Project: Olive Street Reconstruction
From Prairie Avenue to 220 ft north of railroad south of Tucker Drive

This Contract Amendment is made and entered to this Contract between the City of South Bend Board of
Public Works (hereinafter referred to as "LPA") and Lawson -Fisher Associates P.C. (hereinafter referred
to as "CONSULTANT').
WHEREAS, the LPA and CONSULTANT did February 24, 2015 enter into a Contract for project
development services for the above reference project.
WHEREAS, the LPA desires that CONSULTANT provide additional services to extend the project
south to the intersection of S.R. 23 (Prairie Avenue) and also north to approximately 250 ft north of the
railroad tracks and south of Tucker Drive.
WHEREAS, the LPA desires the CONSULTANT provide additional services for a reduced
roadway section, sidewalk on the east side where viable, lighting design, and other amenities that will
require revisions and updates to already completed work at Stage 2 Plan submission.
WHEREAS, the LPA desires the CONSULTANT provide additional services for an expansion of
the geotechnical investigation for the additional project limits north and south.
WHEREAS, the LPA desires the CONSULTANT provide additional services for an expansion of
the utility coordination for the additional project limits north and south.
WHEREAS the LPA desires the CONSULTANT provide additional services for title and
encumbrance reports, right-of-way engineering for the purpose of land acquisition through these project
limits.
WHEREAS, the LPA desires the CONSULTANT provide additional services for public
involvement and conducting a design hearing as part of the environmental documentation.
WHEREAS, the LPA desires the CONSULTANT provide additional services for construction
phase services as part of project development.
WHEREAS, the LPA desires the CONSULTANT to provided additional services to address
changes to the road reconstruction, changed project limits, additional walkway on the east side of Olive
Street, additional right-of-way required, changes to the environmental documentation as requested and
directed; and
WHEREAS, in order to provide for completion of the work, it is necessary to amend and
supplement the contract in the amount of $271,000.00
NOW, THEREFORE, it is agreed by and between the parties that the following Appendices are
amended:

Appendix "A" is amended as follows:
I. CHANGE Task 1 —The CONSULTANT shall prepare an Environmental Assessment (Category
Exclusion -Level 2) services for this project. All work shall comply with all National Environmental
Policy Act (NEPA), NEPA related regulations and guidelines, and comply with INDOT's
Procedural Manual for Preparing Environmental Studies and Categorical Exclusion Manual,
2. CHANGE Task 2 — The CONSULTANT shall expand the survey limits to 300 feet north of the
centerline of the railroad tracks and prepare a Location Control Route Survey conforming to 865
I.A.C. for the purpose of right-of-way acquisition.
3. ADD to Task 5 — The CONSULTANT shall increase the number of soil borings with an additional
four (4) borings with an average depth of 10 feet each and incorporate the findings with the
previous eight (8) borings with an average depth of 15 feet each and update the completed
geotechnical investigation.
4. ADD Task 6 — Design Summary/Public Involvement — The CONSULTANT shall set up and hold
meetings, when needed, in cooperation with the LPA and INDOT, with local officials, planning
agencies or commissions, within the local populace. The CONSULTANT shall prepare
presentation materials for hearings or meetings in accordance with "Public Hearing Visual Display
Preparation Guide" dated March 1994. The CONSULTANT shall have for project design
engineer attend and participate in any such meetings, prepare and distribute minutes, and
prepare letters in response to all questions.
5. ADD Task 7 — Right-of-way Plan Development— The CONSULTANT shall be responsible for
administration, scheduling, and coordinating all activities necessary to certify that the construction
is clear for letting including meetings, conferences, communications, with property owners,
attorneys, engineers, and INDOT and/or the LPA.
6. ADD Task 8 —Construction Phase Services —The CONSULTANT shall be available at
reasonable times, during normal working hours, to respond to inquiries concerning the accuracy
or intent of the CONSULTANT's plans. On projects involving signing and lighting the
CONSULTANT shall review all shop drawings. The CONSULTANT shall also perform utility
coordination services during construction. These Utility Coordination Services shall include
acting as a liaison between utility companies and the LPA, answering questions, interpreting
plans, coordinating activities, and other actions as needed or directed.
Appendix "C" is amended as follows:
All work by the CONSULTANT under this Contract shall be completed and delivered to the LPA for review
and approval within the approximate time periods shown in the following submission schedule:

Appendix "D" is amended as follows:
A. 1. The consultant shall receive payment for the work performed under this contract the total
amount not to exceed is $210,000 $461,000 unless an amendment is executed by the parties
which increases the maximum amount payable and funding approval.
2. The CONSULTANT shall be paid for the work performed under this Contract on a lump sum
basis in accordance with the following fees:

3. The CONSULTANT will be paid for the services described in Task 4 and Task 8 of Appendix
"A" on a labor rate multiplier basis. The CONSULTANT will be paid for the actual hours of work
performed by essential personnel exclusively working on these tasks at the direct wage and
salary rates of each employee multiplied by 3.135, PLUS direct non -salary costs as approved by
the LPA. The direct labor rates shall not exceed the INDOT maximum applicable at the time of
service. The maximum allowable rate is available on the INDOT website. Direct non -salary costs
shall be the actual out-of-pocket expenses of the CONSULTANT directly attributable to this
Contract, such as fares, subsistence, mileage, equipment rentals, reproductions, approved sub -
consultant fees, etc., however, the direct non -salary costs for travel reimbursement shall not
exceed the limitations on travel expenses set out in the current State policy on travel
reimbursement.

5. The CONSULTANT shall receive payment for the work performed under this Contract related

Modify Paragraph 1:

Project Description: This project consists of road reconstruction with installation of new curbs, storm
drainage, pavement, approaches, incidental resurfacing, and other pertinent work. Road construction
begins S.R. 23 Prairie Avenue intersection and Olive
Street intersection and continues north approximately 2,485 feet to 6 3.640 ft to 220 ft north of the
railroad crossing. The northern project end limit is coincidental with the begin construction limit for Des.
No. 1298579. Sidewalks will be reconstructed where they currently exist and added sidewalk along the
east where viable and upgraded for ADA compliance in accordance with INDOT policies and standards.
Collected storm water will be piped below grade into existing separated storm sewer within Olive Street
existing right-of-way.
Modify Paragraph 2, last sentence: The project length is approximately 047 0.69 miles including
intersecting public road approaches.
Modify Paragraph 5:
The proposed typical section will consist of two 42 11 foot travel lanes with center left 12 foot lane and
8 feet shoulders/parking on the west between Ewing Avenue and Calvert Street and st4ght faGe
combined curb and gutter for the full project length.section MatAh the
ad}aining project _ Des No. 12996:79 Pavement width variations are expected at intersections with
public road approaches to the extent necessary based on INDOT design criteria. A five (5) foot sidewalk
is proposed on the west side where present between Ewing Avenue and Calvert
Street. Existing roadway vertical profile shall be reused to the extent possible for project areas exceeding
INDOT minimum vertical grade requirements.
Modify Part A. Field Survey:
1. A Location Control Route Survey Plat (LCRSP) will net be prepared as ne additional right-of-way
is anticipated. Existing right-of-way, property ownership, and intersecting public road approach
centerlines shall be established from recorded plats and recovered property corners.

C. The signature, seal, and registration number of the land surveyor, registered in the State of
Indiana, who was in responsible charge of the survey, shall be affixed to the Location
Control Route Survey and the survey book submitted. In addition, VS shall complete the
field survey as summarized below and as directed by the Client. The project area to be
field surveyed is described as follows:

Olive Street
Beginning 50 feet south of the centerline of Ewing Street, survey north 3,325 feet to a point
175 feet north of the centerline of the railroad tracks.
Ewing Avenue
Beginning 100 feet west of the centerline of Olive Street, survey west 300 feet to a point
200 feet east of the centerline of Olive Street.
Delaware Street
Beginning 100 feet west of the centerline of Olive Street, survey west 250 feet to a point
150 feet east of the centerline of Olive Street.
Calvert Street
Beginning 100 feet west of the centerline of Olive Street, survey west 250 feet to a point
150 feet east of the centerline of Olive Street.
Dubail Street
Beginning at the centerline of Olive Street, survey west 150 feet to a point 150 feet east of
the centerline of Olive Street.
Indiana Avenue
Beginning at the centerline of Olive Street, survey west 150 feet to a point 150 feet east of
the centerline of Olive Street.
Indiana Court
Beginning 100 feet west of the centerline of Olive Street, survey west 100 feet to the

Total survey includes 4,525 lineal feet of roadway.
D. Obtain last deed of record, subdivision plats, and section or auditor plats for all properties
within the project limits from local and state agencies. The property information shall
include parcel number, property owner's name, mailing address and property location. VS
shall provide a listing of all property information, deeds, plats, and maps.

E. Send out surrey notices together with questionnaires (if applicable) to all property owners
within the project area. All surrey notices and questionnaires shall be approved by Client
prior to distribution.
F. Establish Primary Horizontal Control within the project limits such that the survey base
line(s) can be re-established during construction. A local ground coordinate system will be
established and tied to the East Zone of the Indiana State Plane Coordinate System,
NAD83(2011) per the -DOT Survey Manual.
G. Tie in the survey base lines to available USPLSS section corners and/or existing
property/right-of�--way monumentation. All necessary section corners will be located or re-
established to adequately define property lines along the limits of the project during the
Right-of-way Engineering or Easement Acquisition phase.
H. Re-establish existing roadway alignments from plans for previous projects.
Plot right-of-way and property lines based on observed physical evidence and record
documents acquired from local government agencies.
J. Prepare and record a Location Control Route Survey Plat depicting existing alignments,
right-of-way. Property lines and owner information for adjoining properties will be shown,
but not dimensioned.
Note: Items D, E, F, G, H and I will be updated from the initial phase of the project as needed
to meet the requirements for completing a Location Control Route Survey per I.A.C. 865 Rule 12
and the INDOT Survey Manual_

SCOPE OF SERVICES

Project Description: Olive Street Pavement Reconstruction

VS ENGINEERING, INC. (VS) shall provide field surveying services for the above referenced
project. VS shall furnish all labor, materials, and equipment to perform the surveying services
described below for the fee identified in the attached Fee Justification (See Attachment No. 2).
Field Surveying Services
BASIC SERVICES
A. VS shall survey the project location and provide one set of original field notes, all field
survey data collected via electronic media, and one set of master drawings. VS shall
obtain section corner, right -of --way, easement, and state plane coordinate information as
necessary to satisfactorily complete the basic field survey services described herein within
the project limits. VS shall prepare and record a Location Control Route Survey. VS work
shall be in accordance with Indiana Code (I.C. 25-21.5); Indiana Administrative Code (865
I.A.C. 1-12); and the Design Manual, Indiana Department of Transportation, Part III,
Location Surveys (Survey Manual), a copy of which is on file with INDOT. If there is any
conflict between I.C. 25-21.5, 865 I.A.C. 1-12, or the Survey Manual, the order of
precedence shall be:
1. I.C. 25-21.5,
2. 865 I.A.C. 1-12, and
3. Survey Manual
B. Electronic files including the following shall be prepared and submitted by VS as directed
by client:
1. Electronic points file in .txt or .xml coordinate format.
2. Location Control Route Survey Plat in .pdf format.
3. Survey Book in .pdf format (updated from previous phase)

C. The signature, seal, and registration number of the land surveyor, registered in the State of
Indiana, who was in responsible charge of the survey, shall be affixed to the Location
Control Route Survey and the survey book submitted. In addition, VS shall complete the
field survey as summarized below and as directed by the Client. The project area to be
field surveyed is described as follows:
Survey Limits (See Attachment No. 1)
Olive Street
Beginning 50 feet south of the centerline of Ewing Street, survey north 3,325 feet to a point
175 feet north of the centerline of the railroad tracks.
Ewing Avenue
Beginning 100 feet west of the centerline of Olive Street, survey west 300 feet to a point
200 feet east of the centerline of Olive Street.
Delaware Street
Beginning 100 feet west of the centerline of Olive Street, survey west 250 feet to a point
150 feet east of the centerline of Olive Street.
Calvert Street
Beginning 100 feet west of the centerline of Olive Street, survey west 250 feet to a point
150 feet east of the centerline of Olive Street.
Dubail Street
Beginning at the centerline of Olive Street, survey west 150 feet to a point 150 feet east of
the centerline of Olive Street.
Indiana Avenue
Beginning at the centerline of Olive Street, survey west 150 feet to a point 150 feet east of
the centerline of Olive Street.
Indiana Court
Beginning 100 feet west of the centerline of Olive Street, survey west 100 feet to the
centerline of Olive Street.
Total survey includes 4,525 lineal feet of roadway.
D. Obtain last deed of record, subdivision plats, and section or auditor plats for all properties
within the project limits from local and state agencies. The property information shall
include parcel number, property owner's name, mailing address and property location. VS
shall provide a listing of all property information, deeds, plats, and maps.

E. Send out survey notices together with questionnaires (if applicable) to all property owners
within the project area. All survey notices and questionnaires shall be approved by Client
prior to distribution.
F. Establish Primary Horizontal Control within the project limits such that the survey base
line(s) can be re-established during construction. A local ground coordinate system will be
established and tied to the East Zone of the Indiana State Plane Coordinate System,
NAD83(2011) per the INDOT Survey Manual.
G. Tie in the survey base lines to available USPLSS section comers and/or existing
property/right-of-way monumentation. All necessary section corners will be located or re-
established to adequately define property lines along the limits of the project during the
Right-of-way Engineering or Easement Acquisition phase.
H. Re-establish existing roadway alignments from plans for previous projects.
Plot right-of-way and property lines based on observed physical evidence and record
documents acquired from local government agencies.
J. Prepare and record a Location Control Route Survey Plat depicting existing alignments,
right-of-way. Property lines and owner information for adjoining properties will be shown,
but not dimensioned.
Note: Items D, E, F, G, H and I will be updated from the initial phase of the project as needed
to meet the requirements for completing a Location Control Route Survey per I.A.0 865 Rule 12
and the INDOT Survey Manual.
