A regular meeting of the Board of Public Safety was held on Monday,
July 22, 1963 at 10:00 A.M. All members were present. Minutes of
the last regular meeting were read and approved. Vouchers were
approved and ordered paid to the various suppliers.
BUILDING DEPARTMENT_ REQUEST: KAGEL FLORIST. REMODELING
Comes now Louis Smogor, Building Commissioner, and requests permission
to allow Muis Construction Company to construct a 19 ft.by 62 foot
barricade on Michigan Street and a 13 foot by 65 foot barricade on
Navarre Street, thus providing a 5 foot plehk walk during remodeling
of Kegal Flower Shop.
Permission granted.
Mr. Smogor also requested permission to allow Kagel Flower Shop to
)X� erect a 3 foot, 4 inch permanent canopy on Michigan Street and
X Navarre Street and install three tree islands and one planter on
g the parkway.
Permission granted, provded insurance indemnifying the City of South
Bend be obtained. This insurance shall be a permanent policy and
proof of such insurance shall be filed in the Office of the Board.
BUILDING DEPARTMENT___(__CERTIFICATE OF INSURANCE - KOLACZ BROS. MARKET )
A Certificate of Insurance, indemnifying the City of South Bend for
accident or property damage, as previously ordered by the Board, was
submitted by Kolacz Bros. market, 2602 Western Avenue, in connection
with remodeling of said market.
The Certificate of Insurance was accepted and ordered placed on file.
SUB -STANDARD DIVISION: HEARINGS
Comes now Mr. Alex Niedbalski, with reference to property he owns on
1107 High Street.
This property has been sold on land Contract to Mr. and Mrs. Vaster Heron.
A damaged retaining wall must be rapaired. According to information
given to the Board by Mr. Niedbalski, this"retaining wall repair is
the responsibility of the railroad and he was advised by the Board to
take steps to see that this repair is made.
Also, it was the Board's ruling that the finding on this case as to the
condition of the structure on the property be "unsafe" and that a notice
appropriate to said finding be placed on the premises and, further,
that said premises shall not be occupied until it is found to be in
a safe condition.
With reference to property owned by Mrs. Glaser, located at 525 Cottage
Grove Avenue, Mrs. Glaser appeared before the Bbard to report that she
had three prospective buyers for this property and that the buyers
were informed that it must be brought up to standard and not be occupied
until it met stipulations of the building code.
This hearing was continued until August 26, 1963. Bids for demolishment
that were to have been opened at this hearing were ordered not opened.
Comes now Mr. Anderson Jones, owner of property located at 134 N. Olive
Street. Said property had been damaged by fire and time allotted to
bring it up to standard had expired. Mr. Anderson advised the Board
that he has now received the insurance money issued because of the
fire and can now proceed to make the necessary repairs.
Case continued until October 282 1963.
With reference to property owned by Ross Weldy, located at 416
Pennsylvania Avenue, Mr. Weldy appeared before the Board and advised
the Board that he had purchased the house in November and that the
tenants were going to repair house, which had been condemned. However,
they have failed to do so.
After hearing Mr. Weldy$ it was the decision of the Board to continue
this case until October 28, 1963.
A progress report on property owned by Melvin and Jessie Moore, located
at 1013 S. Fellows Street wh,bh house had been damaged by fire, was
given by Mr. Moore._ Mr. Moore advised that he had the insurance money
from the claim and has a man who will make the necessary repairs.
Case continued until October 281, 1963.
With reference to property owned by Mr. Goldberg, located at 320 S.
William Street, the Board was advised by Mr. Grabarz that a notice to
appear before the Board on this date had been sent to Mr. Goldberg
but that he had failed to appear.
The Board directed Mr. Grabarz to send another notice which would
be the final notice.
BUILDING DEPARTMENT: RULING ON SET -BACK LINE SOUTH BEND NORTH UNIT
JEHOVAH'S WITNESSES PROPERTY )
The Board directed Louis Smogor, Building Commissioner, to issue a
building permit to the Board of Trustees of South Bend, Indiana North
Unit of Jehovah's Witnesses to locate and build a church building on
the following described property:
Lot numbered Twenty-two (22) and the south 2 of Lot Number
Twenty-three (23), all as shown on the recorded Plat of
Hartman and Miller's Plat, an Addition to the City of South
Bend, recorded December 10, 1898 in Plat Book 7, page 29.
Such building permit shall recognize the set -back line asset forth
by the Zoning Ordinance only. The Board ha`s decided not to recognize
the set -back line as set out by the Board of Public Works & Safety and
adopted on April 16, 1934 because such set -back line was never recorded
in the County Recorder's Office. Therefore, the purchasers of this
land, their attorneys and the contracting company had no way of knowing
that such set -back line existed.
This, in the Board's estimation, worked a hardship on the purchaser of
this land, otherwise known as South Bend Indiana North Unit of
Jehovah's Witnesses.
ELECTRICAL DEPARTMENT STREET LIGHTS - PETITIONS
Petitions for street light installations at the following locations
were referred to the Electrical Department for investigation and
recommendation:
1. West of Walnut, east of Chestnut on Napier
2. Eastmont Drive, from Viking Drive to Greenwood Drive.
3. Dundee Street between Ford and Dunham Streets.
INSTALLATION APPROVAL ( STREET LIGHT�L
Following the recommendation of Roger DeClercq, Assistant Superintendent
of the Eledtrical Department, the Board approved the following
installation:
1 - 2500 lumen street light at 3516 Langley Drive. This is at the
request of Southmore Mutual Housing Corp.
RE: SPEED SIGNS ( EDGEWATER AND LINCOL_NWXY ON ARCH
RECEIPT OF PETITION
A Petition from residents in the area of Arch Avenue, Lincolnway East
and Edgewater Drive to the Board requested speed a7ntrol signs of
' 10-15 mile per hour limit.
This request was formerly received by the Board by the Precinct
Committeeman and has been referred to the Traffic Engineer for
x investigation and recommendation.
The Board directed that the Petition be referred to the Traffic
Engineer.
TRAFFIC ENGINEER INSTALLATIONS - TRAFFIC SIGNS )
Following the recommendation of the Traffic Engineer, the Board
approved the following installations:
Stop sign installed on York Road, southwest corner, at Hilltop Drive
Stop sign installed on Hastings Street, southwest corner, at Logan St.
Stop sign on 36th Street, both sides, at Hastings Street.
Stop sign on 34th Street, both sides, at Hastings St.
Stop sign on Hastings Street, both sides, at 33rd St.
Stop signs installed on 32nd St., both sides, at Hastings St.
Stop signs installed on Hastings Street, both sides, at 27th St.
Stop signs installed on Hoke Street, both sides, at Fox St.
Stop sign installed on Ribourde Drive, southwest corner, at Portage Ave.
Yield signs installed on Sylvan Lane, both sides, at Dogwodd
No Parking This Side signs installed 2100 block Beverly Place, east side.
No Parking This Side signs installed on 1100 block Ryer St., south side.
No Parking signs installed to eliminate parking for 100 ft. north of
Studebaker foundry gate on 1100 block of Prairie Ave.
20 MPH speed zone installed for 2100 block of Beverly Place
FIRE DEPARTMENT REQUEST: SEAGRAVE PUMPER FOR SALVAGE
A letter signed by Captain Carl Martz, Jr., Chief Mechanic of the
Fire Department, Captain Leo Banacki, Mechan ic, C4 t. Ted Kanczuzewski,
and Capt. Anthony Gadacz, Mechanics was submitted to the Board.
The above -mentioned members of the Fire Department state that they have
examined a 1937 Seagrave Pumper, Mod. #66E7-4867554408024 a piece of
equipment used by the Fire Department, and that all valuable and useable
parts have been removed from this truck. This piece of equipment, as
it remains now, is only good for salvage. Its present condition makes
if worth approximately $100.00.
It was the decision of the Board that this piece of equipment be sold
for approximately $99 for salvage.
POLICE DEPARTMENT( MILITARY LEAVE -OFFICER M. 0. MARTZ )
The Board approved a request from Officer M. 0. Martz, of"the
South Bend Police Department, to be excused from duty from August-
18th through August 31, 1963, in order to attend annual Field Training
with the U. S. Maxine Corps Reserve. This training is to be held at
Camp Pendleton, California. Officer would be able to return to
dury at 10:45 P.M. on August 31, 1963.
POLICE DEPARTMENT REPORT_
A copy of a Report ^for they.ea `:of 1962 from the Police Department
was examined, accepted and ordered placed on file.
STREET LIGHT OUTAGE REPORT
StreetLightOutage Reports were accepted and ordered placed on
file.
HEALTH DEPARTMENT REPRESENTATIVE
Mr. Molnar of the St. Joseph County Health Department was present
at the meeting in order to take care of any matters pertaining to
the Health Department.
There being no further business to come before the Board, the
meeting was adjourned at 11:30 A.M.
