Indiana Avenue NOTE: Council President Tim Scott entertained a motion to suspend the rules to hear Bill No. 17-20,Bill No. 17-21, and Bill No. 17-22 in the Community Investment Committee and to move the hearing for Bill No. 17-17 from the Community Investment Committee agenda to the Zoning and Annexation Committee agenda.This motion was made by Councilmember Gavin Ferlic and seconded by Councilmember Dr.David Varner. This motion carried unanimously by a voice vote of six(6)ayes. Committee Vice-Chair John Voorde called to order the Zoning and Annexation Committee meeting at 4:20 p.m. He introduced the members of the committee and proceeded to give the floor to the presenters. Bill No. 17-17—Special Exception for 226 E. Indiana Avenue Ayoka Paek, Building Department with offices at 125 Lafayette Street, stated, This special exception application for a duplex in an SF-2— Single Family/Two (2) Family District—comes to you with a favorable recommendation from the Area Board of Zoning Appeals. It was initiated first by the owner of the property. They inquired about the legal non-conforming status of the property. She was unable to verify that process, so she is going through this special exception process. There were persons at the ABZA meeting that spoke in remonstrance of the application. Concerns were raised about the overall effect the duplex would have on the surrounding area, as well as the current condition of the property. Concerns were also raised about the possible increase in on-street parking and increased traffic. The findings of fact from the ABZA meeting addressed the concerns raised by the neighborhood. To be used as a duplex, the owner must make sure they are meeting all the code requirements. Duplexes require two (2) on-site parking spaces per unit, so four(4) total. That issue would be addressed at a later date. Dora Cruz, 226 E. Indiana Avenue, stated, I bought this property for my daughter who is in college. We want to give it to her. I am seeking the special exception so my daughter can have one floor and will have the other floor to rent. I have money to address the issues but stopped the process of fixing things until I got this special exception. Committee Vice-Chair Voorde opened the floor to members of the public wishing to speak in favor of or in opposition to the legislation. Will Smith, 728 Whitehall Drive, stated, I checked the location out, I did have some concerns about parking but it seems like that will be addressed differently. Primarily the roof on the structure needs to be addressed as well. With no other members of the public wishing to speak, Committee Vice-Chair Voorde turned the floor back to the Committee for further discussion or main motion. Committeemember Gavin Ferlic made a motion to send Bill No. 17-17 to the full Council with a favorable recommendation. Committeemember Jo M. Broden seconded the motion which carried by a voice vote of three (3) ayes. With no further business, Committee Vice-Chair Voorde adjourned the Zoning and Annexation Committee meeting at 4:25 p.m. Resp ly Submi d, John Voorde, Committee ice-Chair 2
