RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
APPROVING THE URBAN RENEWAL PLAN TOGETHER WITH THE PROPOSED
AMENDMENTS THERETO AND PLAN CHANGES FOR THE LASALLE PARK
PROJECT, INDIANA R -57
WHEREAS, under the provisions of Title I of the Housing Act of 1949,
as amended, the Department of Housing and Urban Development Administrator is
authorized to provide financial assistance to Local Public Agencies for under-
taking and carrying out urban renewal projects; and
WHEREAS, it is provided in such Act that contracts for financial
aid thereunder require that the Urban Renewal Plan for the project area be
approved by the governing body of the locality in which the project is situated
and that such approval include findings by the governing body that: (1) the
financial aid to be provided in the contract is necessary to enable the project
to be undertaken in accordance with the Urban Renewal Plan; (2) the Urban
Renewal Plan will afford maximum opportunity, consistent with the sound needs
of the locality as a whole, for the rehabilitation or redevelopment of the
urban renewal area by private enterprise; (3) the Urban Renewal Plan conforms
to a general plan for the development of the locality as a whole; and (4)
the Urban Renewal Plan gives due consideration to the provision of adequate
park and recreational areas and facilities, as may be desirable for neighbor-
hood improvement, with special consideration for the health, safety, and welfare
of children residing in the general vicinity of the site covered by the Plan;
and
WHEREAS, the City of South Bend, Department of Redevelopment
(herein called the "Local Public Agency "), has entered into a planning
contract for financial assistance under such Act with the United States
of America, acting by and through the Secretary of Housing and Urban
Development, pursuant to which Federal funds were provided for the urban
renewal project (herein called the "Project "), identified as "LaSalle Park
Project, Indiana R -57" and encompassing the area bounded by a line drawn
as follows:
Beginning at the point of intersection of the north right -
of -way line of Linden Avenue and a line which is an extension
of the west right -of -way line of the alley between and parallel
to Sheridan Avenue and Chicago Street; proceed east along the
north right -of -way line of Linden Avenue to a point 129.0 feet,
more or less, east of the east right -of -way line of Falcon
Street; thence south along a line which is 129.0 feet, more
or less, east of and parallel to the east right -of -way line of
Falcon Street, a distance of 388.3 feet, more or less; thence
at 90 degrees in a westerly direction a distance of 129.0 feet,
more or less, to the east right -of -way line of Falcon Street;
thence south along said right -of -way line a distance of 485.7
feet, more or less; thence at 90 degrees in an easterly direction
a distance of 129.0 feet, more or less, to the west right -of -way
line of the alley between and parallel to Falcon Street and Lake
Street; thence south along said alley right -of -way line a distance
of 116.0 feet, more or less; thence at 90 degrees in an easterly
direction a distance of 203.0 feet, more or less, to the east
right -of -way line of Lake Street; thence south along said right -
of way line a distance of 50.0 feet, more or less; thence at 90
degrees in an easterly direction a distance of 793.0 feet, more
or less, to the west right -of -way line of the alley between and
parallel to Kentucky Street and Dundee Street; thence south along
said alley right -of -way line a distance of 250.0 feet, more or
less; thence at 90 degrees in an easterly direction along a
line north of and parallel to the north right -of -way line of
Washington Street, to the west right -of -way line of the alley
west of and parallel to Kaley Street; thence north along said alley
right -of -way line to the south right -of -way line of the New York
Central Railroad; thence southeasterly along said right -of -way
line to the east right -of -way line of the first alley east of
and parallel to Meade Street; thence south along said alley right -
of way line to the center line of the first alley north of and
parallel to Western Avenue; thence west along said alley center
line to the west right -of -way line of the alley between and parallel
to Sheridan Avenue and Chicago Street; thence north along said
alley right -of -way line to the north right -of -way of Linden
Avenue which is the place of beginning.
WHEREAS, the Local Public Agency has made detailed studies of the
location, physical condition of structures, land use, environmental influences,
and the social, cultural, and economic conditions of the Project Area and has
determined that the area is a blighted area and that it is detrimental and a
menace to the safety, health, and welfare of the inhabitants and users thereof
and of the Project Area, because of the presence of blighted structures and
the lack of adequate community improvements, and the members of this Governing
Body have been fully appraised by the Local Public Agency and are aware of
these facts and conditions. Due to the changing market conditions governing
land use, certain land acquisition should be deleted in order to update the
Urban Renewal Plan in accordance with these current market conditions and
update plan studies; and
WHEREAS, there has been prepared and referred to the Common Council
of the Project Area (herein called the "Governing Body ") for review and approval
certain revised pages to the Urban Renewal Plan for the Project Area, dated
November 1, 1965.
WHEREAS, the Urban Renewal Plan and the amendments and plan changes
proposed by those certain pages presented at this meeting have been approved
by the Local Public Agency, as evidenced by the copy of said Body's duly
certified Resolution No. 533 approving the Urban Renewal Plan and said amendments
and plan changes which resolution and which revised pages are attached thereto;
and
WHEREAS, a general plan has been prepared and is recognized and used
as a guide for the general development of the Project Area as a whole; and
WHEREAS, the Area Plan Commission of St. Joseph County, which is
the duly designated and acting official planning body for the Project Area,
has submitted to the Governing Body its report and recommendations respecting
said Urban Renewal Plan and said amendments and plan changes for the Project
Area and has certified that said Urban Renewal Plan and said amendments and
plan changes conform to the said general plan for the Project Area as a whole,
and the Governing Body has duly considered said report, recommendation, and
certification of the planning body; and
WHEREAS, the Urban Renewal Plan and said amendments and plan changes
for the Project Area prescribe certain land uses which the Project Area will
require, among other things, changes in zoning, the vacating and removal of
streets, alleys, and other public ways, the establishment of new street
patterns, the location and relocation of sewer and water mains and other
public facilities, and other public action; and

WHEREAS, the Governing Body is cognizant of the conditions that are
imposed in the undertaking and carrying out of urban renewal projects with
Federal financial assistance under Title I, including those proscribing
discrimination because of race, color, creed, sex or national origin:
NOW THEREFORE, BE IT RESOLVED by the Common Council of the City
of South Bend:
1. That it is hereby found and determined that the Project
Area is a blighted area and qualifies as an eligible Project
Area under the Redevelopment of Cities and Town Act of 1953,
as amended.
2. That the Urban Renewal Plan, and the amendments and plan changes
thereto proposed, presented at this meeting for the Project
aforementioned, having been duly reviewed and considered, are
hereby approved, and the City Clerk be and is hereby directed
to file copies of said Urban Renewal Plan and said amendments
and plan changes with the minutes of this meeting.
3. That it is hereby found and determined that the objectives of
the Urban Renewal Plan cannot be achieved through further land
acquisition and that further acquisition should not be under-
taken.
4. That it is hereby found and determined that said Urban Renewal
Plan and said amendments and plan changes for the Project Area
conform to the general plan of the City and County.
5. That it is hereby found and determined that the financial
aid provided and to be provided pursuant to the contract
for Federal financial assistance pertaining to the Project is
necessary to enable the Project to be undertaken in accordance
with the Urban Renewal Plan and the proposed amendments and
plan changes for the Project Area.
6. That it is hereby found and determined that the above mentioned
Urban Renewal Plan and the proposed amendments and plan changes
for the Project Area will afford maximum opportunity, consistent
with the sound needs of the City and County as a whole, for
the urban renewal of such areas by private enterprise.
7. That it is hereby found and determined that the Urban Renewal
Plan and the proposed amendments and minor plan changes for
the Project Area give due consideration to the provision of
adequate park and recreational areas and facilities, as may
be desirable for neighborhood improvement, with special consideration
for the health, safety, and welfare of children residing in the
general vicinity of the Project Area.
8. That in order to implement and facilitate the effectuation of
the Urban Renewal Plan and the proposed amendments and plan
changes hereby approved, it is found and determined that
certain official action must be taken by this Governing Body
with reference, among other things, to changes in zoning, the
vacating and removal of streets, alleys, and other public
ways, the establishment of new street patterns, the location
and relocation of sewer and water mains and other public
facilities, and other public action, and accordingly, this Body
hereby (a) pledges its cooperation in helping to carry out such

Urban Renewal Plan as amended by those certain pages presented
at this meeting; (b) requests the various officials, departments,
boards, and agencies of the City having administrative responsibilities
in the premises likewise to cooperate to such end and to exercise
their respective functions and powers in a manner consistent
with said Urban Renewal Plan as amended by those certain pages
presented at this meeting; and (c) stands ready to consider
and take appropriate action upon proposals and measures designed
to effectuate said Urban Renewal Plan as amended by those
certain pages presented at this meeting.
9. That additional financial assistance under the provisions of
Title I of the Housing Act of 1949, as amended, may be necessary
to enable the land in the Project Area to be renewed in accordance
with the Urban Renewal Plan and the proposed amendments and plan
changes for the Project Area and, accordingly, the filing by
the Local Public Agency of an application or applications for
such financial assistance under said Title I is hereby approved.

The Department of Redevelopment is submitting the attached Resolution for your
consideration. The purpose of this Resolution is to secure the Council'sapproval
of the Redevelopment Commission's proposed change of the LaSalle Park Project,
Ind. R -57, Urban Renewal Plan.
The substance of the change is the deletion of certain parcels of land from
the Plan's acquisition list. The Commission feels that it would take an un-
due amount of time, effort and money to acquire these parcels in relation to
the benefit to be derived.
In addition, the further time spent acquiring the properties would unduly delay
the impending close out of the Project. The Commission has, therefore, determined
that the acquisition of these parcels is no longer desirable and, also, that the
best interests of the City will be served by the expeditious closing of the R -57
Project.
The Department, therefore, requests that you approve the attached Resolutions so
that it may proceed with the speedy close out of Project Ind. R -57.

RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOP14ENT COMMISSION RE-
DECLARING THE LASALLE PARK RENEWAL AREA TO BE BLIGHTED AND RE-
APPROVING AN URBAN RENEWAL PLAN FOR PROJECT NUMBER INDIANA R -57
AND FOR THE MAKING OF CERTAIN CHANGES TO THE URBAN RENEWAL PLAN
WHEREAS, the City of South Bend, Department of Redevelopment, pursuant to the
Redevelopment of Cities and Towns Act of 1953, as amended, conducted surveys
and investigations and thoroughly studied the area in the City of South Bend,
County of St. Joseph, State of Indiana, designated as the LaSalle Park Urban
Renewal Area which is more particularly described by a line drawn as follows:
Beginning at the point of intersection of the north right -of -way
line of Linden Avenue and a line which is an extension of the west
right -of -way line of the alley between and parallel to Sheridan
Avenue and Chicago Street; proceed east along the north right -of-
way line of Linden Avenue to a point 129.0 feet, more or less,
east of the east right -of -way line of Falcon Street; thence south
along a line which is 129.0 feet, more or less, east of and parallel
to the east right -of -way line of Falcon Street, a distance of 388.3

WHEREAS, upon such surveys, investigations and studies made, it has been found
by the City of South Bend Redevelopment CommisQion that the above - described
area is blighted to an extent that such blighted conditions cannot be corrected
by regulatory process, or by the ordinary operations of private enterprise
without resort to the provisions of the Redevelopment of Cities and Towns Act
of 1953, as amended, and it has been further found that the public health
and welfare would be benefited by the acquisition and redevelopment of such
area under the provisions of such Act; and
WHEREAS, the Commissioners have caused to be prepared maps and plans showing
the boundaries of such blighted area, the location of the various parcels of
properties, streets and alleys and other features affecting the acquisition,
clearance, replanning and redevelopment of such area, and indicating the parcels
of property to be included in the acquisition and portions of the area acquired
which are to be devoted to streets, parks, playground, and other public purposes
under the redevelopment plan; and
WHEREAS, certain parcels have not yet been acquired and the Redevelopment
Commission has determined that the acquisition of these parcels will in no
way further the rehabilitation of the LaSalle Park Project Area and therefore,
these acquisition parcels should not be acquired; and

1. That the LaSalle Park Urban Renewal Area, which is described in the first
"WHEREAS" clause hereof, is blighted and constitutes a menace to the social
and economic interest of the City of South Bend and its inhabitants and
that it will be of public utility and benefit to acquire such area and
redevelop the same under the provisions of the Redevelopment of Cities
and Towns Act of 1953, as amended.
2. That an amendatory application in behalf of the City of South Bend, Department
of Redevelopment deleting from the acquisition list of the LaSalle Park
Urban Renewal Plan those acquisition parcels not yet acquired, which are

specifically enumerated on Attachment "A" which is attached hereto and
incorporated by reference herein, and amending the Cost Estimate and
Financing Plan and the Project Expenditure Budget to reflect the decrease
in expenditures caused by this deletion is hereby approved and that
the Executive Director is hereby authorized and directed to execute and
file such application with the Department of Housing and Urban Development,
to provide such additional information and to furnish such documents as
may be required in behalf of this Department and to act as the authorized
correspondent of the City of South Bend, Department of Redevelopment.
3. That the Urban Renewal Plan, together with the proposed amendments
thereto, is hereby in all respects approved and the Secretary is hereby
directed to file a certified copy of said Urban Renewal Plan, with proposed
amendments, with the minutes of this meeting.
4. That the United States of America and the Secretary of the Department of
Housing and Urban Development be, and they hereby are, assured of full
compliance by the City of South Bend, Department of Redevelopment, with
regulations of the Department of Housing and Urban Development effectuating
Title VI of the Civil Right Act of 1964.
