Broden Committee Members Absent: Gavin Ferlic Other Council Present: Karen White, Tim Scott, Regina Williams-Preston(late) Other Council Absent: Dr. David Varner, Randy Kelly Others Present: Kareemah Fowler, Graham Sparks, Bob Palmer,Aladean DeRose, Mike Divita Presenters: Angela Smith, David Stanton Agenda: Bill No. 25-17- Rezoning at 1405 & 1505 Howard Street Substitute Bill No. 27-17-Rezoning at 3015 Western Avenue Committee Chair Oliver Davis called to order the Zoning and Annexation Committee meeting at 4:01 p.m. He introduced members of the committee and proceeded with the items on the agenda. Bill No. 25-17-Rezoning at 1405 & 1505 Howard Street Committeemember Jo M. Broden made a motion to continue Bill No. 25-17 indefinitely. This motion was seconded by Committeemember John Voorde which carried unanimously by a voice vote of three (3) ayes. Substitute Bill No. 27-17- Rezoning at 3015 Western Avenue David Stanton, Area Plan Commission with offices on the 11 th floor of the County-City Building, stated, The petitioner is requesting a zone change from GB, General Business District to MU, Mixed-Use District, as well as seeking two (2)variances for the development standards. On the site is a retail establishment. To the north of the site are single-family homes zoned SF2. To the east of the site there is a retail store zoned GB, General Business District. To the south and the west are retail establishment that are zoned MU, Mixed-Use District. Only a portion of the building, which is approximately 4,500 square feet, is proposed to be rezoned. The remainder of the building will continue being zoned GB, General Business District. Assured parking is located east of the site. This comes to you from the Area Plan Commission with a favorable recommendation. Rezoning the site to MU, Mixed-Use will allow for the reuse of an existing structure in a manner that is consistent with the comprehensive plan. Committee Chair Davis opened the floor to questions from the Committee or Council members. Committeemember Voorde asked a clarifying question with regard to the ownership of the building and why only half the building is being rezoned. Councilmember Regina Williams-Preston arrived at the meeting at 4:05 p.m. Angela Smith, Area Plan Commission with offices on the I Ith floor of the County-City Building, answered, This is common. You may see this on Mishawaka Avenue where buildings are built property line to property line. It is all one (1) ownership, one(1)parcel, but is more or less two (2)buildings. So in this case,the portion of the building they would like to use isn't zoned to allow them the intended use. They are `down-zoning' this portion. Committeemember Broden asked, What would happen with change of ownership of the parcel? There is assured parking, would that agreement not hold? Ms. Smith replied, It is not an official easement at this point so they would have to work that out. They did get a variance through the Area Plan Commission for no parking. There is a lot of street parking and walking so the demand for parking is not as high. They could enter into an agreement of sorts but that would be up to them. Committee Chair Davis than gave the floor to the property owner. Ciera Ewing, 3015 Western Avenue, stated, I am the owner. We are planning to open a flea market. It will be a retail store that specializes in multiple home items. We hope to open Jul of this year. We wholesale from an online website. Councilmember Tim Scott asked, Are you aware that Lincolnway and Western Avenue, through the Office of Community Investment,have fagade grants? Ms. Ewing replied, Yes, we have applied and been approved. Committee Chair Davis opened the floor to members of the public wishing to speak in favor of or in opposition to the legislation. 2 George Banner, 123 1/2W. 8th Street, Mishawaka, stated, I've been a real estate broker in St. Joseph County for thirty (30) years. I think this will be an asset. The City has already redone the streets and the parking. Mike Divita, Community Investment with offices on the 14th floor of the County-City Building, stated, Rezoning to MU, Mixed Use would support the community's desires as expressed in the Westside-Main Street Plan to create a neighborhood center that is vibrant and walkable. This would be consistent with the plan and the surrounding properties. There is more than adequate parking with the recent streetscape improvements there. With no other members of the public wishing to speak, Committee Chair Davis turned the floor back to the Committee for further comments or main motions. Committeemember Voorde made a motion to accept Substitute Bill No. 27-17. This motion was seconded by Committeemember Broden which carried unanimously by a voice vote of three (3) ayes. Committeemember Voorde then made a motion to send Substitute Bill No. 27-17 to the full Council with a favorable recommendation. This motion was seconded by Committeemember Broden which carried unanimously by a voice vote of three (3) ayes.
