Davis, Zoning & Annexation Committee Chairperson Date: December 22, 2016 2016 Annual Report of the Zoning & Annexation Committee Dear Common Councilmembers: As Chairperson of the Zoning and Annexation Committee, I am filing this report pursuant to § 2- 10(i) of the South Bend Municipal Code. It highlights some of the Committee's activities involving zoning and special exception requests affecting the land use decisions in the City of South Bend. Duties: As noted in the South Bend Municipal Code, the Zoning and Annexation Committee is charge with the following duties: "Oversees the activities related to the Board o /Zoning Appeals, recommendations from the Area Plan Commission and the Historic Preservation Commission, as ivell as all related matters addressing annexation and zoning. " Members: There were four (4) Council Members this year serving on the Committee, namely: 1. Councilmember Oliver J. Davis, Chairperson 2. Councilmember John Voorde, Vice - Chairperson 3. Councilmember Gavin Ferlic, Member 4. Councilmember Jo M. Broden, Member Meetings: As of the date of this Annual Report, the Zoning and Annexation Committee met twenty (20) times this year. The majority of the Committee meetings focused on several rezoning and special exception requests. The following is a brief summary of some of the items referred to this Committee for an advisory review and recommendation: • Pokagon Band of Potawatomi Special Exception • Bruno & Rosa Cataldo Annexation • Insurance Auto Auctions Special Exception • Airport Authority Annexation • Kizer House Rezoning & Historic Landmark Designation 227 W. Davis 6th District Council Member Vice President, South Bend Common Council • Blackthorn Corporate Park Hotel Rezoning Petition • Gates Automotive Special Exception • Blessed Gospel Magazine Rezoning • River Walk, LLC Rezoning • Historic Designation for Elbel House • Avenue's Edge Tax Credit Project Rezoning • Commerce Center PUD Rezoning The Committee also reviewed text amendments to Chapter 21 of the South Bend Municipal Code which is aimed at protecting neighborhoods through closing loopholes in the SF- Single Family zoning designation definition. In the future, the Committee will take a closer look at other text amendments in Chapter 21 in order to promote density in the Central Business District. The Committee also intends to attend training in January 2017 which will educate the Council on the statutory guidelines we are bound to as it relates to various land use decisions. Most importantly, as the City of South Bend experiences new growth and development, especially within the CBD, it is imperative that this Committee works collaboratively and proactively with the Administration, the Area Plan Commission and other quasi-judicial bodies to review and update the City of South Bend's Comprehensive Plan & PUD ordinance — ensuring that growth and development are not impeded by an out of date planning ordinance but rather incentivized and informed through sound policy. The Zoning and Annexation Committee brochure which is available from the Council's website and from the Office of the City Clerk continues to be helpful to the public at large on matters which come before the Committee. I recommend that it be updated again in 2017 to reflect the duties and statutory requirements set before the Committee. The sheer number of rezoning and special exception requests indicates that there is growing interest and activity in the City of South Bend.
