Presented by me to the Mayor of the City of South Bend, Indiana j)erPmher I9 19 City Clerk Approved and signed by me December 15, 1964 ZkA- C� - Mayor RESOLUTION OF THE COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING GENERAL NEIGHBORHOOD RENEWAL PLAN WHEREAS, pursuant to the provisions of Title I of the Housing Act of 1949, as amended, the City of South Bend Department of Redevelopment (herein called the "Local Public Agency") has entered into a contract, designated Contract No. Ind. R-41(GN)(A) with the Federal Government pursuant to which the Government has made available to the Local Public Agency financial assistance for the preparation of a General Neighborhood Renewal Plan for the urban renewal area designated as the LaSalle Park Area in the City of South Bend, State of Indiana (herein called the "Locality"); and WHEREAS the Local Public Agency proposes to undertake with Federal financial assistance one or more urban renewal projects in the above-described urban re- newal area; and WHEREAS there has been prepared and referred to the Common Council of the City of South Bend, Indiana (herein called the "Governing Body") for review and approval a General Neighborhood Renewal Plan for the urban renewal area, dated August 14, 1964, entitled "General Neighborhood Renewal Plan for the LaSalle Park Area" and consisting of 18 pages and 9 exhibits; and WHEREAS said General Neighborhood Renewal Plan has been approved by the gov- erning body of the Local Public Agency, as evidenced by the copy of said body's duly certified resolution approving said General Neighborhood Renewal Plan which is attached thereto; and WHEREAS there have also been presented to the Governing Body certain supplemen- tary data, including data respecting estimated grant-in-aid requirements, relocation requirements and resources, and governmental actions required to carry out said General Neighborhood Renewal Plan; and WHEREAS a general plan is in existence and is recognized and used as a guide for the general development of the Locality as a whole; and, also there has been pre- sented to the Housing and Home Finance Administrator, and said Administrator has approved, a Program for Community Improvement (Workable Program) for the community; and WHEREAS the City of South Bend Plan Commission which is the duly designated and acting official planning body for the Locality, has reported to the Governing Body respecting the conformity of said General Neighborhood Renewal Plan to the general plan for the Locality as a whole: NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: 1� That the General Neighborhood Renewal Plan for the area aforementioned, having been duly reviewed and considered, is hereby approved; that it is determined to be adequate as an outline of the urban renewal activities proposed for the area involved, as a framework for the preparation of urban renewal plans, and as an indication generally, to the extent feasible in pre- liminary planning, of land uses, population density, building coverage, pros- pective requirements for the conservation and rehabilitation of property, and any portions of the area contemplated for clearance and redevelopment, and that the Executive Director of the Department of Redevelopment be and is hereby directed to file said copy of the General Neighborhood Renewal Plan with the minutes of this meeting. -1- GN 304 .,. �� - ,, i ��I I� f 6 r I I I 2. That it is hereby found and determined that said General Neighborhood Re- newal Plan for the urban renewal area conforms to the general plan of the Locality and to the Program for Community Improvement. 3. That it is the intention of this Body that the General Neighborhood Renewal Plan be used to the fullest extent feasible as a guide for the provision of public improvements in such area, and that said Plan will be considered in formulating codes and other regulatory measures affecting property in the area and in un- dertaking other local governmental activities pertaining to the development, redevelopment, conservation, and rehabilitation of the area. 4. That in order to implement and facilitate the effectuation of the Plan hereby approved, this Body hereby (a) pledges its cooperation in helping to carry out the Plan,; (b) requests the various officials, departments, boards, and agencies of the Locality having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the Plan; and (c) stands ready to con- sider and take appropriate action upon proposals and measures designed to effectuate the Plan. He is the duly qualified and acting City Clerk of the City of South Bend, Indiana, (hereinafter called the "Locality"), and the custodian of the records of the Locality, including the minutes of the proceedings of the Common Council (hereinafter called the "Governing Body"), and is duly authorized to execute this certificate. 2. Attached hereto is a true and correct copy of a resolution, including the WHEREA. clauses, adopted at a meeting of the Governing Body held on the day of , 1964, (hereinafter called the "Resolution of the Governing Body"). 3o The Resolution of the Governing Body has been duly recorded in the minutes of said meeting and is now in full force and effect. 4. Said meeting was duly convened and held in all respects in accordance with law and the bylaws of the Locality. To the extent required by law or said bylaws, due and proper notice of said meeting was given. A legal quorum of members of the Governing Body was present throughout said meeting, and a legally sufficient number of members of the Governing Body voted in the proper manner for the adoption of the Resolution of the Governing Body. All other requirements and proceedings under law, said bylaws, or otherwise, incident to the proper adoption of the Resolution of the Governing Body, including any publication, if required by law, have been duly fulfilled, carried out, and otherwise observed. 5� If the seal appears below, it constitutes the official seal of the Locality and was duly affixed by the undersigned at the time this certificate was signed. Nowak, Acting Director Department of Redevelopment DATE: December 3, 1964 SUBJECT: Indiana R-41 LaSalle Park (GN) Local Approval Data Resolution The General Neighborhood Renewal Plan of the LaSalle Park Project Area was adopted by the South Bend Redevelopment Commission on September 3, 1964 and the City Planning Commission adopted a similar resolution on Septem- ber 14 which approved the general framework and outline that the Plan is in conformance in all respects to the City of South Bend Master Plan. Subsequently, on October 23, Mayor Lloyd Allen received a confirmation letter from the Housing and Home Finance Agency approving our submission of the General Neighborhood Renewal Plan which then authorized us to proceed with the next phase of obtaining the local approvals (City Council) regarding the Survey and Planning Application Resolution which was adopted on November 23rd. The resolution now before you pertains to Part II of the General Neighbor- hood Renewal Plan Data which also requires your consideration for adoption at the next regular scheduled meeting. Carl R.
