RESOLUTION NO. 276-71
RESOLUTION AUTHORIZING FILING OF APPLICATION WITH
THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT,
UNITED STATES OF AMERICA, FOR A GRANT UNDER
P. L. 89-117.
WHEREAS, pursuant to P. L. 89-117 the United States of America
has authorized the making of grants to public bodies to aid in
financing the construction of basic water and sewer projects:
NOW, THEREFORE, be it resolved by the Common Council of the City
of South Bend, Indiana:
1 . That Lloyd M. Allen, Mayor of South Bend, Indiana be and he is
hereby authorized to execute and file an application on behalf of the
City of South Bend, Indiana with the Department of Housing and Urban
Development, United States Government, for a grant to aid in financing
the construction of a separated storm and sanitary sewer system in the
South Bend Model Cities area, and an assurance of compliance with the
Department of Housing and Urban Development regulations under Title VI
of the Civil Rights Act of 1964.
2. That Lloyd M. Allen, Mayor of South Bend be and he is hereby
authorized and directed to furnish such information as the Department
of Housing and Urban Development may reasonably request in connection
with the application which is herein authorized to be filed.

TO: Members of the Common Council
SUBJECT: Resolution to designate signatory for an application for federal
assistance on the Model Cities Sewers Separation Project.
An application for federal assistance was made to the Department of Housing
and Urban Development for the purpose of separating the combined sewers in
the Model Cities area. This partial application was reviewed by HUD and
we were informed on May 20, 1971 that the application met their minimum
criteria for further consideration. They now desire that we submit a "full"
application for this project.
One of the required parts of this application is a resolution by the Council
denoting a signatory for this full application. To satisfy this requirement
a resolution has been prepared for your consideration.
As a sidelight, it should be noted that South Bend presently is mandated by
the Indiana Stream Pollution Control Board to separate all of the City' s
combined sewers by 1977. Thus , any assistance in this direction should be
welcome.
Finally, let me apologize for not presenting this matter at the Thursday
caucus meeting. We were aware that this blank application was on the way but
we were not apprised of the necessity for this particular resolution. In
addition, we have given HUD a verbal commitment to return the completed
application within two weeks after receipt. Since this deadline will be before
the next regular meeting, we have submitted the resolution at this time.
