RE: Revised Approval - Encroachment into Public Right -of -Way — 828 Park Avenue
Dear Ms. DeCicco:
The Board of Public Works, at its meeting held on December 13, 2016, reviewed their
previous recommendation regarding the installation of a Historical Marker marking the
birthplace of poet Kenneth Rexroth in the tree lawn at 828 Park Avenue. The Board's previous
recommendation was to work with Jitin Kain, Deputy Director of Public Works on a smaller
sign. After review, Mr. Kam submitted a memo to the Board of Public Works stating
historical markers are the same standard size across Indiana and there is no precedent for a
smaller historical marker. Documentation was also submitted showing examples of historical
markers on residential property. Therefore, this encroachment was approved for placement
of a standard size historical marker in the tree lawn parallel to the street, subject to the
improvements not becoming a safety hazard. Enclosed please find a copy of the approved
memo from Mr. Kain.
The encroachment will be permitted to remain and continue until such time as the Board of
Public Works of the City of South Bend shall determine that such encroachment is in any way
impairing or interfering with the highway or with the free and safe flow of traffic thereon.
Said encroachment shall not in any way prejudice or preclude the City's rights with respect
to the future use of that portion of the right-of-way.

SUBJECT: Encroachment into Public Right -of -Way - 828 Park Ave.
The Board of Public Works at its meeting on November 8, 2016, approved a request by Ms. Linda
DeCicco to install a historic marker marking the birthplace of poet Kenneth Rexroth in the treelawn of
828 Park Ave. The sign placement included restrictions for the size of the sign to 4' above grade and
10' away from any driveway based on Building Dept's recommendation.
Since this time, I have spoken with Ms. DeCicco about her request and received communication from
Casey Pfeiffer with the Historical Marker Program at the Indiana Historical Bureau. Ms. Pfeiffer
explained that all historical markers are the same standard size across Indiana and fall under IC 4-23-
7.2-11. There is no precedent for a smaller historical marker. A document provided by Ms. Pfeiffer is
attached with this memo showing examples of State Historical markers on residential property.
It is my recommendation that the petitioner be allowed to place the historical marker at 828 Park Ave.
at the standard size proposed in the treelawn, parallel to the street. A current picture of the property
is also attached to this memo.
