Contractor does not knowingly employ or contract with an unauthorized alien, nor retain any employee or contract with a person that the Contractor subsequently learns is an unauthorized alien. Contractor agrees that he/she/it shall enroll in and verify the work eligibility status of all of Contractor's newly hired employees through the E-Verify Program as defined by I.C. 22-5-1.7-3. Contractor's documentation of enrollment and participation in the E-Verify Program is included and attached as part of this bid/quote; and 5. Contractor shall require his/her/its subcontractors performing work under this public contract to certify that the subcontractors do not knowingly employ or contract with an unauthorized alien, nor retain any employee or contract with a person that the subcontractor subsequently learns is an unauthorized alien, and that the subcontractor has enrolled in and is participating in the E-Verify Program. The Contractor agrees to maintain this certification throughout the term of the contract with the City of South Bend, and understands that the City may terminate the contract for default if the Contractor fails to cure a breach of this provision no later than thirty (30) days after being notified by the City. 6. Persons, partnerships, corporations, associations, or joint ventures awarded a contract by the City of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or indirectly related to employment because of race, sex, religion, color, national origin, ancestry, age, gender expression, gender identity, sexual orientation or disability that does not affect that person's ability to perform the work. In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any combination of the foregoing including, but not limited to, public works contracts awarded under public bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards, or commissions may consider the Contractor's good faith efforts to obtain participation by those Contractors certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive bidder. CUSTOM REACTIVATED AND/OR VIRGIN GRANULAR ACTIVATED CARBON SPECIFICATION 1. SCOPE OF WORK It is the intent of this solicitation to establish a service/supply contract for Granular Activated Carbon (GAC) as follows: a. Furnish all labor, materials, equipment, and supervision for the removal and transport of spent granular activated carbon (GAC) from the filters to a custom reactivation facility. b. Reactivation of the spent GAC to the parameters specified herein. c. Supply of sufficient make-up virgin GAC as required to ensure the reactivated GAC meets the minimum specified parameters. d. Furnish all labor, materials, equipment, and supervision for the transport and installation of reactivated GAC back into the filters. e. Alternately, furnish all labor, materials, equipment, and supervision for the removal, transport, and disposal of spent GAC from the filters, and supply and install virgin GAC into the filters. Whenever a brand name is mentioned in the bid request, the naming of the item is intended to establish the type, function, performance and quality required. 2. PRE -BID SITE INSPECTION a. Each bidder shall visit the site and shall inform themselves of all existing conditions. Proof of site visitation is mandatory and must be attached to bid documents. b. Failure to comply with site inspection requirements shall be considered non— responsive and bid shall be rejected. 3. BIDDER'S QUALIFICATIONS a. Bids shall only be accepted from manufacturers of bituminous coal based re - agglomerated activated carbon. b. Bidders shall have a minimum of 15 years' experience manufacturing virgin granular activated carbon and shall submit proof via a Manufacturer's Certificate and/or an Affidavit of Compliance. Ver. 13 — 6101115 c. The bidder shall certify that it is the owner and operator of a minimum of two (2) dedicated, potable, NSF Certified reactivation facilities capable of receiving and reactivating spent GAC from this water treatment facility. d. Bidder shall furnish evidence of comprehensive general liability insurance in the minimum amount of $2,000,000 to provide protection from any and all claims that may arise from the supplier's supply, shipping, installation, removal and reactivation/disposal of the spent carbon. e. Field Service personnel performing the exchange must be directly employed by the bidder. f. Bidder's virgin and reactivation manufacturing processes shall produce NSF/ANSI 61 certified products. g. Failure to comply with any of the above qualification requirements shall be considered non —responsive and bid will be rejected. 4. PRODUCT SPECIFICATION — REACTIVATED GAC The bidder shall custom reactivate the Owner's spent GAC. Custom reactivated GAC shall meet the following specifications: a. Materials: i. Materials shall comply with the requirements of the Safe Drinking Water Act, and other federal requirements. ii. The reactivated GAC shall comply with NSF / ANSI 61. iii. Effective procedures will be in place and utilized to ensure segregation of any spent and reactivated carbon intended to be returned as a custom reactivated product. iv. Virgin make-up material shall meet the complete specifications of the Virgin GAC section (Section S Product Specification.) b. Moisture: i. The moisture content of the reactivated GAC shall not exceed 8% by weight of the listed container contents as packed, or at the time it is shipped by the supplier, if shipped in bulk. The moisture content shall be determined in accordance with ASTM 2867/AWWA B604, latest edition. ii. Note: As the moisture content of reactivated GAC may increase during bulk shipment because of ambient conditions that may be beyond the control of the supplier, a moisture content exceeding 8% is permitted in the reference sample collected after the shipment is received. Mer.13-6101115 c. Apparent Density: i. The apparent density of the reactivated GAC shall be not less than 0.20 g/cc, as determined in accordance with ASTM D2854/AWWA B604, latest edition. d. Particle Size Distribution: i. Particle size distribution shall be determined in accordance with ASTM 2862/AWWA 6604, latest edition. The particle size range of the reactivated GAC shall be as specified herein: ii. Mesh Size: 8 x 30 iii. No more than 15% of the reactivated GAC shall be retained on the maximum - size sieve, and no more than 4% of the reactivated GAC shall pass the minimum -size sieve. e. Uniformity Coefficient: I. The reactivated GAC shall have a uniformity coefficient not greater than 2.1. f. Abrasion: I. The retention of mean particle diameter of the reactivated GAC shall not be less than 70% as determined either by the stirring abrasion test or the Ro-Tap abrasion test, AWWA B604, latest edition. g. Performance Criteria: i. Adsorptive Capacity -Iodine Number : 1. If the iodine number of the received spent GAC is >550, the reactivated GAC (on a blended basis of reactivated GAC plus virgin make-up GAC as required) shall attain an iodine number at least 800 mg/g, as determined according to ASTM 4607, latest edition. 2. If the iodine number of the received spent GAC is <550, the reactivated GAC (on a blended basis of reactivated GAC plus virgin make-up GAC as required) shall attain an iodine number at least 250 mg/g greater than the spent GAC, as determined according to ASTM 4607, latest edition. 3. In no case shall the iodine number of the reactivated GAC (on a blended basis of reactivated GAC plus virgin make-up GAC as required) be less than 500 mg/g carbon as determined according to AWWA B604, latest edition. PRODUCT SPECIFICATION — VIRGIN GAC The bidder shall supply a virgin GAC, which shall either be used to make up losses of spent GAC via the reactivation process, or as an alternate supply to the custom reactivated GAC. The virgin GAC shall meet the following specifications: a. The GAC shall be mined and manufactured in the United States of America. b. The GAC product designated by the Bidder as the material to be supplied for this bid shall have five (5) years of history of use in municipal drinking water facilities in North America. Bidder shall submit references per Section 6. c. The GAC shall be manufactured in a facility certified to conform to the Management System Standard: ISO 9001:2000 or later quality standards and at the specific plant or site holding such certification. A copy of the valid certificate must be submitted with bid, with the understanding by all parties that ANSI/NSF assures the GAC against toxicological hazards only. ISO 9001:2000 or later certification assures the GAC of consistent conformance to stated product quality and standards listed in the specifications. d. The GAC shall comply with AWWA B604, latest edition. e. The GAC shall comply with NSF / ANSI 61 Drinking Water System Components — Health Effects standard. f. The GAC shall comply with the requirements for activated carbon as defined by the Food Chemical Codex (FCC), latest edition published by the U.S. Pharmacopeia. g. The GAC must be a 100% re -agglomerated bituminous coal based product, sized to a granular form prior to baking and activation. Samples shall be submitted to the (Engineer/City) prior to the bid date. One (1) sample shall be submitted for each activated carbon type to be supplied. Samples shall be no less than 2 lb. and shall be accompanied with a Certificate of Analysis and shall include the following parameters: 1. Iodine number, mg/g (ASTM D4607) 2. Moisture (as packed), wt% (ASTM D2867) 3. Effective size, mm (ASTM D2862) 4. Uniformity coefficient (ASTM D2862) S. Abrasion number (AWWA B604 — latest edition) 6. After award but prior to GAC delivery to site, pre -shipment samples shall be submitted to an independent laboratory mutually agreed upon between the Engineer/City and the manufacturer. ii. The samples shall be accompanied with a Certificate of Analysis and shall also include the above parameters (3.a.i.1.through 7.). iii. The number of samples to be submitted shall be in accordance with AWWA B604, latest edition. Based on the project size, the manufacturer shall determine the lot size and in turn shall provide the appropriate number of samples to be considered representative. iv. Failure of the pre -shipment samples to meet specifications shall be cause for rejection. Manufacturer shall then resubmit new pre -shipment samples for testing. Manufacturer shall not be given approval to ship GAC until pre -shipment samples meet specification. v. The Certificate of Analysis shall certify that the GAC sample shipped to the site is 100% virgin activated carbon and in full compliance with the specifications stated herein. c. Costs for pre -bid and pre -shipment sample testing shall be borne by the manufacturer. 6. REFERENCES a. Should the bidder not be the current supplier, bidder must provide three (3) references for which bidder have provided services as noted above. All information requested must be filled in. Field Service personnel performing the GAC exchange must be directly employed by the manufacturer of the GAC having a minimum of 5 years' experience in performing carbon exchanges. Performance of the GAC exchange by a third party or sub -contractor shall not be allowed. b. Bidder shall submit resumes of supervisors capable of performing carbon installations, indicating qualifications, years of experience and location. c. Bidder shall submit a detailed carbon exchange procedure. d. The preferred method for spent GAC removal shall be hydraulic eduction. City shall be responsible for water and air supply. e. GAC shall be transported, delivered and placed in a careful manner to exclude all dust, dirt or deleterious material and to prevent physical damage to the particles. f. Failure to provide the information requested will be considered non -responsive and the bid rejected. 8. All prices provided in the bid proposal shall include all applicable fees, costs and taxes (if any) relating to the project. The successful bidder will not be responsible for real property tax on the property, including the site of the project in addition to local taxes assessed. By submitting a price and entering into a contract, the bidder agrees to abide by all the criteria set forth in this bid for a period of time as set forth in the contract. Failure to do so will result in the original contract being voided and an award will be made to the next lowest responsible bidder. 10. PRICE ADJUSTMENT Pricing shall be adjusted on an annual basis by the combined average of the following two Producer Price Indices, as published by the US Department of Labor: (A) Annual percentage change in the Producer Price Index of Other Petroleum and Coal Products Manufacturing (PCU32419-32419), and (B) Annual percentage change in the Producer Price Index of Basic Organic Chemicals (WPU0614). CONTRACT PERIOD The City agrees to award a contract to the lowest responsible, qualified bidder for a period of five (5) years commencing on the first day that the contract is signed by both parties. BULK DELIVERY GAC SERVICE Carbon Activated Corporation operates its own fleet of pneumatic trucks for the delivery and transfer of carbons from pressure and open gravity filters. The trailers are compartmentalized, allowing batches of 20,000 lbs of new or reactivated carbon to be loaded in to the trailers, using only 2 of the 4 compartments. (i.e. 10,000 lbs per compartment) The carbon is transported to site where the first operation is to transfer the 20,000 lbs of spent carbon from the Model 10 filter in to the trailer using the 2 spare empty compartments located at each end of the trailer. To transfer the spent carbon from the filter in to the trailer, flexible 4 inch pipes are run from the trailer "inlet' valve to the spent carbon "outlet' valve on the filter unit. The spent carbon filter is filled with water and pressurized with air to 8 — 14 psi. The filter outlet and trailer inlet valves are opened and the spent carbon slurry flows from the filter in to the 2 spare empty compartments in the trailer. When the filter is empty the valves are closed and the connection pipes are disconnected. For open type filters, the spent carbon is transferred from the filter using an educator and motive water from a hydrant. The suction wand from the educator is placed in the spent GAC bed and the carbon slurry is hydraulically transferred into the empty compartments of the trailer. The spent carbon in the trailer is drained of all free water prior to transporting it back to the reactivation facility. The 20,000 lbs of reactivated/virgin carbon in the trailer is then transferred in to the now empty filter. This is achieved by filling the central compartments containing reactivated or virgin carbon in the trailer, with water. 4 inch flexible pipes are run from the trailer "outlet' valve to the filter "carbon inlet' valve. All trailer valves and top manhole covers are closed and the hailer is pressurized with air to 14 psi. Once pressurized, the trailer central compartment outlet valves and the filter "carbon inlet' valve are opened and the carbon in transferred by air pressure in to the filter. Additional water may be added to the trailer central compartment to ensure all carbon has been transferred. The transfer operation takes 2 — 3 hours. Documentation, including Certificate of Analysis of the lot of reactivated/virgin carbon, bill of lading, and spent carbon collection forms, indicating the date, facility and filter reference number are provided for quality assurance and traceability.
