RESOLUTION NO. 254-70 .
A RESOLUTION FOR TRANSFER OF FUNDS
APPROPRIATED FROM THE CUMULATIVE SEWER
BUILDING AND SINKING FUND BY ORDINANCE
NO . 5154-70 FROM PROJECT III TO
PROJECT I IN THE AMOUNT OF $150, 000 .00 .
WHEREAS , funds have been appropriated under Ordinance
No . 5154-70 from the Cumulative Sewer Building and Sinking Fund
for the construction of Projects defined as I, II, III and IV, and
WHEREAS , it is now apparent that work cannot proceed on
Project III in the immediate future , and
WHEREAS , plans have been completed and bids taken for
Section B of Project I
NOW, THEREFORE, BE IT RESOLVED, by the Common Council
of the City of South Bend :
Section 1 . That the following Project be reduced in the
amount set opposite said Project to-wit :
Project III (Sampson & Randolph Street Storm
Water Detention Basin (#3) - - - - - $150, 000 .00
Section 2 . That the following Project be increased in the
amount set opposite said Project to-wit:
Project I (Washington & 36th Street Storm Water
Detention Basin (Lagoon K) - - - - - - $150, 000 .00
That the transfer of funds as set forth in Sections 1
and 2 are required for the proper and efficient operation and
function of the Department of Public Works of South Bend, and an
emergency is declared to exist concerning the foregoing transfer .
This resolution shall be in full force and effect from
and after its passage by the Common Council of the City of South
Bend.

WHEREAS : In 1957 an engineering report on relief and extension of
sewer facilities was prepared by Consoer, Townsend and
Associates , and
;6H AS : tris report set forth the needs for extending sanitary
trunk sewers to the outlying areas , and
= HEREAS : one such trunk sewer was recommended to serve area H, being
defined as the eastern branch of Bowman Creek serving a
drainage area extending south along Michigan Street and
south of the then city limits , and
WHEREAS : in 1962 this plan was initiated by construction of the
southwest trunk sewer south along the Penn Central Railroad
to Ireland Road, and
WHEREAS : more recent studies have shown a need for further extension
of the southwest trunk sewer to serve the highly developed
residential areas south of the U.S . 20-31 By-Pass where soil '.
conditions make septic sewer systems impractical, and
WHEREAS : by Ordinance No . 5137-70 the Common Council annexed the area
between Ireland Road and the By-Pass , and by Ordinance
No . 5177-70 has annexed the area along South Michigan Street
from the By-Pass to Kern Road, and
WHEREAS : the Board of Public Works and Safety has authority under the
Acts of the General Assembly of 1905 , Chapter 129 as amended ,
to layout , design , order and contract for and execute the
construction, alteration and maintenance of all public drains
or sewers within such city and all drains and sewers without
such city and within four (4) miles thereof which may be
necessary to carry off the drainage of such city and to
erect, maintain and operate works for the collection , treat-
ment and disposal of sewage , and now

BE IT RESOLVED, that the Board of Public Works and Safety finds it
necessary for the public health, safety and welfare that
the southwest sanitary trunk sewer be extended south to
service the area along South Michigan Street to Johnson
Road, and that said Board hereby orders that the necessary
design plans be prepared, that easements and right-of-ways
be acquired by gift, purchase or condemnation , that appro-
priations be sought, that bids be taken for construction ,
that contracts be entered into, and that said construction-:
shall take place .

AN ORDINANCE APPROPRIATING THE SUM OF $583, 510 .00
FROM THE CUMULATIVE SEWER BUILDING AND SINKING
FUND.
WHEREAS, engineering studies have been completed
outlining certain storm water flood control projects, and
WHEREAS, funds are now needed for appraisals, land
accxuisition, design engineering and construction of said first
priority projects, and
WHEREAS, a Cumulative Sewer Building and Sinking Fund
has been established.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL
OF THE CITY OF SOUTH .BEND, INDIANA:
SECTION I. That the sum of $583, 510.00 be appropriated
from the Cumulative Sewer Building and Sinking Fund for the
projects and in the amounts set forth below:

Project II - 1970
Ponsha & 33rd Street Storm Water

SECTION II. This ordinance shall be in full force and
