A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND TO APPROVE SPECIAL ENGINEERING STUDIES
AND REPORTS OF THE ARCHITECT'S CONTRACT FOR THE
CIVIC CENTER PROJECT.
WHEREAS, the Common Council of the City of South Bend have approved
various appropriations as required per the contractual
arrangements specified in the Architect's Contract for
the Civic Center Project, Resolution No. 374 -73 passed
June 11, 1973, and
WHEREAS, the Civic Center Authority and the Board of Public Works
of the City of South Bend has approved the following
special reports required of the Architect:
1. Foundation Report $ 17,000
Halpert & Neyer
2. Spread Footing Design 9,500
Skilling,Helle,Christiansen,
Robertson
$ 26,500 and
WHEREAS, the Civic Center Authority and the Board of Public Works has
authorized the architectural firm of Philip Johnson and
John Burgee to proceed with the above reports,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
South Bend, Indiana:
SECTION I. That the proposed Contracts pertaining to
the above in the amount of $26,500 approved by the
Civic Center Authority and Board of Public Works, are
hereby approved.
SECTION II. This Resolution shall be in full force and effect
from and after its adoption by the Common Council and approval
by the Mayor.

A resolution is being submitted requesting your approval of two engineer-
ing reports totaling $26,500, to be paid as additional services to the
Johnson /Burgee Architectural Contract for the Civic Center Project.
The events which lead to the authorization of this work by the Civic
Center Authority are as follows:
In June of 1974 the Architect was authorized to proceed with construction
drawings for the building. By November 30, 1974, a complete set of draw-
ings and specifications for a) site excavation and demolition,
b) piling,
c) pile caps and associated foundation
concrete, were completed by the Architect. The pile foundation concept
represented by these plans was based upon owner furnished reports,
construction practices in the immediate area, and certain physical require-
ments of the Civic Center building itself. This concept was a sound
approach to the foundation aspects of the building, and were accepted by
the Owner as such. In the spring months of 1975, the Architect, in
pursuing certain aspects of the piling specifications, requested that
one of their associates, Halpert & Neyer Associates - Soils Engineers,
become involved, at the Architect's expense.
As a result of their involvement, Halpert and Neyer Associates reported
to the Architect that while the pile concept was indeed a sound system
for Century Center, they felt that there was a possibility that the
site would also lend itself to a different foundation system, referred
to as a spread footing system. The switch to such a system would be
of advantage to the owner, in that a savings of approximately $175,000
in construction costs would be realized, and secondly approximately two

to three months construction time would be cut from the project.
The Architect established that should the owner direct that said
foundation changes be requested, the owner would be charged for the
associated studies, reports, design and re- design efforts as an
additional service, in keeping with his contract with the owner.
These additional services are quoted at $26,500; as stated in the
ordinance.
Authorization of such action by the Civic Center Authority would
therefore result in a net savings of approximately $150,000 and two
months construction time. Based upon these facts and the concurrence
of this office, said Authorization was issued.
