A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND AUTHORIZING THE BOARD OF PUBLIC WORKS
TO NEGOTIATE THE SALE OF LOT NUMBERED THIRTY -SIX
(36) IN ARNOLD AND PAGIN'S SUBDIVISION IN THE CITY
OF SOUTH BEND, COMMONLY KNOWN AS 235 N. STUDEBAKER STREET.
WHEREAS, the Board of Public Works of the City of South Bend,
Indiana, pursuant to the Municipal Code of the City of South Bend,
Chapter 14.5, has offered for sale a parcel of land described as
Lot Numbered Thirty -six (36) in Arnold and Pagin's Subdivision
of the City of South Bend, commonly known as 235 N. Studebaker
Street, at an offering price of $552.00, and
WHEREAS, the Board of Public Works of the City of South Bend
has now received an offer to purchase the property at 235 N.
Studebaker Street for a price of $300.00, with the additional
commitment to repair the broken sidewalk and curbing on the
property within a period of one hundred and twenty (120) days
from the date of the contract, and
WHEREAS, the Board of Public Works has now complied with all
requirements of the Municipal Code of the City of South Bend,
Chapter 14.5, which establishes procedures for the disposition of
real property owned by the City of South Bend, and more specifically
real property valued by the Board at less than $1,000.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of South Bend that:
SECTION I. The Board of Public Works be authorized to
negotiate a contract for the sale of
Lot Numbered Thirty -six (36) in Arnold and Pagin's
Subdivision in the City of South Bend, commonly
known as 235 N. Studebaker Street
for a total price of $300.00, with the contract to stipulate
that the purchaser ;gill repair the broken sidewalk and curbing
on the property within a period of one hundred and twenty (120)
days from the date of the contract.
SECTION II. This resolution shall be in full force and effect
from and after its' adoption by the Common Council and approval
by the Mayor.

PURCHASE AGREEMENT
THIS AGREEMENT entered into this �_ day of

hereinafter referred to as Buyer, and the Civil City of South Bend,
a municipal corporation of the State of Indiana, hereinafter referred
to as City.
WITNESSETH:
WHEREAS, Ordinances No. 5387 -72 and 6137 -77 establish proce-
dures for the disposition and rental of real property owned by the
City of South Bend; and
WHEREAS, the Board of Public Works is empowered to carry out.

WHEREAS, based upon the appraisal submitted, the Board
established a valuation for the property; and
WHEREAS, said property valued by the Board is less than One
Thousand ($13000.00) Dollars; and
WHEREAS, pursuant to Ordinance No. 5387 -72, Section 114..5 -2(d)
the Board is empowered sum without '

contract."
NOW, THEREFORE, it is agreed by and between the parties hereto, .
and for and in consideration of the premises and the mutual. covenants
herein contained, as follows:
1. City agrees to sell and Buyer agrees to buy:
Lot Numbered Thirty -six (36) in
Arnold and Pag;in's Subdivision
commonly known as 235 11. Studebaker
Street, in the City of South Bend,
Indiana,
for the sum of Three Hundred ($300.00) Dollars.
2. Buyer agrees to pay the purchase price in full at the
time of closing.
3. Buyer agrees to pay all title and abstract costs invol'v(,d
in said transaction which he shall desire or request.
4. At the time oC closinf; and after a submission of a re-cel.r)t
for the total purchase price has been submitted by the Controller
to the Board of Public Works, the Board shall cause a. Quit- Claim
Deed to be prepared, which deed shall be si f;ned by the Mayor and
attested to by the City Clerk with the Seal of the City affixed.
4. It is expressly agreed that all terms and conditions of
this contract are included Herein, and no verbal agreements of any
kind shall be binding; upon the parties, and this contract shall be
binding upon all parties hereto, their heirs, administrators,
executors, successors, and assigns.
