accommodate future development for apartment units as part of the Berlin Place Mixed use project
adjacent to Four Winds Field: A part of the Southwest Quarter of Section 12, Township 37 North,
Range 2, East, City of South Bend, Portage Township, St. Joseph County, Indiana, and described as
follows: Beginning at the southeast corner of Lot 3 of the Coveleski park Minor Subdivision, the plat
of which is recorded in Instrument No. 1503430, in the Office of the Recorder of St. Joseph County,
Indiana; thence South 0 degrees 56 minutes 17 seconds East 82.50 feet to the northeast corner of Lot
4 in said Subdivision and being on the south right -of -way line of Monroe Street; thence South 89
degrees 13 minutes 50 seconds West 178.75 feet along the south right -of -way line of Monroe Street to
the southwest corner of the Monroe Street right -of -way and being on the east line of Lot 1 in said
Subdivision; thence North 0 degrees 59 minutes 56 seconds West 82.50 feet along the east line of said
Lot 1 to the northwest corner of the Monroe Street right -of -way; thence North 89 degrees 13 minutes

The approval of this vacation shall not be injurious to the use of other property in the immediate
vicinity. It shall not be detrimental to or endanger the public health, safety, morals, or general
welfare. This vacation also shall not constrict the use or deter the value of adjacent church as access
will be maintained at all times.

AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY:
The portion of W. Monroe Street that lies approximately 179 feet
west of S. Lafayette Blvd.
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36- 7 -3 -12, the Common Council is charged with the
authority to hear all petitions to vacate public ways or public places within the City.
The following Ordinance vacates the above described public property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend having held a Public
Hearing on the petition to vacate the following property:
A part of the Southwest Quarter of Section 12, Township 37 North, Range 2, East, City of
South Bend, Portage Township, St, Joseph County, Indiana, and described as follows:
Beginning at the southeast corner of Lot 3 of the Coveleski park Minor Subdivision, the plat of
which is recorded in Instrument No. 1503430, in the Office of the Recorder of St. Joseph
County, Indiana; thence South 0 degrees 56 minutes 17 seconds East 82.50 feet to the
northeast corner of Lot 4 in said Subdivision and being on the south right -of -way line of
Monroe Street; thence South 89 degrees 13 minutes 50 seconds West 178.75 feet along the
south right -of -way line of Monroe Street to the southwest corner of the Monroe Street right -of-
way and being on the east Tine of Lot 1 in said Subdivision; thence North 0 degrees 59
minutes 56 seconds West 82.50 feet along the east line of said Lot 1 to the northwest corner

SECTION II. The City of South Bend hereby reserves the rights and easements of all
utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities,
including, but not limited to, the following: electric, telephone, gas, water, sewer, surface
water control structures and ditches, within the vacated right -of -way, unless such rights are
released by the individual utilities.
SECTION III. The following property may be injuriously or beneficially affected by such
vacating:

Field (Preliminary Review)
Dear Mr. Hart:
The Board of Public Works, at its January 24, 2017, meeting, reviewed the following comments by the
Engineering Division, Area Plan Commission, Community Investment, Fire Department, Police
Department, and the Solid Waste Division regarding the above request:
Area Plan stated, per IC 36-7-3-13, the vacation would. not hinder the growth or orderly development of
the unit or neighborhood in which it is located, or to which it is contiguous. The vacation would not hinder
the use of a public right of way by the neighborhood in which it is located or to which it is contiguous.
Engineering; Area Plan, and Community Investment stated the vacation would make access to the lands
of the aggrieved person by means ofpublic way difficult or inconvenient and the vacation would hinder
the public's access to a church,.school or other public building or place, both violations of Indiana Statute.
Therefore, the Board of Public Works submitted a favorable recommendation for the vacation of this
street subject to completion of a signed and recorded permanent access agreement between the owner
of the Zion Missionary Baptist Church, Inc. and the South Bend Cubs received prior to submittal of the
application for vacation to the Common Council. A copy of the signed and recorded document shall be
provided to the Board of Public Works.
Please contact Donna Hanson at (574) 235 -9254 prior to nicking up your radius map You will need
a radius map showing properties within 150' of the proposed vacation for your petition to the Common
Council. Once you pick up the radius map, proceed to the City Clerk's office for your alley vacation
packet.

Dear Board Members:
The staff has reviewed this petition, and would note that in it's opinion, the ROW in question is a street and not an alley.
It is further the staff's opinion that:
(1) The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located
or to which it is contiguous,
The general street pattern has been re- aligned, causing the continuation of Monroe west of Lafayette to no longer
being needed for the redevelopment of the parcels adjacent to it.
(2) The vacation would make access to the lands of the aggrieved person by means of public way difficult or inconvenient.
The staff notes that the vacation of Monroe Street will effectively land -lock the parcel owned by Zion Missionary
Baptist Church, Inc. Property owners should have a reasonable guarantee that they have access to a dedicated public
right -of -way without having to rely on a private agreement.
(3) The vacation would hinder the public's access to a church, school, or other public building or place,
The staff is not aware if the building that would potentially be landlocked is still used as a church. If so, this petition
cannot meet Criteria #3.
(4) The vacation would not hinder the use of a public way by the neighborhood in which it is located or to which it is
contiguous.
Monroe Street is already a dead -end street, Vacating the balance would not hinder its use.
Due to the above stated reasons, the staff recommends that the proposed streetlalley vacation not be approved.

1. Establish a Permanent Access Agreement between the owner of the Church and the S.B. Cubs, and have it
recorded with the St. Joseph County Recorder's Office. The applicant shall provide a copy of the signed &
recorded agreement document to the Engineering Department.
