Be it remembered that the Common Council of the City of South Bend, Indiana met in the
Council Chambers of the County-City Building on Monday, July 24th, 2017 at 7:00 p.m. The
meeting was called to order by Council President Tim Scott and the Invocation was given by
Deacon John Tugman, Holy Catholic Church, and Pledge to the Flag was given.

Councilmember Gavin Ferlic made a motion that the minutes of the July 10th, 2017 meeting of
the Council be accepted and placed on file. Councilmember Karen White seconded the motion
which carried by a voice vote of eight(8) ayes.

CHAMPIONSHIP
Councilmember Tim Scott, 711 Forest Avenue, South Bend, IN, served as the presenter of this
bill. Councilmember Scott read for the Council and public the text of the resolution.
John Gumpf, Head Baseball Coach at St. Joseph High School,thanked the Council for honoring
his team and thanked the members of his team for their work. Mr. Gumpf stated, The chemistry
is what I think really did it for us. I think in the years that I've been at St. Joe, we've probably
had better teams, but as a group this has definitely been the top, and they proved it.
Councilmember Regina Williams-Preston stated, I just want say congratulations. As you know,
what's happening here tonight is that this is going down in the records of the City of South Bend.

RESOLVE INTO THE COMMITTEE OF THE WHOLE
At 7:15 p.m. Councilmember Karen White made a motion to resolve into the Committee of the
Whole. Councilmember Oliver Davis seconded the motion which carried by a voice vote of nine
(9) ayes. Councilmember Gavin Ferlic, Chairperson,presiding.
Councilmember Gavin Ferlic explained the procedures to be followed for tonight's meeting in
accordance with Article 1, Section 2-11 of the South Bend Municipal Code.

34-17 PUBLIC HEARING ON AN ORDINANCE
AMENDING THE ZONING ORDINANCE FOR
PROPERTY LOCATED AT 4640 SOUTH
MICHIGAN STREET; 237, 305, AND 313
REASOR STREET; 4637, 4701, 4707,AND
VACANT PARCEL SOUTH AND ADJACENT
TO 4707 FELLOWS STREET; COUNCILMANIC
DISTRICT NO. 5 IN THE CITY OF SOUTH
BEND, INDIANA
Councilmember Oliver Davis, Chair of the Zoning and Annexation Committee, reported that
they met this afternoon and send this bill forward with a favorable recommendation.
David Stanton, the Area Plan Commission,with offices on the 11th Floor of the County-City
Building, South Bend, IN, served as the presenter of this bill. Mr. Stanton stated, The petitioner
is requesting a zone-change from GB, General Business District, and SF1, Single-Family District
and Two (2)-Family District,to CB, Community Business District. On the site is a former retail
space. To the north is a retail automotive establishment zoned GB, General Business District,
vacant lots zoned CB, Community Business District, and homes zoned SF 1, Single-Family and
Two (2)-Family District. To the east, across Fellows Street, are homes zoned SF1, Single-Family
and Two (2)-Family District. To the south is the St. Joseph Valley Parkway. To the west, across
Michigan Street, is a retail complex zoned CB, Community Business District. Mr. Stanton
presented to the Council public images of the site. Mr. Stanton stated, And then this is just
looking east from the St. Joseph Valley Parkway at what is the current site. They are going to
actually take down this site and reconstruct the new building on this site. Mr. Stanton presented a
view looking north from St. Joseph Valley Parkway toward St. Joseph Street,then the properties
to be rezoned on Fellows Street, and then a view looking south toward the overpass on Fellows
Street. Mr. Stanton stated, The 4.15 acre site is part of a larger development to convert the retail
structure adjacent lot currently being rezoned. A proposed 207,469 square foot retail store will be
accessed by St. Joseph Street. The areas being rezoned are primarily shown as retention areas of
the proposed site plan. The remainder of the project area is already zoned CB, Community
Business District. This comes to you from the Area Plan Commission with a favorable
recommendation. Rezoning this site to CB, Community Business District, will allow for the
reuse of an existing commercial property in a manner consistent with the Comprehensive Plan.

This being the time heretofore set for the Public Hearing on the above bill,proponents and
opponents were given an opportunity to be heard.
Those from the public wishing to speak in favor of this bill:
Mike DiVita, the Department of Community Investment, with offices on the 14th Floor of the
County-City Building, South Bend, IN, stated, As has been discussed,these changes would offer
property owners an economically viable reuse of former big box and other large buildings. With
the standards proposed, self-storage could be done in a combination with other uses that is
compatible with the respective zoning district. So,the zoning classification would be preserved,
but properties could convert to this or from this use more easily, as the market dictates. So,we
believe this quick fix will help at least a couple of developers now and be of further value as
national retailing patterns continue to change over time.
None from the public wished to speak in opposition to this bill.
Councilmember Karen White made a motion to send Bill No. 40-17 to the full Council with a
favorable recommendation. Councilmember John Voorde seconded the motion which carried by

afternoon and send this bill forward with a favorable recommendation.
John Murphy,the Department of Administration and Finance,with offices on the 12th Floor of
the County-City Building, South Bend, IN, served as the presenter of this bill. Mr. Murphy
stated, This bill is an appropriation of$5,000,000 for improvements to Howard Park as part of
the Regional Cities grant program. As you know,there are a number of grants throughout the

parts of our community that have maybe been ignored or blighted for so long. This money allows
for that process to begin. It's definitely a time for the northwest side and the southeast side
regions to be looked at. This money allows for the people of the community to actually get a
survey study done to actually know what the needs of the full community are.
Karl Nichols, 2806 Lincoln Way West, South Bend, IN, stated, I stand in support of this
ordinance, hoping that the additional allotment to the fund will help assist in the funding of a
study that will allow community members to really speak to community members who have
suffered the biggest blight from the"1,000 Houses In 1,000 Days" initiative. Any typical market
study is going to cut off at a certain salary and we are going to miss a whole population of people
we need to hear from. I have submitted a funding request to Indianapolis for$20,000 to be able
to send trained data collectors from the community into the community they live in to get that
information from the people that the market study won't speak to. I would ask that the City help
support that initiative so we can help expand it to all the impacted areas.
Jose Arevaldo, 105 East Jefferson Boulevard, South Bend, IN, stated that he echoes Mr.Nichols'
statements, and that what he is looking for in this study is an inclusion of the status of the current
housing situation in South Bend, especially in areas affected by the "1,000 Houses In 1,000
Days" initiative. Mr. Arevaldo stated,Also,this study should include vacant lots,because within
those vacant lots is the plan to build some of the one-hundred(100)houses that have been
discussed for so many months. It is important to include this because there are many houses that
need repair or rehabbing. That's why we need to take into account the current housing stock. It is
important to take into account those community members and neighbors and citizens of the city
who have been supportive of the city, and I think it is time to give back.
Jorden Giger, 61455 Druid Lane, South Bend, IN, stated that he echoes Mr. Arevaldo's
statements. Mr. Giger stated, I think that we should include a community engagement
component. We have had ongoing conversations with the City since last September about doing
some kind of community needs assessment, and we have assembled a team of folks, in
partnership with Karl Nichols. We have students from IUSB, students from Notre Dame, and we
have a bunch of neighborhood folks who want to be involved in doing door-to-door survey work.
I think that that has to be a part of it,because as we talk to a lot of residents in the area, they are
concerned about the fact that we have all these plans in place across the west side and different
parts of the City, but they don't really feel like they have been engaged. Mr. Giger also suggested
having focus groups and citywide forums. He stated, You can crunch numbers all day long, but
that won't really tell you what real impact you have on these lives.
Jesse Davis, P.O. Box 10205, South Bend, IN, stated, I think this is a good idea. I think it's great
to get some community members involved and some thinking minds, instead of going to the
normal everyday company that we spend$100,000 on to do a study.
Those wishing to speak in opposition to the bill:
Sharon Banicki, 3822 Ford Street, South Bend, IN, stated, We have all these people on the City
staff making six(6) figure digits a year that are so highly educated—why do we have to keep
paying people to tell us what everybody should already know? Why do we have to keep going
out to the east coast to bring in one of these brainstorms? You've got community people that are
willing to do it at a fraction of the cost that are going to put in the labor. They are going to get to
the people that need to be sought out, not your brain trust that is going to tell you what you want
to hear. Keep the costs down, do the study,work with what you've got.
Samuel Brown, 222 East Navarre Street, South Bend, IN, stated that he feels mixed emotions
regarding the bill. Mr. Brown explained that he was in favor of potential improvements coming
as a result of this bill but that he wanted to make sure that the money was going where it needed
to go.
Councilmember Regina Williams-Preston stated, I want to thank the City Administration. I feel
as if a lot has already been said by community members themselves, in terms of just being able
to engage and go through the process. Whether we agree or we disagree, I feel like coming back
to the Council and making that increase has really shown that we are ready to be responsive to
what the community needs and ready to listen. It simply opens the door for more conversation

controversy regarding this particular piece of property. I can't remember, in recent history,when
any bar or even any business in South Bend has occupied so much attention in the local media.
Mr. Masters continued, I want you to take a look at a couple of things from Mr. Burg's
perspective. When Mr. Burg acquired this property in 2014,he went to the City Building
Department to obtain a permit to build the deck. Mr. Burg was told that no permit was required,
because no permit was required for a deck that was under three (3) feet off the ground. After Mr.
Burg built the deck and began using it, and the neighbors started to complain,the City said the
deck wasn't permitted. The Building Commissioner told you before, at the committee meeting
two (2)weeks ago,that that was a mistake to issue a permit for the deck. Yeah, but whose
mistake? Mr. Burg applied and obtained a permit from the Building Department to replace the
six (6) foot fence on the side of the property along Harris Street that was in disrepair. After he
replaced the fence, the Building Commissioner decided that the fence should be three (3) feet
high, because what is the side of the yard,the Building Commissioner said, is the front yard. To
make it even more difficult for Mr. Burg,the Alcohol and Tobacco Commission regulations
require the fence to be seven(7) feet off the ground, because of the deck. So, Mr. Burg applied
for the variance for the fence, and the ABZA approved that variance. Because of the complaints
against the property,primarily from one (1) neighbor,the property was labeled a"chronic
problem property."Now, understand: in your City rules,to be a chronic problem property you
don't have to be found guilty of anything, you don't need to be convicted of any violations—all
you have to have is someone call and make a lot of complaints about you, regardless of whether
they are valid. The complaining neighbor apparently knows that all it takes to get Mr. Burg's
business in trouble with the City is just to,keep calling the police and every other City
department.
Mr. Masters continued, In May, 2016, Mr. Burg signed a remediation agreement with the South
Bend Police Department—and this was to address citations that had been issued. Again,none of
them brought ever reduced to any judgment or conviction. That agreement was in effect from
May, 2016 through November, 2016. There were no additional violations during that time. The
remediation agreement was satisfied in November, 2016. The effect of complying with the
remediation agreement was to have all prior citations rescinded. That remediation agreement
specifically stated that Mr. Burg was allowed to have outside music on the deck until 11 p.m. so
long as he gave notice to the neighbors, and the volume of the music was within City decibel
meter guidelines. The ink was not dry on that agreement before the City sued Mr. Burg for
having music on the deck. So, we are here with this petition to try to resolve the problems that
address the neighbor's concerns and,hopefully, yours. As your counsel has told you, when the
Common Council considers a special exception,your role is valid before the Zoning Appeals.
You must determine if the statutory standards for granting a special exception will be met based
on the evidence you hear. The offered commitments exceed any other legal requirements and are
intended to appease any neighborhood concerns. These commitments offer protection for the
surrounding neighbors.
Mr. Masters continued, You may hear from a number of supporters of Mr. Burg's petition. You
will also hear from an impassioned opponent. You know, I'm personally all in favor of people
who come before the public and speak out on matters that affect their lives and their property. I

So, that's a given. That's what the law requires.
Councilmember Davis asked, Last two (2) questions, and then I'm done: in terms of the issue
you said that Mr. Burg could have done something differently—what do you think he could have
done differently that would have helped relieve the situation?
Mr. Masters responded, When Bob Burg got started,there were some parties out there that
would... The biggest issue is he used the house next door the backyard of the house next
door—which he owns, but it wasn't really his own to use. And so that made it a lot bigger than
what we've got now, which is a deck with a capacity for twenty(20)people.
Councilmember Davis responded, Okay, I'm at peace.

Councilmember Broden asked Mr. Bulot to answer these questions, as well. So, what was the ,
theory or the intent when the rezoning occurred—was it 2004?When parcels of property were
deemed nonconforming, what was the overall intent of that label? And then,what is the process
for bringing those into conformity? And I know some of these answers, but I really want you to
go through that in just, clarification.
Mr. Bulot responded, Sure. In 2004, first of all-
Councilmember Borden interrupted, I'm sorry. Let me actually put a little bit of an additional
request in there. The piece about"non-expansion." So, freezing it at the use, as-is. If you can
maybe hit that?
Mr. Bulot responded, Sure.
Councilmember Broden responded, Thanks.
Mr. Bulot stated, First of all, I want to say the Building Department is not responsible for any
rezoning. That goes through the Area Plan Commission. In 2004—and this is kind of a summary
of what happened—they decided that it was time to rezone certain areas of the City, in and
around the City. What they did was they went through and they saw properties that had similar
characteristics: Residential, Commercial, Industrial, Central Business District. So, what they did,
more or less as a matter of convenience,they surrounded each of these districts and designated a
zone for that district. But nothing is perfect, and along with some of these districts, certain types
of properties were zoned probably improperly for what their function was. So,this was, I think,
the case: it's in a Residential District but it was used as a certain use. It probably should have
been taken out of a Residential District and designated a separate use. It was designated
Commercial, and then it was rezoned to Mixed Use. Now, Mixed Use is a use that's more
appropriate adjacent to a Residential use than a Commercial use. Part of the intent with zoning is
to make a smooth transition from Residential up to Heavy Industrial, so that you have less
impact on adjacent properties. In other words,you don't have a preschool next door to the
foundry. It doesn't make any sense. You want some properties in between those. Now, in terms
of legal nonconformity: when properties like this are rezoned,they are designated a certain
zoning designation, and within that zoning designation are certain types of uses, certain types of
setbacks,type-restrictions, all of these other rules and regulations that go in that district,
specifically. If you are a use that is not recognized in that district, you are allowed to continue
that use as long as you do not increase—and this is the term that is used in the zoning
ordinance—the "degree of nonconformity." So, if you are close to a property line and you decide
you want to move closer than the district allows,you're not allowed to do that. You have to get
special compensation—dispensation—in the form of a variance. The same is true for a use.
Within the confines of this building is a bar. It's been established. That's the extent of the use.
And, as far as we were concerned, the problem occurred when that use extended into the
exterior, increasing the area of the use. So,technically, you cannot increase the degree of
nonconformity, which it did here.

what's legally required,these commitments. Is there a forum, other than the ABZA, where you
could ask, or your client—or you, on their behalf, ask—for relief from those commitments,

Mr. Masters responded, Well,that's the idea in making the commitments. The whole idea of
making the commitments is you're willing to concede certain legal rights that you otherwise
would have.
Councilmember Broden stated, There's a potential, I think, as we talked about earlier,these
could hamstring this—I mean, making the commitments here,today—I recognized it as a
compromise, you know, being put out there. Whether or not it's advisable as a business, I don't
know. But, last question: I guess I'm concerned about unintended consequences of—how do I
say this—kind of a slippery slope, is what I want to get out of that argument, if we allow... Let

Mr. Masters interjected, It's a recognized process of making commitments on zoning matters,
particularly where there's thorny issues.
Councilmember Broden responded, And, maybe,just briefly we can hear that. So,this request is
site-specific, right? It's to this property and this property only. So,would that preclude any other,
I guess,precedent-setting?Am I getting at it? Maybe somebody else has a question that can
articulate it better, I don't know.

require commitments as a condition for approving a variance or an exception. So, I'm not sure

May I ask, though, one (1)thing, and I mean this seriously: you say "no music will be played on

anywhere outside the building premises."What do you mean by"amplified sound"?
A long discussion ensued concerning the exact semantic use of the terms"amplified sound" and
"emanated" in the current draft of the written commitments. Mr. Masters pressed for an exact
interpretation of the terms. Councilmember Ferlic argued that a dictionary definition of those
terms erases ambiguity, while Councilmember Davis, and eventually Councilmember Broden,
agreed with Mr. Masters that the words, as used, do not provide enough clarity as to what type of
sound—and under what circumstances—would be considered"amplified."
Mr. Masters stated, We'll do whatever the Council wants to have,but I just don't want to create
another problem.

about how do they become a non-conforming use, and a Mixed Use District was created; it's not

Confines at 1502 Dunham.
Councilmember Scott responded, Okay, great. What are your hours, and on what days of the
week?
Mr. Burg responded, We open at five (5) o'clock on Monday,Tuesday, and Wednesday, and
usually during the week we're closed by eleven(11) o'clock. Thursday, Friday, Saturday,we're
opening at three (3) o'clock and opening 'til, depending on whether or not we have customers
there, until three (3) o'clock.
Councilmember Scott asked, So, you're closed on Sunday?
Mr. Burg responded, Sunday we're open. We're open on Sunday,but we usually open around
noon and we're closed by, usually, eight(8) or nine (9) o'clock.
Councilmember Scott asked,Alright,my question is: do you agree that sound is accumulative?
Mr. Burg asked, Pardon?
Councilmember Scott reiterated, Sound is accumulative?
Mr. Burg responded, Sure.
Councilmember Scott stated, One (1)person talking is less than twenty (20)people talking at one
(1)time.
Mr. Burg responded, Yes.
Councilmember Scott stated, My point is, nine (9) o'clock is when the sound ordinance goes into
effect in South Bend. So,would twenty (20)people violate the sound ordinance from nine (9)
o'clock to eleven(11) o'clock?It's arbitrary, because we don't know. We don't know how loud
those conversations are going to be.
Mr. Burg responded, I believe we do have a sound ordinance and also a decibel level that you're
legally going up to, which is what I was told by the Police Department, and I also bought a
decibel reader so I can make sure we keep below that.
Councilmember Scott asked, So, would you say that there's no true control over how loud or
how soft someone can be talking? With twenty (20) people at one (1)time?
Mr. Burg responded, I guess that's true, but, you know...
Councilmember Scott interjected, Okay. Alright.
Mr. Masters explained that the petitioner was required to get a decibel reader as part of the
mediation agreement and never has the establishment exceeded the decibel levels allowed by the
sound ordinance.
Councilmember Scott stated, Those are the questions I have right now, so thank you.
Councilmember John Voorde asked,At his next hearing,what I'm asking is would the Alcoholic
Beverage Commission consider his commitment to be a good neighbor?
Mr. Burg responded, Yes, yes, actually, it would. Matter of fact, Linnie was at the Alcoholic
Beverage Commission Board for our last liquor license, which was granted to us. They did tell us
that we had to be good neighbors,basically. And that's what we were trying to figure out. It's
like, okay, we want to be good neighbors. We will compromise. We will stop our music at a
certain time. That's when I went to work with the City to say, okay, what do we do? And we just
keep getting different answers. We just need someone to say, okay, so we're thinking this is a
compromise.
Councilmember Voorde asked, Okay, so if there were nuisance calls for which citations were
issued,that would probably be taken into account by the ABZA when that license renew came
up. So,the integrity of those commitments would come into play when that license renewal
would come up, correct?

that this was always an option. Mr. Burg always had the opportunity to go before the Board of
Zoning Appeals and go before the Council and have his special exception use recognized and the
expansion then carried out into the outdoor area outside of the bar. So, there was never any
decision on my part that pushed them into that idea. It was always,something that was available
to them, and they determined, I suppose, during the pendency of the litigation pertaining to the
injunction that that was the avenue that they wanted to access at this point.
Councilmember Davis responded, Thank you for that. There has been some testimony,the last
few weeks,that the Building Department gave a permit and then said no... Councilmember
Davis asked Mr. Anderson to share with the Council and public the Building Department's side
of the story regarding the improper issuance of a permit,regarding the fence, as well as what led
to the injunction.
Mr. Anderson responded, I believe that Mr. Masters' representation regarding the permit for the
deck is correct. At one (1)point, Mr. Burg tried to determine whether or not he needed a permit.
Mr. Anderson explained that at the time it was assumed that the property was a residential
property, which has no deck requirements,.but it was actually in a Mixed Use District, so a
permit is required to have a deck. Mr. Anderson stated, At this point,that's sort of been shelved
because we've had the injunction on the way. As for the fence, I believe that there was not a
permit that was obtained initially. Later, there were conversations with the Building Department
and subsequently, Mr. Burg did obtain a permit for the fence. That was with the input with, I
think it was ATC—sorry, the State Excise Police—that determined that a seven (7) foot fence
was required. As far as the noise issue goes, the noise was sort of ancillary to the actual zoning
violation that the Building Department had-
Councilmember Davis asked Mr. Anderson to break down how the noise issue was ancillary.
Mr. Anderson responded, The zoning violation was the expansion of the use into the outdoor
area. Part of the expansion of the use into the outdoor area carried with it, then,the noise that
took place when that use occurred. And so, the injunction that was filed would have been filed
irrespective of noise, assuming that there was some other issue related to that use. Now, the noise
was necessary to show to the court,because it became an issue of the use and enjoyment of the
neighboring properties. So, it was sort of ancillary to the expanded use issue,but the true part of
the injunction was the expansion of the use, not the noise.
Councilmember Davis asked Mr. Anderson how long after the remediation agreement was the
lawsuit filed.
Mr. Anderson responded, So,the remediation agreement was entered, I believe, in late 'l 5. The
use of the deck stopped as a natural consequence of South Bend's weather, so we didn't hear
anything from about October,November, through April of 2016,presumably because no one was
using the outdoor area. So. I think it was sometime in April,then,that we received first contact
from a neighbor of the property, and after that contact the injunction was filed in, I think it was,
June, 2016.
Councilmember Davis asked, So, you heard something in April and you enforced it in June?
Mr. Anderson responded, That's correct, sir. It was either April or May, and the injunction was
filed in June. Mr. Anderson verified the date on which a letter was sent to Mr. Burg from the
City informing him of the potential of injunction should he fail to get noise levels under
control—June 6 h, 2016. As well, Mr. Anderson verified the date on which he received an email
complaining about an escalating conflict between patrons and members of the community—June
l Ott', 2016. Mr. Anderson stated,After that was received,the injunction was filed. I filed my
motion June 21St, 2016; I think I filed the complaint for injunctive relief within a day or two (2)
prior to that.
Councilmember Davis asked, You acted pretty quickly, when it came to that situation,based on
everything else, correct?
Mr. Anderson responded, Uh, yeah, I would say so.

Those from the public wishing to speak in favor of this bill:
Jesse Davis, P.O. Box 10205, South Bend, IN, stated that the nuisance ordinance does not seem
to have teeth and that it is being selectively enforced. Mr. Davis stated, I truly believe that we
need to look at this and let this man run his business. Why try to hamper another business in
town?
Lawrence Chudzinski, 10026 Shadow Wood Drive, Granger,IN, stated that Mr. Burg was
always concerned with being righteous in his business with Mr. Chudzinski. He stated, All Bob
is doing is the American dream of wanting to be an entrepreneur.
Speedy Singleton, 1332 Ford Street, South Bend,IN, stated that this bar has helped bring
members of the community grow closer to each other.
May Markowitz, 51250 Tamarack Road,New Carlisle, IN, stated that she has been the manager
of the Friendly Confines since its founding. Ms. Markowitz stated that one (1)person has been
consistently complaining about the bar, effectively bullying them for the past two (2) years. She
stated that the complaints were not just for noise,but for things like gun shells found on her lawn
that the neighbor falsely attributed to the bar, or cars parked on the curb by the bar (where it is
not clear whether or not the parked car belongs to a bar patron).
Katie Reeves, 1001 South Mayflower Road, South Bend, IN, stated that the Friendly Confines is
one (1) of the safest bars in town and that they have invested in the community.
Tessa Harris, 54450 North 30th Street, South Bend, IN, stated that in an otherwise unsafe
neighborhood, she has always felt safe and welcome at the Friendly Confines. Ms. Harris stated
Bob Burg is a wonderful man and that he will continue to do things that will improve the
community.
Lisa Popielski, 55345 Lexington Avenue, South Bend, IN, asked why a nearby bar could have an
outdoor area but the Friendly Confines couldn't.
Mark Florkowski, 605 Kosciuszko Street, South Bend, IN, stated that the bar is a great, clean
place with friendly people.
Victoria Kucharski, 805 South Walnut Street, South Bend, IN, stated that, in the past,the
property in question was often vandalized and left in disarray. Mr. Burg has kept the property
clean and presentable and crime-free. Ms. Kucharski stated that she gets up for work at 3 a.m.
and that she is never kept up or disturbed by boisterous behavior. She asked, Our question is,
why is this all happening now when it's been a bar for as long as anybody in that neighborhood
can remember? Like the other people said, we've not had any music in over a year, so I don't
know what the problem is at this point.
Sadie Brown, 230 Sadie Street, South Bend, IN, stated that she agrees that this is a case of
selective enforcement as she has been trying to get the City to address a drug dealer living near
her, while a man trying to run a business in compliance with City statute is getting unwanted and
undeserved attention. Ms. Brown stated, Leave this gentleman alone.
Samuel Brown, 222 Navarre Street, South Bend, IN,urged the Council to allow Mr. Burg to
conduct his business in peace.
Sharon Banicki, 3822 Ford Street, South Bend, IN, stated that Mr. Burg is bending over
backwards to please everybody, but his efforts keep getting impeded by roadblocks. Ms. Banicki
stated, It's been a bar since my uncle owned it. Let it continue to be a bar.

want to put the onus on the people who are responsible, and I believe it's us. Councilmember
Williams-Preston stated that she hopes that people in the neighborhood come together and move
forward in a way that is more respectful of each other's needs. She stated, It feels to me that if
Mr. Burg and the establishment actually adhere to the written commitments,that that will allow
everybody in the neighborhood to be in peace and quiet.
Councilmember Randy Kelly stated, I would just like to thank Ms. Preston for those words, and I
really don't have anything to add to that.
Councilmember Jo M. Broden stated,Very well articulated, Regina. Thank you for those
comments. I would concur that this is the process to try to amend—if something went awry with
the 2004 rezoning—is to allow the public to view this specific use. Is it a right fit? Is it specific
to that site?I think of the four(4) criteria that we are asked to evaluate,probably the second one
(1) that was enumerated tonight: "the proposed use will not injure or adversely affect the use of
adjacent area or property values therein."Whom is being impacted, and is it adverse? I think the
commitments are going a long way... These are going beyond, legally, what's required. I guess
I'm feeling that that is accommodating the complaints. It's making a specific effort to eliminate
the adverse effect. We should be able, in the City of South Bend, in a Mixed Use District,to
accommodate a place for individuals to go to the bar,to enjoy themselves, and it shouldn't and
need not disturb the overall peace of the neighborhood. So, I would agree with Councilmember
Preston that there needs to be work on all ends, here: enforcement, neighborliness, other folks
coming and going, and also a higher degree of communication and collaboration within the
neighborhood itself. This is the process. Our parameters are very limited, and I think the business
is making some pretty large accommodations to get this off on a better foot. I'm going to read
something very specific from the ABZA minutes: "The question is whether or not the proposed
land use is consistent with the district it is in and whether or not an impact on the surrounding
community would be detrimental. The Mixed Use District is established to allow for
establishments such as this. The fact that this is a tavern makes it a controlled use and therefore a
special exception." So, the type of establishment being requested is considered and addressed in
the zoning ordinance and the land use. So, kind of hone in on this. It is about use. The district
was Commercial. It's Mixed Use. We should be able to accommodate this.
Councilmember Dr. David Varner stated that selective enforcement comes as a result of selective
complaints. Regarding the written commitments, Councilmember Dr. Varner stated, I think it's a
practical solution to a difficult problem. And then we have to allow our decision to be enforced,
to the extent it can, by the Administration. I am inclined to support this and then ask everyone,
including Mr. Burg who is making the concessions,to really live up to his statements with
regards to wanting to be a part of the neighborhood and wanting to run a good business. On the
other hand,the good people of the neighborhood want to know that they can live and enjoy the
peace and quiet. It takes a collaborative effort,not a winner or loser. If we walk out of here and
someone thinks there's a winner and someone thinks we're a loser, then I'm afraid we've failed.
Councilmember Oliver Davis stated that the Council should have been brought into this case
earlier than it had been. Councilmember Davis urged that the City must do a better job, stating,
We cannot punish business owners when we have made mistakes, ourselves. He concluded by
stating that he would be voting in support of the special exception.
Councilmember John Voorde thanked Mr. Masters and Mr. Anderson for their informative
responses to the Council,thanked the people for speaking for or against the bill, which he stated
helps inform the Council's decision. He pointed out that Council Attorney Bob Palmer and
Councilmember Gavin Ferlic had arrived at language that was acceptable for.the written
commitments.
Councilmember Gavin Ferlic stated, I want to say thank you to everyone for coming,both in
favor and in opposition. I also want to say thank you to the City for their handling of this matter.
I think you've done a fine job. You know, a big thing to consider here is that if the lawsuit
against Friendly Confines prevails,they'll have the ability to use the deck any way they want,
play music,have people out there until 3 a.m., and that might not be the best compromise for the
neighborhood. I do think that the language in the written commitments provides compromise and
protection for the neighbors. I will be supporting this. If this does go through, Mr. Burg, I would

Therese Doreau, Director of the Sustainability Office in the Department of Public Works, with
offices on the 13th Floor of the County-City Building, South Bend, IN, stated that this is a
community-led initiative with no financial investment or risk adopted by the City. Ms. Doreau
stated, I'm very grateful for the work of the steering committee. It's a great example of the
responsibility for sustainability being spread throughout the community.

her neighborhood that has become a big problem where large quantities of rainfall lead to rivers
in the road. She stated, The problem is that I don't want us to put form over function. All the
beautification in town is incredible, I love it, but when we have this much of an infrastructure
problem, and especially something that is a flaw in the infrastructure, I don't feel it's right for
residents to have to pay fortunes of money to fix that kind of a problem. I need your help. Thank
you.
Sharon Banicki, 3822 Ford Street, South Bend, IN, stated, A couple months ago, I was here and
implored the Council to go home,take your Council salary, crunch the numbers and see if you
can live on it. It was after one (1) of the rate increases that everybody says was only a dollar($1),
it's only two dollars ($2). I don't know how many of you have done.it, but I can look at this
Council and wonder how many of you have a household income of less than $100,000. How
many have less than a$50,000 household income? You guys make more than a person working
full-time, making $8.50 an hour,to be on the Council. Ms. Banicki insisted that the Council does
not understand how much bigger of a deal it is for most City residents than it is for
Councilmembers that utility rates have gone up by one dollar($1) or two dollars ($2). She urged
the Council to consider this when budget time comes around.
Rod Goodchild, 837 South 24 h Street, South Bend, IN, stated that he needed help removing a
fifty (50) foot tree from his property.
