley is for
safety, security and traffic control in regards to my property located at 313
Madison Street in South Bend.
I want to restrict access from the north end of the alley. To accomplish
this I propose the following.
Set a gate from the corner of the garage to the property east of the alley.
This will allow me to secure the above mentioned property and at the same
time not interfere with traffic coming from the north or west to service the
electric pole or hinder any other services the city might provide.
If this were to be accomplished , the property at 313 W. Madison , that has
been empty for more than 20 years will be rehabilitated and have a purpose
again.

36-7-3-13 Criteria:

Engineering gives this an unfavorable recommendation because the alley vacation:

Dear Board Members:
The staff has reviewed this petition relative to IC 36-7-3-13. 1t is the staff's opinion that:
(1) The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is
located or to which it is contiguous.
The block serviced by this alley is fully developed. All properties within the block have direct access to
neighboring public streets, Further development or redevelopment of the block would benefit from direct access
to the adjacent public ways.
(2) The vacation would not make access to the lands of the aggrieved person by means of public way difficult or
inconvenient,
Access to all affected properties is provided by adjacent public streets. There are two large, church -affiliated
parking lots to the north of the proposed alley vacation. The alley system within the block provides enhanced
access to these parking lots, helping to efficiently distribute traffic to the major streets, Vacation of this portion
of the system would not significantly compromise access, although the creation of a "right-angle" turn would
make continued use of the remaining alley difficult, if not impossible for some vehicles.
(3) The vacation would not hinder the public's access to a church, school, or other public building or place,
The alley does provide secondary access to a church, Temple Beth El, As noted in Criteria #2, above, that
portion of the alley proposed to be vacated appears to function as secondary access for the Temple parking fats.
The Temple has direct access from their parking lots to the adjacent streets.
(4) The vacation would not hinder the use of a public way by the neighborhood in which it is located or to which it
is contiguous.
The vacation may hinder access to other adjacent public ways. See comment under Criteria #2 relative to the
creation of a "right-angle" alley.
