July 14, 1969
A regular meeting of the Board of Public Works and Safety convened at 9:35
A.M., on July 14, 1969, with all members present. The minutes of previous
meetings were reviewed and approbed.
OPEN BIDS - IMPROVEMENT RESOLUTIO N.NO. 3 M - PRAST BOULEVARD.
This being the date set for receiving bids for the improvement of Prast
Boulevard, from Johnson Street to Huey Street,'by constructing a Class C
pavement with curb repair, the Clerk,tendered proofs of publication in the
South Bend Tribune and the•Tri County -News, which were examined and found
to be sufficient.
Bids were opened; non collusion affidavits were found to be proper; and bid
bonds in the amount of 5% of the total bids were found to be sufficient.

There being no further bids, upon motion made, seconded and unanimously
carried, the bids were referred to the consulting engineer, Clyde E. Williams
& Associates, Inc., for study and recommendation to the Board.
BUILDING DEPARTMENT - SUB -STANDARDS DIVISION
J. W. Adamson, Sub -Standards Director, appeared before the Board and the
following matters were taken up:
2207 Smith Street. Leon Little, representing the National Bank and Trust Company,
appeared before the Board. Mr. Little stated the National Bank and Trust
Company is the owner of this property through a mortgage foreclosure; that
they hope to sell the property and have a prospective buyer. Upon motion
made, seconded and unanimously carried, the matter was continued one week to
permit the Bank to decide what they intend to do with the property.
318 N. Cushing Street.. Mrs. Parcher appeared before the Board, as requested,
and stated that her father's estate has been closed and she is now the owner
of the property; and that she intends to rehabilitate it. Upon motion made,
seconded and unanimously carried, the matter was continued 30 days to permit
Mrs. Parcher to close up the premises and clean up the debris.
223 N. Adams.Street.•, Rose Scruggs, one of the owners of this property (who
failed to appear before the Board on Junec30, 1969, as requested) appeared
before the Board. Mr.*Adamson stated this property is in bad condition, al-
though presently closed up. Mrs. Scruggs stated she wants to rehabilitate
the property. Upon motion made, seconded?,and unanimously carried, an additional
two weeks was extended for the owner to make a final decision regarding the
property. (Permission was granted to advertise for bids for demolition of
this property on June 30, 1969, and Mr. Adamson stated bids have been re-
ceived for opening this date.)
506 Cushin,gs Street. Mr. Adamson reported the owner of this property is
tearing it down himself.
414 Pennsylvania Street. The request of Mr. Hartman,.Elkhart, Indiana, land
contract buyer of this property, who appeared before the Board, for two weeks
additional time, was denied by the Board.
1814 S. St. J oseph Street. Alice Walters did not appear -as requested. It
was moved, seconded and unanimously carried, to continue the matter one week
for further investigation as to ownership.

Bids opened for demolition:
This being the date set, bids were opened for demolition of the following
sub -standard buildings. Non collusion affidavit accompanying each bid was
examined and found to be proper. Bids were as follows:

Upon motion made, seconded and unanimously carried, bids for demolition of

pending disposition of the property by the owner.

On the basis of the fact that A & J Demolition is behind on three demolition
contracts, it was moved, seconded and unanimously carried that contract for
demolition of 204 E. Keasey Street be awarded to Julius O'Neal as the lowest
and best bid received, subject to the owner of the property taking an appeal
within the next seven days.

STATISTICAL REPORT FOR JUNE, 1969 - POLICE DEPARTMENT
Statistical report of the Police Department for June, 1969, was reviewed
and ordered filed.
MONTHLY REPORT FOR JUNE, 1969 - BUILDING DEPARTMENT
Monthly report of the Building Department for June, 1969, was reviewed
and ordered filed.
AMENDED PETITION TO VACATE ALLEYS - WOODEN KEG RESTAURANT
Wooden Keg Restaurant, 1611 S. Main Street, South Bend, Indiana, by Fred
J. Gantert, General Manager, files amended petition for the vacation of
the following:
First north -south alley west of Main Street, running from
the south line of Indiana Avenue south to the south line
of the first east -west alley south of Indiana.
Also, the first east -west alley south of Indiana Avenue
running from the west line of Main Street west to the east
line of the above mentioned north -south alley.
Upon motion made, seconded and unanimously carried, said amended petition
is referred to the City Engineer for drawing of the area before referral
to Area Plan Commission for its study and recommendation to the Board.
PETITION TO WIDEN GERTRUDE STREET UNDER BARRETT LAW
Fred Dittman, 2111 Gertrude Street, South Bend, Indiana, and five others
files petition to widen and install curbing on Gertrude,Street, from Ewing
Avenue to Prairie Avenue, under Barrett Law. Upon motion made,seconded
and unanimously carried, petition is referred to the City Engineer for
study and recommendation.
IMPROVEMENT RESOLUTION NO. 3288 RESCINDED - CLYDE STREET
For the improvement of Clyde Street, from Ewing Street to Altgeld Avenue,
by constructing a Class C pavement with curb repair.
Written remonstrances against said improvement bearing the signatures of
51% or more of the resident property owners on said street who may be
liable for assessment for said improvement having been filed with the Board
within 10 days following the date and time of hearing on said improvement,
upon motion made, seconded and unanimously carried, Improvement Resolution
No. 3288, 1969, adopted by the Board May 26, 1969, is hereby in all things
rescinded, and the improvement ordered not made.
IMPROVEMENT RESOLUTION NO. 3290 RESCINDED - ST. PETER STREET
For the improvement of St. Peter Street, from Howard Street to Corby
Boulevard, by constructing Class C pavement with curb repair.
Written remonstrances against said improvement bearing the signatures of
51% or more of the resident property owners on said street who may be
liable for assessment for said improvement having been filed with the Board
within 10 days following the date and time of hearing on said improvement,
upon motion made, seconded and unanimously carried, Improvement Resolution
No. 3290, 1969, adopted by the Board on June 2, 1969, is hereby in all
things rescinded, and the improvement ordered not made.
PETITION TO IMPROVE HAWTHORNE DRIVE UNDER BARRETT LAW
Donald Eberhart, 2020 E. McKinley, South Bend, Indiana and 18 others
file petition to improve Hawthorne Drive, from McKinley Street to Colfax
Avenue, by paving, under Barrett Law. Upon motion made,seconded and
unanimously carried, petition was referred to the City Engineer for
study and recommendation.

STREET AND SEWER PLANS FILED - KENSINGTON FARMS
Construction plans for streets and sewers in Kensington Farms Subdivision,
Section 5, were filed by Engineering Planning Services, Inc., of Mishawaka,
Indiana, and approved by the Board.
TRAFFIC REGULATIONS APPROVED
Upon motion made, seconded and unanimously carried the Board approved
the recommendation of the Traffic Engineer for the installation of a stop
sign and post on Hudson Street, at Portage Ayenue.
Upon motion made, seconded and unanimously carried, the Board approved the -
recommendation of the Traffic Engineer for the installation of a "Begin"
plate above the "30 Speed Limit" sign on the north side of Jackson Road,
200 feet west of York Road.
Upon motion made, seconded and unanimously carried, the Board approved the
recommendation of the Traffic Engineer for the installation of a "40 Speed
Limit" sign by banding to the 3rd UP on Jackson Road west of Ironwood.
Upon motion made, seconded and unanimously carried, the Board approved the
recommendation of the Traffic Engineer to locate meter posts so as to pro-
vide for a loading zone on the Lafayette Street side of the County -City
Building, such loading zone to be designated as an emergency type of zone
for access to the building.
SPEED LIMIT 30 SIGNS
Action on the recommendation of the Traffic Engineer for the installation
of Speed Limit 30 Signs and posts on Riverside Drive and on Summit between Western
and Fdnd was postponed for one week.
SPEED LIMIT SIGNS - JACKSON ROAD
Traffic Engineer reports the missing speed limit signs on Jackson Road
have been ordered replaced. Complaint having been filed by residents on
Renfrew Drive with the Board on June 30, 1969.
APPLICATIONS - FIRE DEPARTMENT
The following applications for appointment to the South Bend Fire Department
were filed with the Board and referred to the Personnel Director for further
processing;

IMPROVEMENT RESOLUTION NO. 3258 - HARTMAN DRIVE
For the improvement of Hartman Drive, from Rosemary•to dead end.
Fifty one percent or more of the resident property owners on Hartman Drive
having requested that said street be paved with Type IV pavement instead of
Type III -A as designated in the preliminary order adopted on June 30, 1969,
the preliminary order is hereby rescinded and said street is ordered paved
with Type IV pavement.
The Board, having examined all bids and being duly advised, upon motion made,
seconded and unanimously carried, awards contract to Bituminous Materials

Company, Inc., for the paving of said street with Type IV pavement on its'low
bid of $13,454.00. And said Company is hereby given notice to proceed with
such improvement.

For the improvement of 33rd Street, from Pleasant to Northside.
Fifty one percent or more of the resident property owners on 33rd Street
having requested that said street be paved with Type IV pavement instead of
Type 111-A as designated in the preliminary order adopted on June 30, 1969,
the preliminary order is hereby rescinded and said street isordered paved
with Type IV pavement.
The Board,having examined all bids and being duly advised, upon motion made,
seconded and unanimously carried, awards contract to Bituminous Materials
Company, Inc., for the paving of said street with Type IV pavement on its
low bid of $9,187.25. And said Company is hereby given notice to proceed
with such improvement.

IMPROVEMENT RESOLUTION NO. 3263 (AMENDED) - 35TH STREET
For the improvement of 35th Street, from Jefferson to the Railroad South.
Fifty one percent or more of the resident property owners on 33rd Street
having requested that said street be paved with Type IV pavement instead
of Type III -A as designated in the preliminary order adopted*on June 30,
1969, the preliminary order is hereby rescinded and said street is ordered
paved with Type IV pavement.
The Board, having examined all bids and being duly advised, upon motion
made, seconded and unanimously carried, awards contract to Bituminous
Materials Company, Inc., for the paving of said street with Type IV pavement
on fts low bid of $5,963.50. And said Company is hereby given notice to
proceed with such improvement.

For the improvement of Clyde Street, from Donald to Calvert.
Fifty one percent or more of the resident property owners on Clyde Street

of Type 111-A as designated in the preliminary order adopted on June 30,
1969, the preliminary order is hereby rescinded and said street is ordered
paved with Type IV pavement.
The Board, having examined all bids and being duly advised, upon motion
made, seconded and unanimously carried, awards contract to Bituminous
Materials Company, Inc., for the paving of said street with Type IV pavement
on its low bid of $4,515.80. And said Company is hereby given notice to
proceed with such improvement.

For the improvement of Sancome Avenue, from LaPorte to Lincolnway West.
Fifty one percent or more of the resident property owners on Sancome Avenue
having requested that said street be paved with Type IV pavement instead
of Type III -A as designated in the ,preliminary order adopted on June 30,
1969, the preliminary order is hereby rescinded and said street is ordered
paved with type IV pavement.
The Board, having examined all bids and being duly advised, upon motion
made, seconded and unanimously carried, awards contract to Bituminous
Materials Company, Inc., for the paving of said street with Type IV pavement
on its low bid of $3,060.00. And said Company is hereby given notice to
proceed with such improvement.

For the improvement of West Calvert Street, from Pulaski to Brookfield.
Fifty one percent or more of the resident property owners on West Calvert
Street having requested that said street be paved with Type IV pavement
instead of Type III -A as designated in the preliminary order adopted on June
30, 1969, the preliminary order is hereby rescinded and said street is
ordered paved with Type IV pavement.
Having examined all bids and being duly advised, the Board, upon motion made,
seconded and unanimously carried awards contract to Rieth Riley Construction
Company on its low bid of $10,297.80 for the paving of said street with
Type IV pavement. And said Company is hereby given notice to proceed with
said improvement.

AWARD OF CONTRACT
IMPROVEMENT RESOLUTION NO. 3268 (AMENDED) - WALSH STREET
For the improvement of Walsh Street, from Chalfant to Sorin.
d= Fifty one percent or more of the resident property owners on Walsh Street having
requested that said street be paved with Type IV pavement instead of Type
III -A as designated in the preliminary order adopted on June 30, 1969, the
preliminary order is hereby rescinded and said street is ordered paved with
Type IV pavement.
Having examined all bids and being duly advised, the Board, upon motion made,
seconded and unanimously carried, awards contract -to Bituminous Materials
Company, Inc., on its low bid of $8,927.50 for the paving of said street with
Type IV pavement. And said Company is hereby given notice to proceed with
said improvement.
VACATION RESOLUTION NO. 3295 ADOPTEi"UNE 30, 1969 RESCINDED - FRANKLIN STREET
Due to scrivener's error -requiring readvertising and the setting of a new
hearing date, Vacation Resolution No. 3295 adopted June 30, 1969, being for
the vacation of Franklin Street, from Western M enue south to Monroe Street,
is hereby rescinded and voided.
VACATION RESOLUTION NO. 3295 ADOPTED - FRANKLIN STREET
Upon motion made, seconded and unanimously carried, the following Resolution
was adopted:
"RESOLVED, BY THE BOARD OF PUBLIC WORKS AND SAFETY OF SOUTH
BEND, INDIANA, that it is desirable to vacate the following:
Franklin Street, from Western Avenue south to Monroe Street.
Reserving the rights and easements of all -utilities and the
Municipal City of South Bend, Indiana, to construct and maintain
any facilities, including but not limited to electric, telephone,
gas, water, sewer, surface water control structures and ditches
within the vacation right of way unless such rights are released by
the individual utilities.
The following property may be injuriously or beneficially
affected by such vacation:
Lot Nos. 1, 2, 3, 4, 5, 6, 7 and 8,of Block 8 of Vail's
southwest Addition and Lot Nos. 24, 25, 26, 27, 28, 29, 30 and 31
of part of Vail's Southwest Addition.
Notice of this Resolution shall be published on the l8th
day of July and on the 25th day of July, 1969, in the South Bend Tribune
and the Tri County News.
This Board, at its office in the City Ha ll, on the 2!8th day
of July, 1969, at 9:30 A.M., will hear and receive remonstrances from
