REGULAR MEETING MAY 23, 2017
The Regular Meeting of the Board of Public Works was convened at 9:35 a.m. on May 23, 2017,
by Board President Gary A. Gilot, with Board Members Elizabeth Maradik, James Mueller,
Suzanna Fritzberg, and Therese Dorau present. Also present was Board Attorney Michael
Schmidt.
CHANGE TO AGENDA
Mr. Gilot stated the Board would move Item 2F. to 2A. to allow staff to review and award the
bids for the Monroe Parking Lot and Street Improvements today.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the Minutes of the
Agenda Review Session, Regular Meeting and Claims Review Meeting of the Board held on
May 4, May 9, and May 16, 2017, were approved.
OPENING AND AWARD OF BIDS — MONROE PARKING LOT AND STREET
IMPROVEMENTS — PROJECT NO. 117-043 (RWDA TIF)
This was the date set for receiving and opening of sealed bids for the above referenced project.

to the lowest responsive and responsible bidder Walsh & Kelly, Inc., 24358 SR 23, South Bend,
IN, in the amount of $228,898.08. Therefore, Ms. Maradik made a motion that the
recommendation be accepted and the bid be awarded and the contract approved subject to
Redevelopment funding approval. Ms. Fritzberg seconded the motion, which carried.

Mr. Jeff Hudak, Central Services, advised the Board that on April 25, 2017, bids were received
and opened for the above referenced equipment. After reviewing those bids, Mr. Hudak
recommended that the Board award the contract to the lowest responsive and responsible bidder
Vermeer of Indiana, 13402 Britton Park Road, Fishers, IN 46038, in the unit amount of
$546,090.28. Therefore, Ms. Maradik made a motion that the recommendation be accepted and
the bid be awarded as outlined above. Ms. Fritzberg seconded the motion, which carried.
AWARD BID — ONE (1) OR MORE 2017 OR NEWER COMPACT TRACK LOADER
SPEC K (VENUES PARKS & ARTS CAPITAL LEASE)
Mr. Jeff Hudak, Central Services, advised the Board that on May 9, 2017, bids were received and
opened for the above referenced equipment. After reviewing those bids, Mr. Hudak
recommended that the Board award the contract to the lowest responsive and responsible bidder
Hull Lift Truck/Bobcat of Michiana, 28747 Old US 33 West., Elkhart, IN 46514, in the unit
amount of $57,299.29. Therefore, Ms. Maradik made a motion that the recommendation be
accepted and the bid be awarded as outlined above. Ms. Fritzberg seconded the motion, which
carried.
AWARD BID AND APPROVE PURCHASE AGREEMENT — SALE OF CITY -OWNED
PROPERTY - 1721 PRAIRIE AVENUE
Ms. Debrah Jennings, Community Investment, advised the Board that on March 14, 2017, bids
were received and opened for the above referenced property. After reviewing those bids, Ms.
Jennings recommended that the Board award the contract to the sole responsive and responsible
bidder, Richard Fox, 12813 Westwood Lane, Wayland, MI 49348, in the amount of $1,030.00
plus recording and advertising fees for a total of $1,137.32. Also presented at this time for
approval was the Purchase Agreement. Therefore, Ms. Maradik made a motion that the
recommendation be accepted and the bid be awarded as outlined above and the Purchase
Agreement be approved. Ms. Fritzberg seconded the motion, which carried.
AWARD BID AND APPROVE CONTRACT — CURB AND SIDEWALK DIVISION A —
PROJECT NO. 117-008
Mr. Kevin Fink, Engineering, advised the Board that on May 9, 2017, bids were received and
opened for the above referenced project. After reviewing those bids, Mr. Fink recommended
that the Board award the contract to the lowest responsive and responsible bidder Walsh &
Kelly, Inc., 24358 SR 23, South Bend, IN 46614, in the amount of unit prices not to exceed
$109,024. Therefore, Ms. Maradik made a motion that the recommendation be accepted and the
bid be awarded and the contract approved as outlined above. Ms. Fritzberg seconded the motion,
which carried.
AWARD BID AND APPROVE CONTRACT — CURB AND SIDEWALK DIVISIONS B-F —
PROJECT NO. 117-008
Mr. Kevin Fink, Engineering, advised the Board that on May 9, 2017, bids were received and
opened for the above referenced project. After reviewing those bids, Mr. Fink recommended
that the Board award the contract to the lowest responsive and responsible bidder Ziolkowski
Construction, Inc., 4050 Ralph Jones Drive, South Bend, IN 46628, in the amount of unit prices
not to exceed $260,381. Therefore, Ms. Maradik made a motion that the recommendation be
accepted and the bid be awarded and the contract approved as outlined above. Ms. Fritzberg
seconded the motion, which carried.

In a memorandum to the Board, Mr. Corbitt Kerr, Community Investment, requested permission
to reject all bids for the above referenced projects due to being over budget. Therefore, upon a
motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, with Mr. Mueller recusing
himself, the above request to reject bids was approved.
AWARD QUOTATION — LEIGHTON PLAZA IMPROVEMENTS PHASE 2 — PROJECT
NO. 117-054A (RWDA TIF/SPECIAL DONATIONS)
Ms. Alexandria Schultz, Engineering, advised the Board that on May 18, 2017, quotations were
received and opened for the above referenced project. After reviewing those quotations, Ms.
Schultz recommended that the Board award the contract to the lowest responsive and responsible
bidder, C&S Masonry Restoration LLC, 3725 N. Foundation Ct., Ste. A-B, South Bend, Indiana
46628, in the amount of $37,808 for Division A and $20,196 for Division B. Therefore, Ms.
Maradik made a motion that the recommendation be accepted and the quotation be awarded as
outlined above. Ms. Fritzberg seconded the motion, which carried.
AWARD PROPOSAL — LAWN MAINTENANCE AND MENTORSHIP PROGRAM (VPA
MISCELLANEOUS SERVICES)
Mr. Patrick Sherman, Venues Parks & Arts, advised the Board that on May 9, 2017, proposals
were received and opened for the above referenced project. After reviewing those proposals, Mr.
Sherman recommended that the Board award the contract to the highest scoring company,
Greater Impact Lawn Care, 615 Cushing Street, South Bend, IN 46616, in the amount of $20 per
lawn, not to exceed $20,000. Therefore, Ms. Maradik made a motion that the recommendation be
accepted and the quotation be awarded as outlined above. Ms. Fritzberg seconded the motion,
which carried.
APPROVE CHANGE ORDER NO. 13 — SOUTH BEND ONE-WAY TO TWO-WAY
CONVERSION, DIVISION B — PROJECT NO 116-001B (2015 TIF BOND)
Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted Change Order No. 13 on behalf
of Rieth-Riley Construction Co., Inc., 25200 State Road 23, South Bend, IN 46614, indicating
the contract amount be increased by $14,912.70 for a new contract sum, including this Change
Order, in the amount of $17,616,742.55. Upon a motion made by Ms. Maradik, seconded by Ms.
Fritzberg and carried, the Change Order was approved.
APPROVE CHANGE ORDER NO. 9 — WASTEWATER TREATMENT PLANT
SECONDARY TREATMENT IMPROVEMENTS — PROJECT NO 114-053 (2011 AND 2012
SEWER BONDS, WASTEWATER EQUIPMENT PURCHASES/TREATMENT &
DISPOSAL)
Mr. Gilot advised that Mr. Jacob Klosinski, Wastewater, has submitted Change Order No. 9 on
behalf of Thieneman Construction, Inc., 17241 Foundation Parkway, Suite 100, Westfield, IN
46074, indicating the contract amount be increased by $27,084.00 for a new contract sum,
including this Change Order, in the amount of $13,046,684.87. Upon a motion made by Ms.
Maradik, seconded by Ms. Fritzberg and carried, the Change Order was approved.
APPROVE CHANGE ORDER NO. 1 — CALVERT STREET LIFT STATION
REPLACEMENT —PROJECT NO. 116-053 (WASTEWATER CAPITAL ACCOUNT)
Mr. Gilot advised that Mr. Jacob Klosinski, Wastewater, has submitted Change Order No. 1 on
behalf of 14RP Construction, Inc., 5777 Cleveland Road, South Bend, IN 46628, indicating the
contract amount be increased by $10,805.80 for a new contract sum, including this Change
Order, in the amount of $927,805.80. Upon a motion made by Ms. Maradik, seconded by Ms.
Fritzberg and carried, the Change Order was approved.
APPROVE CHANGE ORDER NO 2 (FINAL) AND PROJECT COMPLETION AFFIDAVIT
— CHIPPEWA AVENUE EMERGENCY REPAIRS —PROJECT NO 116 083F (COIT)
Mr. Gilot advised that Mr. Villa, Engineering, has submitted Change Order No. 2 (Final) on
behalf of JCI Bridge Group, Inc., PO Box 368, LaPorte, IN 46350 indicating the contract amount
be decreased by $2,910.95 for a new contract sum, including this Change Order, of $180,853.30.
Additionally submitted was the Project Completion Affidavit indicating this new final cost of
$180,853.30. Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried,
Change Order No. 2 (Final) and the Project Completion Affidavit were approved.

Mr. Gilot stated an application for a Revocable Permit has been received from Jones, Petrie,
Rafinski Corporation for the purpose of allowing the installation of an awning at their offices at
325 S. Lafayette Blvd. The encroachment shall remain in the right of way until the time as the
Board of Public Works of the City of South Bend shall determine that such encroachment is in
