Minutes of the previous meeting were read and approved. Vouchers were approved and ordered poid to the various suppliers. Comes now Vernon Lane, Building Commissioner, to give a progress report on the condemnation order of a dwelling at 615 E. Ohio Street, owned by Y.C. Magee who resides at 506 E. Keasey Street. Mr. Lane reports that Mr. Magee has not brought said dwelling up to standard as directed. The Clerk was directed to address a letter to Mr. Magee informing him that unless he brought the dwelling at 615 E. Ohio Street up to standard within three weeks from this date, the +condemna- tion order will be carried out. Vernon Lane, Building Commissioner, gives a progress report on the dwelling at 2143 N. Olive Street owned by Beverly and Irma E. Gibson, 8404 Stanton Ave., Buena Park, Calif. and reports that the Olive Street dwelling has notyet been removed. The Clerk was directed to address a letter to Beverly and Irma E. Gibson, in. Buena Park, -and order them to appear before the Board in person or through representation on the llth day of July, 1960 to show cause why said dwelling has not been dismantled. Represented by his attorney, William Roemer, and in person, appears Gerald McGinn for a hearing on the following charges made by the Board on the 24th day of June, 1960: MUNICIPAL CITY OF SOUTH BEND BEFORE THE BOARD OF PUBLIC WORKS 8 SAFETY IN THE MATTER OF ) CHARGES FOR VIOLATION OF THE RULES Gerald McGinn ) AND REGULATIONS OF THE SOUTH BEND 1240 Canterbury Drive) FIRE DEPARTMENT - ARTICLE XIV, South Bend, Indiana ) Section 6 and ARTICLE XIV, Section 15-a That the said Gerald McGinn during the month of May and a portion of June, 1960, violated Article XIV, Section 6, of the rules and regulations of the South Bend Fire Department, which regulation reads as follows: ARTICLE XIV. Section 6. In matters of general conduct, not within the scope of Department rules, said members shall be governed by the ordinary rules of good behavior observed by law-abiding and self-respecting citizens, and shall have charges preferred against them for conduct tending to bring reproach or reflection upon the Department . That the violation of said rule and regulation occurred in the following manner: Said Gerald McGinn, while wearing the uniform of the South Bend Fire Department, cashed a check at a bank for which he did not have sufficient funds• to cover and, subsequently, on the 21st day of June, 19609 pled guilty to a charge of issuing fraudulentcheck in the St. Joseph Superior Court No. 2, under Cause No. 120679 titled State of Indiana vs Gerald McGinn. That further the said Gerald McGinn on the 17th day of June, 1960, violated Article XIV, Section 15-a2 of the rules and regulations of the South Bend Fire Department, which said regulation reads as follows: ARTICLE XIV, Section 15-a. It shall be the duty of said members to notify the company officer of any inability to report at the time required stating the reason. 1 1 1 That on said date the said Gerald McGinn violated Article XIVD Section 15-a, of the rules and regulations of the South Bend Fire Department by being absent without leave. Smith, President Comes now Gerald McGinn and to the charges of violation of the Rules and Regulations of the South Bend Fire Department, Article XIV, Section 6, and Article XIV, Section 15-a, to each of said charges the said Gerald McGinn pleads guilty to violation of said Articles, through his attorney, William Roemer. Comes now William Roemer and speaks on behalf of his client, Gerald McGinn, pointing out that the record of Gerald McGinn to this date and to his knowledge has been exemplary, this being the first instance to being absent without leave. Comes also Fireman's McGinn's superior officer, Lieutenant Haag and confirms that Gerald McGinn's record for being on time up to this It, particular violation has been proper. The Board, after having heard attorney William Roemer and Lientenant Haag now takes the matter under advisement. A copy of a letter addressed to Gerald McGinn dated June 249 1960 and signed by Irving J. Smith, President of the Board of _Safety and a copy of the Charges for Violation were ordered placed on file. Vernon Lane, Building Commissioner,and Kenneth Jacob, representing Shell Oil Company, appear before the Board to request permission for said Shell Oil Company to place a sign on public property near the sidewalk at a Shell Service Station located on the corner of Michigan and Navarre Streets. The Building Commissioner finds no fault in granting this request. The Board thus grants permission, subject to the following: 1. That said sign would not be an encumbrance to the traffic signals or prove hazardous to public safety, and 2. that the Shell Oil Company take out insurance indemnifying the City of South Bend for injury to person or property damage as follows: $1009000 injury per person, $300,000 total accident and $25,000 property damage. The Board directs the Traffic Engineer to check the abov a premises and report his recommendation to the Board at the next regular meeting. In connection with a request of Mr. D.D. Gross concerning the control of truck traffic in Columbus Court, between Wyman's Department Store and Milady Shop, Mr. Clem Hazinski, Traffic Engineer, was directed to check this c0art and report his findings to the Board at the next regular meeting. Comes how Bert Cichowicz of the Department of Weights and Measures and submits a monthly report for June, 1960 which is the final monthly report of the 1959-60 fiscal year. Submitted also, as required by law, is the Annual Report, from July 19 1959 to Jude 30, 19609 which consists primarily of the number of various types of weight and measure devices tested and inspected. Said reports were examined, accepted and placed on file. Officer James E. Robison of the South Bend Police Department requests leave from duty from July 9, 1960 until the 24th day of July, 1960 for annual summer training with the 27th AAM TC USAP of South Bend. Request granted. PROPOSAL FOR PUBLIC LIGHUNG A Resolution adopting the Plans and Specifications with reference to lighting streets, alleys, boulevards and public places in the City of South Bend was presented to the Board, since the contract of July 1, 1949 is terminated and it is necessary to enter into a new contract to take steps for the lighting of streets, alleys, boulevards and public places. With reference to Town Towers Motel request for barricades of alley between Michigan and Main Streets for a period of 10 to 12 months during construction of motels said request entered in Minutes of Board of Public Works & Safety on June 20, 19609 page.988. All future reference to this matter will be entered in Board of Public Safety Minutes. There being no further business to come before the Board, the meeting was adjourned at 11.00 A.M.
