Presented by me to the Mayor of the City of South Bend, Indiana n ' City Clerk Approved and signed by me ' 1980. � �� "U" �J Mayor RESOLUTION NO. 819 -80 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY SOUTH BEND APPROVING THE ISSUANCE OF A LICENSE FOR SCRAP AND JUNK DEALER (BREMEN IRON AND METAL COMPANY, INC.) WHEREAS, the Common Council of the City of South Bend recognizes the contributions that recycling operations such as junk and scrap yards make to the community; and the Council further realizes that such operations must be reasonably regulated in order to minimize any en- vironmental or aesthetic nuisances which may be created by the operations of scrap and junk yards within the city; and WHEREAS, the Common Council of the City of South Bend has enacted reasonable rules and regulations with regard to the issuance of licenses and the operation of the scrap and junk dealers; and WHEREAS, a petition by Bremen Iron and Metal Company, Inc., was submitted to the Board of Public Works on August 18, 1980, for the operation of a waste metal scrap operation on property located off of Sample Street immediately east of Webster Street and extending along and to the rear of the Penn Central Railroad tracks (more particularly described in a map attached to said petition); and WHEREAS, inspections of the property have been completed by the Environmental Protection Office and the Fire Prevention Bureau; peti- tioner has agreed to conform with all of the rules and regulations per- taining to the operation of such scrap yards; and the Board of Public Works has approved the issuance of said license, all as required in Ordinance No. 6621 -79. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the license application for Bremen Iron and Metal Company, Inc., for the operation of a scrap yard at the above location be approved, and the City Controller authorized to issue such license, however, said license shall be subject to the following con- ditions: (a) That no shredders shall be allowed to operate at this location. (b) That no sheerer in excess of 1,100 tons shall be allowed to operate at this location. (c) That permanent underground containers of suitable material be housed on this location for all oils, solvents, and other fluids drained at this facility. SECTION 2. That this Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Kernan CITY of SOUTH BEND RQGER Q PARENT, Mayor COUNTY -CITY BUILDING SOUTH BEND, INDIANA 46601 Common Council County -City Building South Bend, Indiana 46601 Dear Council Members: September 10, 1980 219/284 -9412 The Board of Public Works, at its meeting held on August 25, 1980, conducted a public hearing on the petition for a scrap dealer's license of Bremen Iron and Metal Company, Inc. for property located off Sample Street and Prairie Avenue (immediately east of Webster and extending along and to the rear of the Penn Central Railroad tracks). In accordance with Ordinance No. 6621 -79, regarding the licens- ing of scrap dealers, the Board of Public Works, at its meeting held on September 8, 1980, adopted a resolution approving the issuance of a license to Bremen Iron and Metal, subject to approval and ratification by the Common Council, and further subject to the receipt by the Legal Department of a statement that the legal description to which the license would apply would be amended to include only those areas zoned "E" heavy industrial, and that there would be no expansion or encroachment within the 1,000 foot distance, unless that area was previously licensed. This Resolution approving the issuance of the license was adopted by the Board of Public Works because it found Bremen Iron and Metal in technical compliance with the requirements of the South Bend Municipal Code, if the matters mentioned above are complied with. It was the feeling of the Board that it was their function to determine technical compliance; however, other matters were raised by members of the surrounding neighborhood which the Board deter- mined were more appropriate for consideration at the public hear- ing and determination by the Common Council. Therefore, this matter is now being referred to you for public hearing and subsequent action on the petition for a license. We do not feel that either that particular site, or this community, is the proper place for such a facility.
