A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AUTHORIZING THE MAYOR TO SUB-
MIT TO THE UNITED STATES GOVERNMENT, DEPARTMENT OF
ENERGY, AN APPLICATION FOR A LOAN UNDER THE "LOAN
PROGRAM FOR SMALL HYDROELECTRIC FEASIBILITY STUDIES ".
WHEREAS, the City of South Bend, acting through the Office of the Mayor
and Common Council, has aggressively and successfully sought out federal
assistance to support local efforts and to supplement local resources; and,
WHEREAS, the Mayor is the chief executive officer of the City, and is
the applicant for a loan called "The Loan Program For Small Hydroelectric
Feasibility Studies" under the auspices of the Department of Energy.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
South Bend, Indiana:
SECTION I. Hereby establish the authority of the Mayor of the City of
South Bend to submit an application for funds in the amount of forty -five
thousand dollars ($45,000) to the United States Department of Energy under
the "The Loan Program For Small Hydroelectric Feasibility Studies ".
SECTION II. Hereby designates the Division of Community Development as the
administrative agent for the program. The Division of Community Development
shall submit to the Common Council a line item budget in ordinance form prior to
any expenditures of any grant money received upon approval of this application.
SECTION III. This resolution shall be in full force and effect from and
after its adoption by the Common Council and a proval by the Mayor.

SUBJECT: Resolutions authorizing Mayor to submit applications
to the United States Government, Department of Energy
for a loan and to the State of Indiana, Department of
Commerce for a matching grant for a "Small Hydroelectric
Facility Feasibility Study ".
DATE: December 2, 1980
On December 8, 1980, the Common Council will consider Resolutions
authorizing the Mayor to submit two applications which will provide the
City with the funds necessary to study the feasibility of developing a
hydroelectric facility on the St. Joseph River in the East Bank area.
The major source of funding will come from the Department of Energy's
Loan Program For Small Hydroelectric Feasibility Studies. This program
funds up to 90% of the cost of the feasibility study, with the loan
forgiven if the project proves to be unfeasible.
The additional 10% needed to cover the cost of the study will be
requested from the Indiana Department of Commerce's Energy Development
Board. These funds will be an outright matching grant and will require
no payback.
The cost of the feasibility study will be $50,000 with $45,000
requested from the Department of Energy and $5,000 requested from the
Indiana Energy Development Board.

As a part of the study process we will also be applying to the
Federal Energy Regulatory Commission for a preliminary permit to generate
energy. This application is made in order that the applicant may secure
and maintain priority of application for a license for the project under
Part I of the Federal Power Act while obtaining the data and performing
the acts required to determine the feasibility of the project and to
support an application for a license.
We expect to submit these applications before the first of the year
to meet a January 1, 1981 due date and are therefore submitting these
resolutions at'this time because of your December meeting schedule. A
copy of the actual application will be submitted to you upon completion.

further explanation.
