NEMETH, Mayor COUNTY -CITY BUILDING SOUTH BEND, INDIANA 46601 EPARTMENT OF HUMAN RESOURCES AND ECONOMIC DEVELOPMENT Carl Ellison Director MEMORANDUM TO : Member of the Common Council FROM : Carl Ellison dtd Uo' SUBJECT: City Employee /Public Official Participation in HUD - funded programs DATE : August 21, 1979 1200 County -City Building South Bend, IN 46601 (219) 284 -9371 The City's grant agreements with HUD require that no city employee, elected official, or other public official "shall have any interest, direct or indirect, in any contract or subcontract, or the proceeds thereof, with respect to which assistance is provided." Because of this provision, the Community Development Program has in the past requested written waiver of this provision from HUD on a case -by -case basis when a city employee or public official made application and was determined to be otherwise eligible to participate in a HUD - funded activity. HUD has responded favorably to every request. However, HUD now advises us that waivers will be granted on the condition that the Common Council publically recognize the participation of city employees or public officials in HUD - funded programs. Thus, the first of many similar resolutions is submitted for your consideration. I urge you to act favorably on this matter. CE /df cc: Mayor Peter J. Nemeth Peter H. Mullen Jon R.
