SEWER MAIN LINE EXTENSION AGREEMENT <br />This Sewer Main Line Extension Agreement ("Agreement") is made on the 23rd day of <br />May, 2017 by and between St. Joseph County, Indiana ("County") and the City of South Bend, a <br />municipal corporation existing under the laws of Indiana ("City"), acting by and through its Board <br />of Public Works. <br />WHEREAS, County has constructed a sewer main line for the benefit of a planned <br />development located adjacent to Walnut Road and U.S. Highway 20 near New Carlisle, Indiana, <br />as described in the Donohue & Associates study attached and incorporated herein as Exhibit A <br />("Donohue Study"). <br />WHEREAS, the sewer main line is located in the area ("Service Area") depicted in Exhibit <br />B, attached and incorporated herein; and <br />WHEREAS, the engineering design for said sanitary sewer systems has been, or will be, <br />accomplished by competent professional engineers registered and licensed in the State of Indiana; <br />and <br />WHEREAS, the County shall be responsible for the bidding and construction of the sewer <br />main line, and all expenses related thereto. <br />NOW, THEREFORE, in consideration of the obligations, terms and conditions contained <br />herein, the adequacy of which the parties expressly acknowledge, County and the City agree as <br />follows: <br />1.
