DORAU vUNITED Consulting= This SUPPLEMENTAL AGREEMENT ("Agreement's is made and entered into on this date 0AL(h ly,100 by and between the City of South Bend, acting by and through its proper officials, `LOCAL PUBLIC AGENCY" or "LPA') and UNITED CONSULTING, an Indiana corporation 'CONSULTANT'). WITNESSETH WHEREAS, the CONSULTANT did, on April 26, 2016 enter into an Agreement with the LOCAL PUBLIC AGENCY for Engineering Services and Documents in relation to the following described project: Des. No, 1401810 Coal Line Trail, Phase I; from Lincolnway West to Riverside Drive in LaPorte District This supplement is required to revise the following services included in the original scope of work: Topographic Survey, US Waters Report, Section 106, and Trail Design & Plans; and Add the following new services: Landscape Architecture Design & Plans, Lighting Design & Plans, Title Searches, Right -of -Way Engineering, and Right -of -Way Staking. WHEREAS, in order to provide for completion of the work it is necessary to amend and supplement the Engineering Agreement. NOW, THEREFORE, it is agreed by and between the parties as follows: L Appendix "A"is amended to read as follows; L. LANDSCAPE ARCHITECTURE DESIGN AND PLANS The CONSULTANT shall prepare plans, specifications and estimates of cost, which shall be in accordance with the accepted standards for such work and in accordance with the following documents in effect at the time the plans or reports are submitted: Indiana Supplemental Agreement version 6-2011 Design Manual, American Association of State Highway and Transportation Officials "A Policy on Geometric Design of Highways and Streets", Indiana Department of Transportation's Standard Specifications, Road and Bridge Memoranda except as modified by supplemental specifications and special provisions, if any, and shall be completed to the point required to fulfill the requirements of Stage 3 Plans and Final Contract Documents. 1. The CONSULTANT shall prepare and submit Stage-2 level plans to the LPA for review and acceptance. 2. The CONSULTANT shall prepare and submit Stage-3 level plans to the LPA and INDOT for review and acceptance. 3. The CONSULTANT shall prepare and submit Final Tracing plans to INDOT and the LPA. N. LIGHTING DESIGN AND PLANS The CONSULTANT shall prepare plans, specifications and estimates of cost, which shall be in accordance with the accepted standards for such work and in accordance with the following documents in effect at the time the plans or reports are submitted: Indiana Design Manual, American Association of State Highway and Transportation Officials "A Policy on Geometric Design of Highways and Streets", Indiana Department of Transportation's Standard Specifications, Road and Bridge Memoranda except as modified by supplemental specifications and special provisions, if any, and shall be completed to the point required to fulfill the requirements of Stage 3 Plans and Final Contract Documents. 1. The CONSULTANT shall prepare and submit Stage-2 level plans to the LPA for review and acceptance. 2. The CONSULTANT shall prepare and submit Stage-3 level plans to the LPA and INDOT for review and acceptance. 3. The CONSULTANT shall prepare and submit Final Tracing plans to INDOT and the LPA. TITLE SEARCH The CONSULTANT shall perform Title Searches for acquisition parcels in accordance with the INDOT Right -of -Way Engineering Procedures Manual along with any supplemental memoranda to said Manual and Title 865 of the Indiana Administrative Code, Articles 1 through 12. The procedures for the Title Searches for 31 parcels consists of the following: 1. Review and interpretation of Title and Encumbrance Reports. 2. Determination of the owners and property limits of the areas of acquisition within the project limits. Q. RIGHT-OF-WAY ENGINEERING The CONSULTANT shall perform Right -of -Way Engineering for acquisition parcels in accordance with the INDOT Right -of -Way Engineering Procedures Manual along with any supplemental memoranda to said Manual and Title 865 of the Indiana Administrative Code, Articles 1 through 12. The procedures for the Right -of -Way Engineering for 31 parcels consists of the following: 1. Provide legal descriptions (certified by a registered land surveyor) of all temporary and permanent acquisition parcels. 2. Provide land plats (certified by a registered land surveyor) for each permanent acquisition parcel showing the owner's property, existing right of way and proposed right of way. 3. Provide area computations and L-10 forms of the owners' title areas, existing rights of way, proposed rights of way and residues of the owners' properties. Supplemental Agreement version 6-2011 4. Provide documentation and proof and any existing rights of way. 5. Be available for assistance in interpreting any right of way documents with the client or acquisition team. R. RIGHT-OF-WAY STAKING The CONSULTANT shall perform Right -of -Way Staking for acquisition parcels in accordance with the INDOT Right -of -Way Engineering Procedures Manual along with any supplemental memoranda to said Manual and Title 865 of the Indiana Administrative Code, Articles 1 through 12. The procedures for the Right -of -Way Staking of up to 31 parcels consists of the following: 1. Provide in the field, stake -out locating the proposed right-of-way line at property line intersections, deflection points and at one hundred foot intervals. 2. Provide the stake -out with wood hubs and lathes. II. Appendix "B"is amended to read as follows. 13. Condemnation of any parcels. III. Appendix "C"is amended to read as follows; L. LANDSCAPE ARCHITECTURE DESIGN AND PLANS 1. Stage 2 Plans within 45 calendar days after the completion of the Preliminary Field Check Plans. 2. Stage 3 Plans within 90 calendar days following receipt of Stage 2 Plans approval by LPA. 3. Final Tracings within 45 calendar days following receipt of Stage 3 Plans approval by INDOT and LPA and at least 30 calendar days prior to Ready for Contracts. N. LIGHTING DESIGN AND PLANS 1. Stage 2 Plans within 45 calendar days after the completion of the Preliminary Field Check Plans. 2. Stage 3 Plans within 90 calendar days following receipt of Stage 2 Plans approval by LPA. 3. RIGHT-OF-WAY STAKING 1. Right -of -Way Staking within 7 calendar days after a request from the LPA. Supplemental Agreement version 6-2011 IV, Appendix "D"is amended to read as follows; A.I. The CONSULTANT shall receive as payment for the work performed under this Agreement the total fee not to exceed $544,425 unless a modification of the Agreement is approved in writing by the LPA. A.2. ASBESTOS INSPECTION The CONSULTANT shall make observations at the bridge and identify suspected asbestos - containing materials (ACMs) that are encountered, obtain samples of the materials (if feasible) and analyze samples for asbestos using polarized light microscopy. The results of the findings shall be provided in a report including the location and approximate quantity of ACMs encountered and will include a single -page summary of our findings as required by the Indiana Department of Environmental Management. Q. RETAINING WALL DESIGN AND PLANS The CONSULTANT shall prepare plans, specifications and estimates of cost, which shall be in accordance with the accepted standards for such work and in accordance with the following documents in effect at the time the plans or reports are submitted: Indiana Design Manual, American Association of State Highway and Transportation Officials "A Policy on Geometric Design of Highways and Streets", Indiana Department of Transportation's Standard Specifications, Road and Bridge Memoranda except as modified by supplemental specifications and special provisions, if any, and shall be completed to the point required to Supplemental Agreement version 6-2011 fulfill the requirements of Stage 3 Plans and Final Contract Documents. 1.
