1. Contractor has not, nor has any other member, representative, or agent of the firm,
company, corporation or partnership represented by him, entered into any combination,
collusion or agreement with any person relative to the price to be bid by anyone at such
letting nor to prevent any person from bidding nor to induce anyone to refrain from
bidding, and that this bid is made without reference to any other bid and without any
agreement, understanding or combination with any other person in reference to such
bidding. Contractor further says that no person or persons, firms, or corporation has, have
or will receive directly or indirectly, any rebate, fee, gift, commission or thing of value
on account of such sale; and
2. Contractor certifies by submission of this proposal that neither contractor nor any
of its principals are presently debarred, suspended, proposed for debarment, declared
ineligible, or voluntarily excluded from participation in this transaction by any Federal

3. Contractor has not, nor has any successor to, nor an affiliate of, Contractor, engaged in
investment activities in Iran.
a. For purposes of this Certification, "Iran" means the government of Iran and any
agency or instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5,
as amended from time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor
is engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty
million dollars ($20,000,000) or more in value in the energy sector of Iran;
or
ii. Contractor, its successor or its affiliate, is a financial institution that extends
twenty million dollars ($20,000,000) or more in credit to another person for
forty-five (45) days or more, if that person will (i) use the credit to provides
goods and services in the energy sector in Iran; and (ii) at the time the
financial institution extends credit, is a person identified on list published by
the Indiana Department of Administration.
4. Contractor does not knowingly employ or contract with an unauthorized alien, nor
retain any employee or contract with a person that the Contractor subsequently learns is
an unauthorized alien. Contractor agrees that he/she/it shall enroll in and verify the work
eligibility status of all of Contractor's newly hired employees through the E-Verify
Program as defined by I.C. 22-5-1.7-3. Contractor's documentation of enrollment and
participation in the E-Verify Program is included and attached as part of this bid/quote;
and
5. Contractor shall require his/her/its subcontractors performing work under this
public contract to certify that the subcontractors do not knowingly employ or contract
with an unauthorized alien, nor retain any employee or contract with a person that the
subcontractor subsequently learns is an unauthorized alien, and that the subcontractor has
enrolled in and is participating in the E-Verify Program. The Contractor agrees to
maintain this certification throughout the term of the contract with the City of South
Bend, and understands that the City may terminate the contract for default if the
Contractor fails to cure a breach of this provision no later than thirty (30) days after being
notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a
contract by the City of South Bend through its agencies, boards, or commissions shall not
discriminate against any employee or applicant.for employment in the performance of a
City contract with respect to hire, tenure, terms, conditions, or privileges of employment,
or any matter directly or indirectly related to employment because of race, sex, religion,
color, national origin, ancestry, age, gender expression, gender identity, sexual
orientation or disability that does not affect that person's ability to perform the work.

In awarding contracts for the purchase of work, labor, services, supplies, equipment,
materials, or any combination of the foregoing including, but not limited to, public works
contracts awarded under public bidding laws or other contracts in which public bids are
not required by law, the City, its agencies, boards, or commissions may consider the
Contractor's good faith efforts to obtain participation by those Contractors certified by
the State of Indiana as a Minority Business ("MBE") or as a Women's Business
Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive
bidder.
In no event shall persons or entities seeking the award of a City contract be required to
award a subcontract to an MBE/WBE; however, it may not unlawfully discriminate
against said WBE/MBE. A finding of a discriminatory practice by the City's MBE/WBE
Utilization Board shall prohibit that person or entity from being awarded a City contract
for a period of one (1) year from the date of such determination, and such determination
may also be grounds for terminating the contact for which the discriminatory practice or
noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination
commitment shall be made a part of any contract which it may henceforth enter into with
the City of South Bend, Indiana or any of its agencies, boards or commissions.
Contractor agrees not to discriminate against or intimidate any employee or applicant for
employment in the performance of this contract with privileges of employment, or any
matter directly or indirectly related to employment, because of race, religion, color, sex,
gender expression, gender identity, sexual orientation, handicap, national origin or
ancestry. Breach of this provision may be regarded as material breach of contract.
I, the undersigned bidder or agent as contractor on a public works project, understand my
statutory obligations to the use of steel products or foundry products made in the United
States (I.C. 5-16-8-1). I hereby certify that I and all subcontractors employed by me for
this project will use steel products or foundry products made in the United States on this
project if awarded. I understand I have an affirmative duty to notify the City in my bid
that my proposal does not include the use of steel products or foundry products made in
the United States. I understand it is my sole obligation and responsibility to provide a
justification to the City, subject to review and approval, why the cost of United States
made steel or foundry products is unreasonable. Prior to award and upon submission of
bid which does not use steel products or foundry products made in the United States, the
City, through its director of public works, shall make a determination if the price of
United States made steel or foundry is unreasonable. I understand that violations
hereunder may result in forfeiture of contractual payments.

Hopper: For safety reasons, we do not offer a lock to hold the side door open.
Fully Automated Cart Lift Mechanism Right Side: Due to the design of the Python arm an
integrated valve lock in the inner boom cylinder is not required.
Hydraulic System: Hydraulic pump will be mounted off of the transmission as the unit is not
equipped to be able to mount a front mount pump.
Hydraulic System: All valving is air over hydraulics in lieu of electric over hydraulics
Warranty: Unit has one year complete body warranty in price, any other warranties will need to
be purchased per the attached bid price sheet provided.
CLARIFICATION PAGE
We do not have a bid price on a diesel version of these chassis because these are 2016 LEU633
chassis.
Chassis delivery and price are based on unit subject to prior sale.
Pricing includes a 1 year complete body warranty and a 5 year warranty on the Infinity eject
cylinders, all other warranties will need to be purchased off of the bid price sheet provided.
Tires and Wheels: Bridgestone M860A 315/80r22.5 on front and rear.
Tires and Wheels: Rear tires are 315/8002.5 exceeding requested 1102.5

This Extended Coverage Plan (Plan) is available to be purchased for all eligible Cummins Engines used in
automotive applications marketed for use in the United Slates* and Canada under the trademark "Cummins",
"Cummins ReCon®" or "Cummins Westport". This Plan covers failures of the following Engine components

Cummins Responsibilities
Cummins will pay for all parts and labor needed to repair the damage to the Engine resulting from a Covered
Failure.
Cummins will pay for the lubricating oil, antifreeze, diesel exhaust fluid, filler elements and other maintenance
items that are not reusable due to a Covered Failure.
Cummins will pay reasonable labor costs for Engine removal and reinstallation when necessary to repair a
Covered Failure.
Owner Responsibilities
Owner is responsible for the operation and maintenance of the Engine as specified in the applicable
Cummins Operation and Maintenance Manual. Owner is also responsible for providing proof that all
recommended maintenance has been performed.
Before the expiration of this Plan, Owner must notify a Cummins distributor, authorized dealer or other repair
location approved by Cummins of any Covered Failure and make the Engine available for repair by such
facility. Owner is also responsible for delivering the Engine to the repair facility.
Service locations are listed on the Cummins Worldwide Service Locator at cummins.com.
Owner is responsible for all towing and/or travel expenses incurred as a result of a Covered Failure.
Owner is responsible for the cost of lubrication oil, antifreeze, filter elements, belts, hoses and other
maintenance items provided during covered repairs unless such items are not reusable due to the Covered
Failure.
Owner is responsible for the communication expenses, meals, lodging and similar costs incurred as a result
of a Covered Failure.
Owner is responsible for non -Engine repairs, "downtime" expenses, cargo damage, fines, all applicable
taxes, all business costs and other losses resulting from a Covered Failure.
Owner is responsible for the cost to investigate complaints unless the failure is caused by a defect in
Cummins material or factory workmanship.
Limitations
Engines with an emissions certification listed below must be operated using only diesel fuel having no more
than the corresponding maximum sulfur content. Failure to use the specified fuel as listed in the Cummins
Fuel Bulletin #3379001 Table 1 (Cummins Inc. Required Diesel Fuel Specifications) can damage the Engine
and aftertreatment system within a short period of time. This damage could cause the Engine to become
inoperable and failures attributable to the use of incorrect fuels will be denied Warranty Coverage. Fuel
specifications also need to comply with local fuel regulations (EN590 for Europe and ASTM D975 for North
America) for Warranty eligibility.
Maximum sulfur levels by emissions certification level as listed on the Engine's dataplate are:
EPA 2007/2010/2013/2017 max. 15 parts per million
EPA Tier 4 Interim / Final max. 15 parts per million
EU Stage 111132011 max. 15 parts per million
Euro 4/5 max. 50 parts per million
Euro 6 max. 10 parts per million
Cummins is not responsible for failures or damage resulting from what Cummins determines to be abuse or
neglect, including, but not limited to: operation without adequate coolants or lubricants; overfueling;
overspeeding; lack of maintenance of lubricating, cooling or intake systems; improper storage, starting, warm-
up, run-in or shutdown practices; unauthorized modifications of the Engine. Cummins is also not responsible
for failures caused by incorrect oil or fuel or by water, diesel exhaust fluid, dirt or other contaminants in the
fuel, oil or diesel exhaust fluid.
This Plan does not apply to accessories supplied by Cummins which bear the name of another company.
Such non -Warranted accessories include, but are not limited to: alternators, starters, fans, air conditioning
compressors, clutches, filters, transmissions, torque converters, steering pumps, non -Cummins fan drives,
Engine compression brakes and exhaust brakes.
Cummins branded alternators and starters are not covered by this Plan.
Aftertreatment component failures are not covered by this Plan.
Failures resulting in excessive oil consumption are not covered by this Plan.
Low Fuel Pressure Regulator covered component applies to the ISL G and ISX12 G Engines only.
Parts used to repair a Covered Failure may be new Cummins parts, Cummins approved rebuilt parts or
repaired parts. Cummins is not responsible for failures resulting from the use of parts not approved by
Cummins.
A new Cummins or Cummins approved rebuilt part used to repair a Covered Failure under this Plan assumes
the identity of the part it replaced and is entitled to the remaining Coverage hereunder. This Plan is
transferable to subsequent Owners of the Engine by notifying a Cummins Distributor within 90 days of the
transfer of ownership.
This Plan does not duplicate other Coverages applicable to the Engine.
Fees paid for this Plan are not refundable.
Coverage purchase must be documented on a Cummins Assurance Plan Certificate. The Certificate must be
signed and dated by the customer.
CUMMINS DOES NOT COVER WEAR OR WEAROUT OF COVERED PARTS.
CUMMINS IS NOT RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
EXCEPT FOR THE PUBLISHED CUMMINS WARRANTIES, THERE ARE NO OTHER WARRANTIES,
EXPRESS OR IMPLIED, OR OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PUROSE.
