Present were Lloyd S. Taylor and James A. Bickel. BIDS OPENED FOR MISCELLANEOUS EQUIPMENT This being the date set for receiving bids for miscellaneous equipment, as follows: Item #1 - 4 8 to 10 cubic yard dump bodies with hydraulic systems. Item #2 - 1 5 to 7 cubic yard dump body with hydraulic system. Item #3 - 3 2,000 gal. flusher tank with gasoline engine operated pump. Item #4 - l ''Utility body for a 10,000 GVW truck 84" C.A. Item #5 - 7 Utility bodies for 3/4 ton cab and chassis trucks with 54" C.A. Item #6 - 3 16 cubic yard packer bodies for 25,000 GVW truck with 108" C.A. Item #7 - 1 30,000# capacity implement trailer Item #8 - 1 Utility body with 700#,capacity telescoping hydraulic operated lift for a 7500# truck with 54" C.A. the Clerk tendered proofs of publication in the South Bend Tribune and the Tri County News on December 5 and December 12, 1969, which were found to be r..1 proper. Model MTA 2,000 gal. street flashers $5,502.00 each. For three units $16,506.00 Reid Holcomb Company, Inc., 3333 W. California Road, Fort Wayne, Indiana. Non collusion affidavit and bid bond in the amount of $1,447.00 were found to be proper. Bid being: Item #3 - 3 New 1970 Etnyre Street flushers $14,463.00 Stanley Enterprises, Inc., 2808 Tucker Drive, South Bend, Indiana. Non collusion affidavit and certified check in the amount of $2,500.00 were found to be proper. Bid being Item #1' - 4 12' x 7' 8-10 yard dump bodies $11,036.00 Item #2 - 1 10' x 7' 5-7 yard dump body $.2,764.00 Item #4 - 1 128-4 CD -Stahl Body with bumper $ 1,357.00 Item #5 - 7 #96-CL Stahl low boy bodies w/ bumper $ 5,148.50 Streets and Ibads Equipment Co., 2508 S. Main Street, South Bend, Indiana. Non collusion affidavit and certified check in the amount of $1,312.50 were found to be proper. Bid being: Item #3 - 3 2,000 gal. street flusher $13,125.00 Jim Ries of Ries Equipment Company, Inc., 2804 Catherwood, Indianapolis, Indiana, in attendance at the meeting, stated his company had submitted a bid by certi- fied mail some 10 days ago. The bid was located in the Certified Mail Depart- ment at the Post Office and upon examination by the Board was found to be timely mailed and was opened. _Non collusion affidavit and bid undertaking in the amount of $1,700.00 were found to be proper. Bid being: Item #3 - -16 cubic yard Leach Packmaster $16,860.00 There being no further bids, upon motion made, seconded and carried, the bids were referred to the City Engineer and Richard Gartner, Street Commissioner, for review and recommendation to the Board. RECOMMENDATION FOR DISMISSAL FROM FIRE DEPARTMENT - STEPHEN DANIELOWICZ Fireman Stephen Danielowicz III having been suspended from the Fire Department on October.24, 1969, for a period of 60 days for violation of Article IX, Section 3, of the General Rules and Regulations of the Fire Department and not having reported back for duty at the end of the 60 day period on December 22, 1969, the matter was referred to the Legal Department for the preparation of charges . for dismissal as recommenddd by Fire Chief Joseph L._Zurat. PROMOTIONS - POLICE DEPARTMENT Upon motion made, seconded and carried, the Board approved the promotion of the following police officers to the rank -of -sergeant, effective January 1, 1970, as recommended by Chief of Police Loren M. Bussert: Salvatore Lazzara Richard Kazmierczak Robert Tomaszewski CONTRACT AWARDED FOR AUDIO VOICE TAPE RECORDER - POLICE DEPARTMENT Upon motion made, seconded and carried, the Board approved the recommendation of Police Chief Loren M. Bussert for the award of contract for the voice tape recording -reporting system to International Butiness Machines at $3,297.97, 12/29/69 that being the lowest and best bid received. Purchase order to be written after January 1, 1970. BUILDING DEPARTMENT - SUB -STANDARDS DIVISION J. W. Adamson, Sub -Standards Director, appeared before the Board and the following matters were taken up. 1820 S. Taylor. Mr. Adamson reported nothing further has been done to re- habilitate this structure. Upon motion made seconded and carried, the mat- ter was continued to January 12, 1970, and Mr. Adamson was directed to con- tact the owner. 1209 S. Lafayette. Mr. Adamson stated the owner has done nothing to re- habilitate this property as promised to the Board on October 20, 1969, and that the property is in a worse condition, is open and has been vandalized. Upon motion made, seconded and carried, the Sub -Standards Director was authorized to seek bids for the demolition of the premises. 120-122 S. Chapin Street. Mr. Adamson reported this property is secured. per minute 10/20/ 9 O Request for owners of sub -standard properties to appear before Board 1/12/70. Upon motion made, seconded and carried, the Board approved the request of the Sub -Standards Director for permission to have the following owners of sub- standard properties appear before the Board on January 12, 1970 to show cause if any they have why the following properties should not be demolished; Joseph and Pearl Culp - 1144 S. Main St. Goldie Oberlin - 145 E. Elder St. Stanley Kandzierski - 702 S. Olive St. John and Amy Ludlow - 412 E. Ohio St. Harriet Lawson - 730-732 South Bend Ave. Continental Homes of Indiana - 508 E. South St. Virginia Bailey - 208 S. Chapin St. And the Clerk was directed to so notify said owners by certified mail. RECOMMENDATION OF PURCHASING DIRECTOR FOR JANITORIAL SERVICES FOR MUNICIPAL SERVICES FACILITY The Purchasing Director having reviewed the bids for janitorial services for Municipal Services Facility for 1970, and having recommended to the Board that a contract be awarded for a period of three months, the motion was made, seconded and carried that the bids be referred to the City Controller for further review. HEARING ON ASSESSMENT ROLL - IMPROVEMENT RESOLUTION NO. 3274 - ALLEY BETWEEN MAIN AND MICHIGAN This being the date set, hearing was held on the assessment roll for the improvement of the alley between Main and Michigan Streets, from Bowman to Calvert, by constructing a Class C, Type I pavement. The Clerk tendered proofs of publication in the South Bend Tribune and the Tri County News on December 12 and December 19, 1969, which were read and found to be sufficient. No remonstrators having appeared and no written remonstrances having been received, upon motion made, seconded and carried, the assessment roll adopted December 8, 1969, was in all things confirmed. HEARING ON ASSESSMENT ROLL - IMPROVEMENT RESOLUTION NO. 3275 - ALEEY BETWEEN WAYNE STREET AND SUNNYMEDE AVENUE This being the date set, hearing was held on the assessment roll for the improvement of the alley between Wayne Street and Sunnymede Avenue, from Sunnyside Avenue to the alley west, by constructing a Class C pavement, Type I. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri County News on December 12 and December 19, 1969, which were read and found to be sufficient. No remonstrators having appeared and no written remonstrances having been received, upon motion made, seconded and carried, the assessment roll adopted December 8, 1969, was in all things confirmed. 12/29/69 HEARING ON ASSESSMENT ROLL - IMPROVEMENT NO. 3282 - WALL STREET This being the date set, hearing was held on the assessment roll for the im- provement of Wall Street, from Ironwood Street to 24th Street, by constructing a Class C pavement, Type IV. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri County News on Decembe.r 12 and December 19, 1969, which were read and found to be sufficient. Dallas Lung, 801 23rd Street, South Bend, Indiana, appeared before the Board in responsecto notice of the hearing. His only question was how the assess- ment was to be paid, which was explained. No remonstrators having appeared and no written remonstrances having been received, upon motion made, seconded and carried, the assessment roll adopted December 8, 1969, was in all things confirmed. AREA PLAN RECOMMENDATION AND ADOPTION OF VACATION RESOLUTION NO. 3307, 1969 - MOSSBERG AND,. -,COMPANY Area Plan Commission recommends to the Board the vacation of the north -south alley between Tutt and Sample Streets and the east -west alley between Carroll and Fellows Streets. And the Board, upon motion made, seconded and carried, adopts Resolution No. 3307, 1969, as follows: "RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, that it is desirable to vacate the following: Beginning at the southeast corner of Lot 6 in William S. Anderson's Subdivision in -the City of South Bend, Indiana; thence north along the east line of said Lot 6 to the north- east corner thereof; thence east along the north line of Lots 5, 4, 3 and 2 in said Subdivision, to the southwesterly line of Tutt Street; thence northwesterly along the south- westerly line of Tutt Street to the southeast corner of Lot 12 in said Subdivision; thence west along the south line of Lots 12, 11 and 10 to a point on the west line of said Lot 6 as extended northerly; thence south to the northwest corner of said Lot 6; thence east on the north line of said Lot 6 to a point 14 feet west of the northeast corner of said Lot 6; thence south'on a line parallel with and 14 feet west of the east line of said Lot 6, to the south line of said Lot 6; thence east 14 feet to the place of beginning, in St. Joseph County, Indiana. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation: Lots 2, 3, 4, 5, 6, 10, 11 and 12 in William S. Anderson's Subdivision. Notice of this Resolution shall be published on the 2nd day of January, 1970 and the 9th day of January, 1970, in the South Bend Tribune and in the Tri County News. This Board at its office, on the 12th day of January, 1970, at 9:36 6'clock, A.M., will hear and receive remonstrances from all persons interested in or affected by these proceedings. Bickel Attest: Doris Allen, Clerk " 1 12/29/69 1 REQUEST FOR PERMISSION TO OPERATE PARKING LOT - ANCIENT ACCEPTED SCOTTISH RITE Upon motion made, seconded and carried, the Board approved the request of Ancient Accepted Scottish Rite of Freemasonry, Masonic Temple, 427 N. Main Street, South Bend, Indiana, by Ira J. Martz, Secretary and Business Manager, for permission to operate Lot No. 202 at 415 N. Main Street, South Bend, Indiana, owned by the Board of Trustees of South Bend'Lodge of Perfection and/or Ancient Accepted Scottish'Rite, Valley of South Bend. Said lot parks 45 cars, at the rate of 25� per day until 6:00 P.M., 25� after 6:00 P.M.; 50� for 24 hours, or $5.50 per month,'with in and out privileges. Certificate of liability insurance to 5/27/71 was provided, and the Clerk was directed to deliver same to the office of the City Controller for filing. LEASE - CIVIC AUDITORIUM Copy of lease of Morris Civic Auditorium with Whirlpool Corporation for "Musical presentation and appliance demonstration" on December 10, 1969 was reviewed and ordered filed. TRAFFIC REGULATION APPROVED - CAROLINE AT EWING Upon motion made, seconded and carried, the Board approved the recommendation of the Traffic Director for the installation of stop signs on Caroline Street at Ewing Avenue. REQUEST FOR REVIEW OF ORDINANCE COVERING LICENSING OF TAXICABS At the request of the Clerk of the Board, it was moved, seconded and carried that the ordinance covering the licensing of taxicabs be referred to the City Controller and the Legal Department for review and revision for presentation to the Common Council. CONTRACTORS' BONDS The Board approved and ordered filed certificates continuing contractors' bonds as follows: Roseland Construction Company - to 1/1/71 Steve P. Ross - to 1/1/71 Frank Trimboli - to 1/1/71 B & G Construction Company - to 1/1/71 EXCAVATION BONDS The Board approved and ordered filed certificates continuing the following excavation bonds: B & G Construction Co. - to 1/1/71 William Cinal - to 1/1/71 Henry DeWulf - to 1/1/71 Raymond F. Hoffman - to 1/1/71 Walter T. Otterstein - to 1/1/71 Stanley E. Wesolowski - to l/l/71 STREET LIGHT OUTAGE REPORTS Street light outage reports for the period 12/15/69 to 12/19/ 9 were ordered filed.
