Superior Equipment, LLC is pleased to submit this proposal to the City of South Bend. This
proposal responds to the needs of the City of South Bend, Various Refuse Roll -Off Containers.
Our company is a family -owned, full service container manufacturing company based in Elkhart,
Indiana. We have been serving our customers for over twenty years.
We invite the board to tour our recycling facility and experience our commitment to our
customers and outstanding service.

STATEMENT OF EXPERIENCE
In 1940, the Himes family created Himes Cartage Company and later established themselves as
pioneers in the waste industry. Through the years of varying economies, developing environmental
regulations and the changing needs of generators, The Waste -Away Group has always adapted in
the face of change. Innovation and creativity has been essential to developing a complete program
with exceptional service.
Our company is made up of an ownership team of five Himes family members from two generations
and over 170 employees. Currently, 17% of our team has greater than 15 years of experience with
the company and 64% of our team has more than 6 years experience. The organizational structure
has been created by the Himes' with the understanding that change is an on -going process, not an
event.
As a value-added service provider, we provide a strong resume of quality service backed by
extensive experience. The background includes owning and operating a landfill, developing
residential pickup, providing commercial and industrial service, offering document destruction and
recycling service. Below is a snapshot of our company history:

The Waste -Away capabilities are vast. Our fleet size is strong, our resources are readily available
and our team is eager to perform. From the service staff, to the CEO, our team always strives to
exceed customer expectations. Our market presence and company resources provide consistent
service with the flexibility to handle the unknown.
The Himes family leads our organization. Because we have our key management team under one
roof, it is very easy to get the appropriate decisions made quickly. When response time is
immediate in nature, our response time is effective.
The various divisions of our company include a residential and commercial hauling operation, a
recycling operation and a document destruction program:
Residential and Commercial Hauling Division
Today we operate with over 100 - Class 8 vehicles. When the a private company or
municipality considers the resources necessary to provide all types of service required, we
are the hauler that can respond with the most effective resources.
Recycling Division:
Our recycling division collects, processes and sells over 30 types of recyclable products. As
a secondary processor for numerous industrial and post consumer recycling, we are
consistently looking to improve our processes for our customer.
The multi -million dollar MRF (Materials Recycling Facility) opened in July of 2009 and allows
us to grow the single sort recycling program even bigger than it is today. We have the
network to investigate a variety of recycling methods and to respond to customer challenges
and find new sources for end markets.
Document Destruction
We take pride in offering this value-added service. Confidentiality is a large concern of many
organizations today. Our service offers the ability to address document destruction needs
with a variety of frequencies, programs and containers.
Safety
Safety is our first priority throughout the day. Waste -Away conducts monthly safety meetings and
"as needed" meetings to review current safety topics and to introduce new ways of improving safety
practices. Our supervisors take an active role in mentoring their drivers and riding with them to
promote awareness and proper procedure. We understand the importance of yielding to
pedestrians on campus and we are prepared to wait for the area to clear so as to err on the side of
safety.
Best Practices
Our years of experience have allowed the team to mold processes that yield the biggest benefit. We
have used these processes to benefit both new and existing customers. Waste -Away routinely
retains industry specialists to review and improve service. This allows a fresh perspective and it
further perfects our best practices.
Waste -Away is also actively engaged on various boards. Such organizations include the Indiana
Business Alliance ( Indiana University Business School as facilitator), National Solid Waste
Management Association, Indiana Solid Waste Management Association, Independent Haulers
Network, and the NSWMA Chairman's Council for Independent Haulers. The experiences shared
at these organizations are invaluable to us. We are invited to tour other facilities, engage in round
table discussions and share best practices.
Municipal Experience
Currently, Borden Waste -Away Service provides service to sixteen municipalities in the northern
Indiana and Southern Michigan area. We utilize our best practice methods to help our customers
with the service that makes sense for their goals.

Waste -Away Group has evolved since the 1940's. We pay attention to market trends, we make
changes after the proper research, and we move forward into the latest technology as the true
benefits present themselves. The market is constantly changing in today's environment. We will

1. Contractor has not, nor has any other member, representative, or agent of the firm,
company, corporation or partnership represented by him, entered into any combination,
collusion or agreement with any person relative to the price to be bid by anyone at such
letting nor to prevent any person from bidding nor to induce anyone to refrain from
bidding, and that this bid is made without reference to any other bid and without any
agreement, understanding or combination with any other person in reference to such

a. For purposes of this Certification, "Iran" means the government of Iran and any
agency or instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5,
as amended from time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor
is engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty
million dollars ($20,000,000) or more in value in the energy sector of Iran;
or
ii. Contractor, its successor or its affiliate, is a financial institution that extends
twenty million dollars ($20,000,000) or more in credit to another person for
forty-five (45) days or more, if that person will (i) use the credit to provides
goods and services in the energy sector in Iran; and (ii) at the time the
financial institution extends credit, is a person identified on list published by
the Indiana Department of Administration.
4. Contractor does not knowingly employ or contract with an unauthorized alien, nor
retain any employee or contract with a person that the Contractor subsequently learns is
an unauthorized alien. Contractor agrees that he/she/it shall enroll in and verify the work
eligibility status of all of Contractor's newly hired employees through the E-Verify
Program as defined by I.C. 22-5-1.7-3. Contractor's documentation of enrollment and
participation in the E-Verify Program is included and attached as part of this bid/quote;
and
5. Contractor shall require his/her/its subcontractors performing work under this
public contract to certify that the subcontractors do not knowingly employ or contract
with an unauthorized alien, nor retain any employee or contract with a person that the
subcontractor subsequently learns is an unauthorized alien, and that the subcontractor has
enrolled in and is participating in the E-Verify Program. The Contractor agrees to
maintain this certification throughout the term of the contract with the City of South
Bend, and understands that the City may terminate the contract for default if the
Contractor fails to cure a breach of this provision no later than thirty (30) days after being
notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a
contract by the City of South Bend through its agencies, boards, or commissions shall not
discriminate against any employee or applicant for employment in the performance of a
City contract with respect to hire, tenure, terms, conditions, or privileges of employment,
or any matter directly or indirectly related to employment because of race, sex, religion,
color, national origin, ancestry, age, gender expression, gender identity, sexual
orientation or disability that does not affect that person's ability to perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment,
materials, or any combination of the foregoing including, but not limited to, public works
contracts awarded under public bidding laws or other contracts in which public bids are
not required by law, the City, its agencies, boards, or commissions may consider the

Contractor's good faith efforts to obtain participation by those Contractors certified by
the State of Indiana as a Minority Business ("MBE") or as a Women's Business
Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive
bidder.
In no event shall persons or entities seeking the award of a City contract be required to
award a subcontract to an MBE/WBE; however, it may not unlawfully discriminate
against said WBE/MBE. A finding of a discriminatory practice by the City's MBE/WBE
Utilization Board shall prohibit that person or entity from being awarded a City contract
for a period of one (1) year from the date of such determination, and such determination
may also be grounds for terminating the contact for which the discriminatory practice or
noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination
commitment shall be made a part of any contract which it may henceforth enter into with
the City of South Bend, Indiana or any of its agencies, boards or commissions.
Contractor agrees not to discriminate against or intimidate any employee or applicant for
employment in the performance of this contract with privileges of employment, or any
matter directly or indirectly related to employment, because of race, religion, color, sex,
gender expression, gender identity, sexual orientation, handicap, national origin or
ancestry. Breach of this provision may be regarded as material breach of contract.
I, the undersigned bidder or agent as contractor on a public works project, understand my
statutory obligations to the use of steel products or foundry products made in the United
States (I.C. 5-16-8-1). I hereby certify that I and all subcontractors employed by me for
this project will use steel products or foundry products made in the United States on this
project if awarded. I understand I have an affirmative duty to notify the City in my bid
that my proposal does not include the use of steel products or foundry products made in
the United States. I understand it is my sole obligation and responsibility to provide a
justification to the City, subject to review and approval, why the cost of United States
made steel or foundry products is unreasonable. Prior to award and upon submission of
bid which does not use steel products or foundry products made in the United States, the
City, through its director of public works, shall make a determination if the price of
United States made steel or foundry is unreasonable. I understand that violations
hereunder may result in forfeiture of contractual payments.
