Dear Mr. & Mrs. Collins:
The Board of Public Works, at its March 14, 2017, meeting, reviewed comments by the Engineering
Division, Area Plan Commission, Community Investment, Fire Department, Police Department, and the
Solid Waste Division. The following comments and recommendations were submitted:
Area Plan, the Fire Department, and Engineering Department state, per IC 36-7-3-13, the vacation would
make access to the lands of the aggrieved person by means of public way difficult or inconvenient. The
vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is
located or to which it is contiguous. The vacation would not hinder the public's access to a church, school
or other public building or place. The vacation would not hinder the use of a public right of way by the
neighborhood in which it is located or to which it is contiguous. Engineering noted the vacation would
create a dead-end alley with no turn -around access. The Board recommends against vacating partial alleys.
The Fire Department stated also the alley is too long and hydrants are too far for access without the alley.
Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation of this
alley.
Please contact Donna Hanson at (574) 235-9254 prior to picking up your radius man. You will need
a radius map showing properties within 150' of the proposed vacation for your petition to the Common
Council. Once you pick up the radius map, proceed to the City Clerk's office for your alley vacation
packet.

Request to Vacate Alley Right-of-way
This is an official request to vacate & block off the alley right-of-way that is at St. Paul Pl,
between the 1000 block of W. Washington St and W. Colfax St.
The traffic that uses the alley has become a nuisance to the property owners that reside around
& near it. After living on the end of the alley for 10 years, we have consistently had trash, large
TV's, and yard waste just dumped in our alley. Being a paved alley, speeds of people driving
through there tend to be unsafe. There currently is a Large Screen TV sitting in our neighbor's
back yard. We own the property at 1005 W. Washington St, I I I St. Paul Pl, 113 St. Paul Pl, and
121 St. Paul Pl, which surrounds that alley right-of-way.
There are no longer City Trash trucks that access the alley with the new pick up being in the
front of the houses. There is an access that T's off and can be used off of W. Colfax St, and also
the other end onto Elm St., so there are still 2 access points for residents to use this alley. I
believe this would put an end to unwanted extra traffic.

Dear Board Members:
The staff has reviewed this petition, and would note that in our opinion:
(1) The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located
m to which it is contiguous.
The neighborhood is fully developed and traffic patterns established.
(2) The vacation would make access to the lands of the aggrieved person by means of public way difficult or inconvenient.
The staff notes that the vacation of a portion of the alley will limit access to the balance of the properties west of the
proposed vacation request. There may be an inconvenience factor, but access is still guaranteed from the west. Staff
also further notes that at least one property owner has a garage that accesses the alley.
(3) The vacation would not hinder the public's access to a church, school, or other public building or place.
The alley does not provide access to a church, school, or other public building or place,
(4) The vacation would not hinder the use of a public way by the neighborhood in which it is located or to which it is
contiguous.
The use of this alley is not a requirement to accomplish the overall traffic circulation pattern of the neighborhood,
and its sole value is access to the rear yards of adjacent properties.
Due to the above stated reasons, the staff recommends that the proposed alley vacation be approved.
