August 28, 1961
A regular meeting of the Board of Public Safety was held on Monday, August
289 1961 at 10:00 A.M. DST. All members were present. Minutes of the last
regular meeting were read and approved. Vouchers were approved and ordered
paid to the various suppliers.
POLICE DEPARTMENT (CHARGES AGAINST OFFICERS)
Comes now Officer Matthew Puecker and his attorney, Joseph Ettel before the
Board to answer to charges of violation of Regulations 8, 9 and 12 of the
Rules and Regulations of the Police Department of South Bend.
Officer Puecker, through his attorney, does not admit to them and pleads
not guilty to any of the charges.
A hearing will be held on Friday, September 11 1961 at 1:30 P.M. DST in
the office of the Police Chief to hear this case. Officer Puecker is now
and will remain on suspension pending final action of the Board.
Comes now Officer Ralph W. Mullins before the Board to answer to charges
of violation of Regulations 89 9 and 12 of the Rules and Regulations of
the Police Department of South Bend.
Officer Mullins does not admit to them and pleads not guilty to any of
the charges.
The Board informed Officer Mullins that he had the right .to be represented
by counsel and a hearing will be held on Friday, September 4 1961 at
2:30 P.M. DST in the office of the Police Chief to hear this case. Officer
Mullins is now and will remain on suspension pending final action of the
Board.
_OPENING OF.BIDS (POLICE DEPARTMENT CARS)
This being the date set, it was so announced and healed bids were opened
and read by the Board. Proofs of publication from The South Bend Tribune
with affidavit signed by Robert DeLong and The Record with affidavid signed
by Kathleen Sweitzer were found sufficient. The following bids were

CHANGE ORDER RE: FIRE STATION NO. 13 BREHMER ELECTRIC 00.)
A Change Order from Callix Miller to ,Bxehmer.'Electric Company for work
at Fire Station #13 was examined by the Board. This Change Order is
for the sum of $514.00 and, would increase the existing contract by this
figure.
The Board, after examining the Order, approved same, subaect to there
being sufficient funds available for such Change Order.
REPORT: TRAFFIC ENGINEER (HOUSE MOVE)In compliance with a request.from
the Board to check out a prospective house move, in this instance the
str?ueture is a garage, said structure.was to be moved from 1017 Fisher
Street to rear of 606 Euclid Avenue.
After investigation, the Traffic Engineer recommends that permission be
granted provided specified time and routine is followed.
The Board, therefore, following the recommendation of the Traffic Engineer,
grants permission for the move.
TRAFFIC ENGINEER (TRAFFIC SIGNS)
The Board approved the following traffic sign installations:
Stop sign installed on Keller St., southwest corner, at Bendix Drive
Stop sign installed on Elwood, southwest corner, at Bendix Drive
Stop sign installed at 3201 Lincolnway West, at exit of parking lot just
north of Bendix Drive.
RE: ERECTION
OF NEON SIGN ( S. MICHIGAN ST.) BUILDING DEPARTMENT
Comes now Mr.
Vitale Carmelo, 2035 S. Michigan Street and
requested
permission to
erect a neon sign on city property in front
of his business
establishment.
Mr. Carmelo contends that a large tree on
the adjoining
property blocks the visibility of a sign erected on his own property.
Also present was Morgan Peck from the City Electrical Inspection Department.
It was brought to the attention of the Board by Mr. Carmelo and also Mr.
Peck that another neon sign post located at 2023 is erected on city
property and has been there for some years.
It was the decision of the Board, after hearing all persons present, that
permission to erect a sign on city property at 2035 S. Michigan Street
I be denied.
Mr. Lane, Building Commissioner who was also pres-ent, was instructed to
assist Mr. Carmelo by having somebody in his department or by taking care
of this personally, contact the neighbor with regard to the large tree
and attempt to secure the cooperation of the neighbor by trimming the
tree or removing it or, in some way, cooperate with Mr. Carmelo so that
a sign on his property is visible.
Mr. Lane requested a ruling on the sign post that already exists at 2023
S. Michigan Street. It was the decision of the Board that., since this
post has been in this location for some years, the owner will not be
directed to remove it. However, no new signs will be allowed on city
property.
SUB -STANDARD DIV. BUILDING DEPARTMENT (HEARINGS)
Comes now John Grabarz and Battalion Chief Downes of the Fire Department
with reference to property located at 720 N. Francis Street.
This house has been condemned, but the owner requested permission to repair
same. Completion date was August 28, 1961 and, at this time, the repairs
have not been completed. The owner requested additional extension of
time on the repair order.
Case continued until Ocober 16, 1961 at which time repairs must be completed.
With reference to a house at 275 S. Camden, owned by Sammy and Bessie Harper,
Mr. Grabarz reported that letters -had been sent letters listing what must
be done to bring property up to standard. He further stated that the owners
are anxious to comply with this order but request additional time.
Case continued for 90 days in order to bring property up to standard.
With reference to property located at 122 E. Paris Street, owned by Mr.
Rightley, Mr. Grabarz reported that letters sent to Mr. Rightley had been
returned. Case continued for one week to albow additional time to deliver
letter to Mr. Rightley to show cause why demolition order has not been
complied with.
ELECTRICAL DEPARTMENT (STREET LIGHTS)
Following the recommendation of Nicholas Horvath, Electrical Department
Superintendent, the following installations were approvedt
A 4000 lumen light at 809 Garden Lane
A 4000 lumen light at alley intersection of 900 Block North Goodland
Avenue, between Fredricksen and Prast.
FIRE DEPARTMENT APPLICATION
An application for the Fire Department from Michael Joseph Wegenka was
accepted and ordered placed on file.
STREET LIGHT OUTAGE REPORTS
Street Light,0utage Reports were accepted and ordered placed on file.
POLICE DEPARTMENT REPORT
A Report from the Police Department for the month of fly was accepted
and ordered placed on file.
GERMAN TOWNSHIP FIRE PROTECT ION OONTRACT
A Contract between the City of South Bend and German Township for Fire
protection was approved by the Board. Said Contract stipulates that payment
of fire protection fees shall be made once a year, on the 30th day of
December.
The Contract was ordered to be forwarded to the German Township Trustee
so that the members of the Advisory Board of German Township may approve
the document, sign and return to the Boaidd of Works & Safety for Filing.
There being no further business to come before the Board, the meeting
was adjourned at 10:45 S. M.
