RESOLUTION NO.
A RESOLUTION REQUESTING THAT
THE AIR POLLUTION OPERATION
PERMIT REQUESTED BY PRENCO,
INCORPORATED, BE DENIED.
WHEREAS, the Common Council of the City of South Bend, is the
elected body which represents the viewpoints of its citizens within the
Community; and
WHEREAS, the Council recognizes the need to protect the health,
safety, and welfare of the Community; and
WHEREAS, the City of South Bend, Indiana, and Prenco, Incorporated,
a Delaware Corporation entered into an agreement for the maintenance and
operation of a Soluble Oil Disposal Facility on December 4, 1978, and the
City subsequently terminated said agreement effective September 30, 1980; and
WHEREAS, the public outcry by the residents against the proposed
new location on the Southwest side of South Bend is as great an outcry as
those opposing the Riverside location;
WHEREAS, a recent survey indicates that there is no present need
for such a soluble oil facility in the area; and
WHEREAS, there is a potential danger to the health and safety
of our residents by the transporting of such wastes to and from the
proposed facility.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. The Common Council requests that the Air Pollution
Operation Permit requested by Prenco Incorporated to operate at the
southwest side of the City be denied.
SECTION II. The Council believes that the potential health
and safety dangers and the lack of a present need of such a soluble oil
disposal facility in the area are justifible public concerns to deny such
a permit.
SECTION III. This Resolution shall be in full force and effect
from and after its adoption by the Common Council and approval by the Mayor.
