HomeMy WebLinkAboutSupplemental No. 1 to PSA - DLZ Indiana LLC - Bendix Drive7- .. d SUPPLEMENTAL AGREEMENT NO. 1 This Supplemental Agreement No. 1 is made and entered into this bday of � 1, 20AI by and between the City of South Bend, Indiana, acting by and through the Board of Public Works, hereinafter referred to asthe "LPA", and DLZ Indiana, LLC, 2211 East Jefferson Blvd., South Bend, IN 46615, hereinafter referred to as the "CONSULTANT". WITNESSETH WHEREAS, the LPA and CONSULTANT did, on February 10, 2015 enter into an agreement for the preparation of construction documents for the construction of the Road Reconstruction on Bend ix Drive. WHEREAS, during the course of design, certain additional services not included in the original contract dated February 10, 2015, have become necessary; specifically: • Convert plans from an overlay to "Complete Streets" 3-lane redesign. • Additional roadway design for lane transitions and the Nimtr Parkway jughandle design. • Change the design to full depth pavement, • Redesign of the Stage 2 Plans (Rework), • Addition of an & foot sidewalk, • Additional storm sewer assessment and replacement, • Additional Inlet Design, • Addition of traffic signal modifications, • Develop impacts and project costs for multiple conceptual lane configurations, • Evaluate impacts and project costs for adding sidewalks along Bendix while maintaining a 4 lane typical section and a 3 lane typical section, • Perform additional pavement design iterations, • Develop a Traffic Study, • Perform a Traffic Warrant Analysis at two intersections, if required, • Provide plan modifications for alternate bid pavement, • Develop Landscape Design and Plans, • Perform Right of Way Engineering Services. NOW THEREFORE, the LPA and the CONSULTANT desire to amend the above referenced Design Contract as follows: Delete Section IV Compensation of the LPA-Consulting Contract and replace with the following: SECTION 1V COMPENSATION. The LPA shall pay the CONSULTANT for the Services performed under this Contract as set forth in Appendix "D" which is herein attached to and made an integral part of this Contract. The maximum amount payable under this Contract shall not exceed $503,000.00. Delete Line 10 of Section V1.23. of the LPA-Consulting Contract and replace with the following: Eric Horvath, P.E. 1of13 Supplemental Agreement No. 1 III. Revise Subsection II.B. Appendix "A" as follows: B. The CONSULTANT shall provide engineering and prepare design plans, preliminary opinions of probable construction cost, and other submittal documents following the INDOT LPA Process Guidance Document for Local Federal Aid Projects, dated April 2012 and revisions thereto, for the Bendix Road Reconstruction Project in the City of South Bend, Indiana. The project limits are along Bendix Drive from approximately 320 feet south of the centerline of Lathrop Street to the 1-80 Toll Road Bridges for a length of approximately 5,730 feet. IV. Delete Subsection II.C.2.a. Appendix "A" and replace with the following: a. The LPA is implementing a road diet and reducing the typical section of Bendix Drive from four lanes to a three lane section, including one 11 foot wide travel lane in each direction with a 12 foot two way left turn lane, with new curbs each side and a 5 foot wide sidewalk with a 5 foot wide grass buffer along the east side of the roadway. The roadway shall be designed such that the proposed left back of curb matches the left existing back of curb location and elevation to the extent possible. Full depth reconstruction of Bendix Drive will extend from 470 feet north of the centerline of Lathrop Street to the south end of the 1-80 Toll Road Bridges. The jughandle at the intersection of Bendix Drive and Nimtz Parkway will be removed and replaced with an exclusive left turn lane for northbound traffic turning onto westbound Nimtz Parkway. Along Bendix Drive from approximately 320 feet south to 470 feet north of Lathrop Street, the pavement markings will be revised to transition from the existing four lane roadway section south of Lathrop to the new three lane roadway. The sidewalk shall extend south of the full depth reconstruction limits to the north side of Lathrop Street to allow for future extension. The change in the typical section along with the inlet spacing requirements for the corridor, will require adjusting and reconstructing existing inlets and manholes, adding additional inlets and manholes to collect storm water. The project shall also include replacement of 184 feet of storm sewer pipe to eliminate a deficiency in the trunk storm sewer. The change in scope for the project will require the CONSULTANT to abandon the current proposed design plans that were based on a four lane unbounded overlay pavement section. The plans were developed nearly to the Stage 2 level. The revised scope of work will develop the plans back to the Stage 2 level. V. Add Subsection II.C.2.d Ap pendix "A" as follows: d. The CONSULTANT shall complete design and plans for a traffic signal modification at the following intersections: i. The CONSULTANT shall complete design and plans for a traffic signal modification at the (2) intersections of Bendix Drive with Boland Drive and with Sugar Maple Lane and Court, to adjust the existing traffic signal heads to accommodate the changes to the typical section. Modifications to the 2of13 Supplemental Agreement No. 1 signal are limited to shifting signal heads and wiring. No changes to the mast arms, mast arm poles, strain poles and span and catenary will be performed. ii. The CONSULTANT shall complete design and plans for the replacement/modification of the traffic signal at the intersections of Bendix Drive with Nimtz Parkway. The plan is to adjust the existing traffic signals to accommodate a three lane typical section and the addition of a sidewalk along one side of the roadway. The modifications to the signal are anticipated to be the addition of pedestrian signals, push buttons, pedestrian poles, shifting signal heads and wiring. No changes to the mast arms and mast arm poles will be performed. However, if it is determined during design that the traffic signal needs to be replaced, the CONSULTANT shall develop design and plans for replacing the traffic signal. VI. Revise Subsection II.C.3.d. Appendix "A" as follows: d. The CONSULTANT shall complete a preliminary analyses of plausible alternatives for a full depth pavement sections using the MEPDG approach (AASHTOWare PavementME) and referencing Ch. 304 of the INDOT Design Manual and applicable memoranda. Our analysis along with a report of the existing pavement conditions and a patch location and joint repair table will be included in a draft report. With a full depth three lane pavement section, the CONSULTANT anticipates that INDOT will require an alternate bid. Therefore, it will be necessary to develop a pavement design for both o full depth concrete pavement section and o full depth HMA pavement section. The CONSULTANT shall submit documentation supporting a full depth concrete pavement section, in lieu of an alternate bid, for INDOT's consideration. VII. Revise Subsection II.C.3.f. Appendix "A" as follows: f. The CONSULTANT shall complete Life Cycle Cost Analysis for Alternate bid pavement, if required. Vill. Add Subsection II.C.3.h. Appendix "A" as follows: h. The CONSULTANT shall design and detail up to 13 curb ramps at a total of 6 intersections within the project limits. The ENGINEER shall develop geometrics and spot elevations for all curb ramps in accordance with INDOT requirements. IX. Add Subsection II.C.3.i. Appendix "A" as follows:_ i. If an alternate bid is required, the CONSULTANT shall prepare the plans to include alternate bid for pavement with opinions of probable construction cost and special provisions. X. Add Subsection II.D.13. Appendix "A" as follows: 13. The CONSULTANT shag prepare an Additional Information Document (Al) to approved Level ICE. The following services pertain to potential environmental effects associated with full depth reconstruction of the Bendix Road pavement as opposed to the previously proposed 3of13 Supplemental Agreement No. 1 white -topping and the addition of sidewalks in some locations. It is understood that the modified project would not require the acquisition of more than 0.5 acre of right of way, including temporary right of way. a. Perform field reconnaissance of the newly proposed construction limits to assess the potential for impacts upon social, economic and environmental resources. b. Perform coordination with INDOT Environmental Services' Cultural Resources Office (CRO) regarding the continued applicability of the Minor Projects Programmatic Agreement (MPPA). c. Prepare an updated MPPA submittal for review and approval by CRO. d. Conduct environmental studies to assess the impacts upon social, economic and environmental resources. e. Prepare a Draft At and submit to INDOT Environmental Services for review and comment. f. Revise the Draft Al per INDOT Environmental Services' comments, and submit the Final Al for INDOT approval. g. Prepare copies of the Al for distribution per INDOT guidelines for distribution of approved NEPA documents. h. Update the environmental commitments database spreadsheet, as appropriate, and send to the iNDOT Project Manager. L The above described environmental compliance services numbered shall be performed in accordance with INDOT/FHWA-IN guidance documents including the Procedural Manual for Preparing Environmental Documents (20081, the INDOT Categorical Exclusion Manual (2013), the INDOT cultural Resources manual (2014 and other guidance and/or procedures issued by INDOT and FHWA. Xl. Revise Subsection II1.28 Appendix "A" as follows: 28. Traffic ^^^a' ...affants, tFagiG counts at intersections and/or traffic signal upgrades, except as noted. Xll. The CONSULTANT shall perform an evaluation and develop a probable construction cost for adding sidewalk along a four lane roadway including the following three alternatives: 1. Adding a 5 foot sidewalk along one side of the roadway crossing from east to west at the intersection of Bendix Drive with Sugar Maple Lane. The analysis was based on not acquiring any additional right of way for the project. This required an analysis of the existing cross sections to determine the limits and approximate height of retaining walls required to eliminate impacts to the adjacent properties. 2. Adding an 8 foot sidewalk along one side of the roadway crossing from east to west at the intersection of Bendix Drive with Sugar Maple Lane. The analysis was based on not acquiring any additional right of way for the project. This required an analysis of the existing cross sections to determine the limits and approximate height of retaining walls required to eliminate impacts to the adjacent properties. 4of13 Supplemental Agreement No. 1 3. Adding a 5 foot sidewalk along both sides of the roadway. The analysis was based on not acquiring any additional right of way for the project. This required an analysis of the existing cross sections to determine the limits and approximate height of retaining walls required to eliminate impacts to the adjacent properties. XIV. Add Subsection II.N. Appendix_"A" as follows: N. The CONSULTANT shall perform an evaluation and develop a probable construction cost for a Three Lane roadway section for adding sidewalk along a three lane roadway including the following two options: 1. Adding an 8 foot sidewalk along one side of the roadway crossing from east to west at the intersection of Bendix Drive with Sugar Maple Lane. The CONSULTANT developed a conceptual strip map of the project site for use in determining the quantities. The analysis was based on not acquiring any additional right of way for the project. This required an analysis of the existing cross sections to the limits and approximate height of retaining walls required to eliminate impacts to the adjacent properties. 2. Adding a S foot sidewalk along both sides of the roadway. The analysis was based on not acquiring any additional right of way for the project. This required an analysis of the existing cross sections to determine the limits and approximate height of retaining walls required to eliminate impacts to the adjacent properties. XV. Add Subsection 11.0. Appendix "A" as follows: O. The CONSULTANT shall develop a Traffic Study for the Bendix Drive Corridor. Traffic data from the LPA provided 2015 traffic counts will be used for this task including the following: 1. Construction is anticipated to occur in 2018. The CONSULTANT shall apply an annual traffic growth rate to traffic data to determine projected construction year (2018) and design year (2038) intersection traffic volumes for the following four intersections: a. Bendix Drive and Lathrop Street. b. Bendix Drive and Boland Street. c. Bendix Drive and Sugar Maple Lane and Court. d. Bendix Drive and Nimtz Parkway. The annual growth rate shall be provided by the LPA or MACOG. 2. The CONSULTANT shall utilize the SYNCHRO software to evaluate the capacity of the signalized intersection of Bendix Drive and Nimtz Boulevard. Three alternatives will be analyzed, as stated below: a. Alternative 1: NB Left Turn Lane / No lug Handle (no westbound movement), with multiple phasing options. b. Alternative 2: Jug Handle with 2 Lanes (existing configuration). c. Alternative 3: Jug Handle with 1 Lane. These capacity analyses will be used to identify the intersection Level of Service (LOS) and capacity restraints that may exist at the intersection for each alternative. The analyses will be performed for the traffic volumes for the peak periods (AM and PM). 3. The CONSULTANT shall utilize the SYNCHRO software to perform an arterial analysis of the Bendix corridor extending from Lathrop Street to Nimtz Boulevard. The capacity of the four signalized intersections will be analyzed for the proposed configurations as a result of a roadway road diet. The four signalized intersections are: a. Bendix Drive and Lathrop Street. 5of13 Supplemental Agreement No. 1 b. Bendix Drive and Boland Street. c. Bendix Drive and Sugar Maple Lane and Court. d. Bendix Drive and Nimtz Parkway. These capacity analyses will be used to identify the intersection Level of Service (LOS) and capacity restraints that may exist at the intersections. The analyses will be performed far the traffic volumes for the peak periods (AM and PM) for existing, construction year 2018 and the design year 2038. 4. For the purpose of evaluating a need for the exclusive turn lanes, the CONSULTANT shall perform right and left turn lane warrant analyses using the guidelines and procedures presented in the INDOT design manual. The CONSULTANT shall determine turn lane length requirements based on SYNCHRO queue data from Task 3 above. The analyses and calculations will be performed for the following intersections: a. Bendix Drive and Lathrop Street. b. Bendix Drive and Boland Street. c. Bendix Drive and Sugar Maple Lane and Court. d. Bendix Drive and Nimtz Parkway. 5. Based on the preceding tasks, the CONSULTANT shall recommend intersection improvements for the evaluated intersections. This task will include turn lane recommendations, storage and taper lane lengths recommendations. 6. The CONSULTANT shall prepare a report in letter format outlining the findings and recommendations for the LPA's review. XVI. Add Subsection H.P. Appendix "A" as follows: P. The CONSULTANT shall develop one conceptual lane assignment alternative based on transitioning from a three lane pavement section on Bendix Drive at the intersection with Sugar Maple Lane/Court, through the intersection of Nimtz Parkway, to a four lane typical section at the south end of the bridges over the Indiana Toll Road. The alternative shall be based on the findings of the preliminary Level of Service analyses for the following three alternatives at the intersection of Bendix Drive and Nimtz Parkway (all options are based on a three lane roadway section through the intersection of Bendix Drive and Sugar Maple Lane and Court): 1. A single lane jug handle. 2. A double lane jug handle. 3. No jug handle with on exclusive northbound left turn lane. XVII. Add Subsection II. . Appendix "A" as follows: Q. The CONSULTANT shall perform a traffic signal warrant analyses for up to two intersections, as required, in accordance with the Indiana Manual on Uniform Traffic Control Devices (IMUTCD). The projected 2018 traffic volumes calculated as part of the traffic evaluation will be used for the analyses. Existing 12-hour intersection counts shall be provided by the LPA for this task XVIIi. Add Subsection II.R. Appendix "A" as follows: R. The CONSULTANT shall develop Landscape Design and Plans, including the following: 1. Preliminary Landscape Design a. Schedule a scoping meeting with LPA representatives including the LPA Arborist. 6of13 Supplemental Agreement No. 1 b. Develop a Preliminary Conceptual Design for the corridor, including sub - alternatives where required. The conceptual design shall consist of a plan drawing with up to 3 typical sections to convey the design intent. c. Present Preliminary Conceptual Design to the LPA. d. Upon authorization, incorporate revisions necessary to satisfy the LPA's review and comment, and develop a Final Conceptual Design. e. Present Final Conceptual Design to the LPA. 2. Final Landscape Design a. Prepare Final Design and Plans utilizing the approved Final Conceptual Design. b. Develop special provisions, compute quantities and prepare an estimate of probable construction cost. c. Attend Final Plan review meeting with the City. d. Upon authorization, incorporate revisions necessary to satisfy the City's review and comment, and develop Final Tracings. XIX, Add Subsection II.T. Appendix "A" as follows: T. The CONSULTANT shall perform all right of way activities in accordance with INDOT's and FHWA's procedures as outlined in the INDOT - LPA Guidance Document, Chapter 9, Rev July 31, 2015, INDOT Right of Way Engineering Manual, current edition and iAC Title 865. 1. Obtain the last Deed of Record Report for each tax id for temporary right of way parcels. 2. Calculations to determine stations, offsets and placement on plans. 3. Provide descriptions for temporary easements for driveway construction or lawn grading. Separate descriptions are required far each tax id. The descriptions shall be prepared and certified by a land surveyor registered in the State of Indiana. 4. Parcel Plats are not required for temporary parcels. 5. Provide separate folder for each parcel including an applicable plan sheet. 6. An Appraisal Problem Analysis shall be prepared for each of the parcels. The Appraisal Problem Analysis will be performed by an INDOT approved review appraiser for the purpose of recommending the type, scope and fee of each appraisal to be prepared. Each Appraisal Problem Analysis report shall be submitted to the LPA for approval. XX. Add Subsection II.U. Appendix "A" as follows: U. The CONSULTANT shall provide Bid Phase Services, design support to the Resident Project Engineer (Construction Phase Office Services), as required, and as directed by the LPA. 1. Review the final construction documents distributed by INDOT for bidding purposes including the Contract Information Book (Cie) for conformance with the CONSULTANT's final tracing submittal. 2. Issue responses, as appropriate to interpret, clarify or expand the Bidding Documents that are not directly related to an error or omission from the CONSULTANT. 3. Following award of contract(s), the CONSULTANT shall be responsible for attending the Pre -Construction Meeting. 4. The CONSULTANT will meet at the project site with the LPA or Resident Project Engineer, as required and as directed by the LPA, to assist in matters that may arise during the construction of the project for the duration of construction. 7of13 Supplemental Agreement No. 1 S. The CONSULTANT will make his services available to the LPA during the construction of the work for the interpretation of the plans where disagreement may arise and for consultation during construction in the event unforeseen or unusual conditions arise. 6. The CONSULTANT shall review working (shop) drawings for conformance with the plan documents. Review of such submittals is not conducted for the purpose of determining the accuracy and completeness of other details such as dimensions and quantities, or for substantiating instructions far installation or performance of equipment orsystems, all of which remain the responsibility of the Contractor as required by the contract. Reviews shall not constitute approval of safety precautions or, of any construction means, methods, techniques, sequences or procedures. Approval of specific item shall not indicate approval of an assembly of which the item is a component. The submittals shall be reviewed and returned to Resident Project Engineer within 7 calendar days after submittal to CONSULTANT. XXI. Add Items 14. to 24. to Appendix "B" as follows: 14. Guarantee access to and make all provisions for the CONSULTANT to enter upon public and private lands as required for the CONSULTANT to perform the work under this Agreement. 15. Conveyance instruments which have been prepared and/or approved for each parcel by LPA legal counsel. 16. Recording of all transfer documents after the parcel is acquired by the Buyer. 1Z Legal counsel for condemnation proceedings and for legal services in connection with the project. 18. The money and delivery for all payments due property owner and/or applicable property interests. 19. Copies of the location and/or design study reports, if applicable. 20. Copies of the environmental studies and/or approvals, if applicable. 21. Partial mortgage release fees. 22. Copies of recorded documents and proof of payment. 23. Property Management 24. Condemnation legal services, if required. 8of13 Supplemental Agreement No. 1 XXII. Delete A endix "C" and replace with the following, APPENDIX "C" SCHEDULE: No work under this Contract shall be performed by the CONSULTANT until the CONSULTANT receives a written notice to proceed from the LPA. All work by the CONSULTANT under this Contract for the design of this project shall be completed and delivered to the LPA for review and approval within the approximate time periods shown in the following submission schedule, see Exhibit 2: The anticipated letting date for the project is September 12, 2018, based on receipt of FMIS and Notice to Proceed with Right of Way acquisition activities before September 7, 2017. XXIII. Delete Exhibit 2 of Appendix "C" and replace with _attached revised Exhibit 2: XXIV. Revise Subsections LA and 1.13 of Appendix "D" as follows: li. Amount of Payment A. The CONSULTANT shall receive as payment for the work performed under this Agreement the total fee not to exceed $503,000.00 unless a modification of this agreement is approved in writing by the LPA. If a right of way acquisition Subconsultant is utilized, the CONSULTANT shall receive as payment the actual cost incurred by the CONSULTANT. XXV. Amendment: 10 of 13 Supplemental Agreement No. 1 Supplement Agreement No. 1 increases the current contract fee of $303,000.00 by $200,000.00 to $503,000.00 and incorporates all other terms and conditions as set forth in the original Agreement dated February 10, 2015. The original Agreement, dated February 10, 2015, shall remain in full force and effect, except as herein modified. The undersigned attests, subject to the penalties for perjury, that he is the contract party, or that he is the representative, agent, member or officer of the CONSULTANT that he has not, nor has any other member, employee, representative, agent or officer of the firm, company, corporation or partnership represented by him, directly or indirectly, to the best of his knowledge, entered into or offered to enter into any combination, collusion of agreement to receive or pay, and that he has not received or paid, any sum of money or other consideration for the execution of this Contract other than that which appears upon the face of the Contract.
