G q 3- % S A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA ORDERING A HEARING ON PROPOSED FORM OF LEASE OF WATER WORKS FACILITIES OWNED BY SOUTH BEND FEDERAL SAVINGS AND LOAN ASSOCIATION WHEREAS, negotiations have been conducted over an extended period of time between South Bend Federal Savings and Loan Association and the Mayor and other members and employees of the Executive Department of the City of South Bend for the acquisition of water works facilities serving River Commons subdivision in Clay Township, St. Joseph County, Indiana; and WHEREAS, officers of the City have caused to be prepared a form of lease agreement between South Bend Federal Savings and Loan Association, as lessor, and the City, as lessee, the terms of which have been agreed upon by the lessor and officers of the City; and WHEREAS, it is necessary that a public hearing be held as provided by I.C. 19 -3- 11.5 -6. NOW, THEREFORE, BE IT RESOLVED BY the Common Council of the City of South Bend, Indiana: SECTION I. That a public hearing shall be held on June 26, 1978 on the necessity for the execution of such lease and the fair- ness and the reasonableness of the rentals provided therein, and the City Clerk shall give notice of such hearing in the manner provided in I.C. 19- 3- 11.5 -6. SECTION II. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor.
