HomeMy WebLinkAboutResolution No. 27-2017 - Appointing Authorized Representatives to Conduct Certain Adminstrative Acts on behalf of the BPWRESOLUTION NO. 27-2017 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, APPOINTING AUTHORIZED REPRESENTATIVES TO CONDUCT CERTAIN ADMINISTRATIVE ACTS WHEREAS, the City of South Bend Board of Public Works ("Board") is the contracting body for the City of South Bend, Indiana ("City") and the Board has the authority under the laws of Indiana to purchase, acquire and lease property; WHEREAS, the Board have determined that a need exists to delegate certain administrative tasks in order to promote the efficiency and operation of the City; and WHEREAS, as a result of the vast array of activity involving the City's Public Works Department, staff of the City's Public Works Department receive frequent requests to perform administrative functions on behalf of the department, including but not limited to, executing the transfer of title to personal property, the submission of forms to other various entities, the certification of the senior citizen rate for refuse, and the execution of documents related to the ownership and maintenance of property; and WHEREAS, the Board desires to expressly authorize the department's Director to take such administrative acts and to execute such administrative documents as necessary to provide for the proper maintenance and management of its property interests. NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of Public Works as follows: 1 Mr. Eric Horvath, in his capacity as Director of the City of South Bend's Department of Public Works is authorized to perform, on behalf of the Board, administrative acts related to the'department's transfer of title to personal property, the submission of forms to other various entities, the certification of the senior citizen rate for refuse, and the execution of documents related to the ownership and maintenance, of property. For purposes of this Resolution, an administrative act is one in which the Director determines, upon the advice of legal counsel, that said act occurs within the normal course of owning, operating, or managing department property and does not adversely impact an interest of the Board. 2. This Resolution shall be in fall force and effect after its adoption. ADOPTED at a meeting of the Board of Public Works of the City of South Bend, Indiana held on July 25, 2017, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
