The minutes of the previous meeting were reviewed and approved. HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3277, 1969 - EDMOND COURT This being the date set, hearing was held on the assessment roll in Vacation Resolution No. 3277, being for the vacation of: A portion of Edmond Court, situated between Notre.Dame Avenue and Frances Street, from LaSalle Avenue south to the first east -west alley also known as Luther Court. Proofs of publication in the South Bend Tribune and the Tri-County News on April 4, April 11 and April 18, 1969, were read and found to be sufficient. No remonstrators having appeared and no written remonstrances having been re- ceived, on motion made, seconded and carried, the assessment roll was in all things ratified, confirmed and approved, and the proceedings closed and the property declared vacated. PRELIMINARY HEARING ON VACATION RESOLUTION NO. 3278, 1969 - A. T. F, T. This being the date set preliminary hearing was held on Resolution No. 3278, being for the vacation of: Part of the existing alleys located in Weaver's Subdivision in the City of South Bend, St. Joseph County, Indiana, being further described as follows: Beginning at the southeast corner of Lot 8 in said Weaver's Subdivision; thence north along the east line of Lots 8, 9 and 10 in said Subdivision 127.50 feet; thence east along the north line of the existing alley 32.0 feet; thence south parallel with the west line of Lot 7 and the east line of Lots 8, 9 and 10 in said Sub- division 16.50 feet to a point on the north line of the south 111.00 feet of Lot 7; thence west along said north line of the south 111.00 feet of Lot 7, a distance of 22.0 feet; thence south along the west line of Lot 7, a distance of 111.00 feet to the southwest corner of said Lot; thence west 10.0 feet to the point of beginning. The Clerk tendered proofs of publication in the South Bend Tribune and the Tri-County News on April 11 and April 18, 1969, which were read and found to be sufficient. Attorney Joseph A. Roper and D. D. Cottrell of the American Telephone and Telegraph Company, appeared before the Board. Also appearing before the Board were six interested property owners, spokesmen for whom were Mr. and Mrs. Frank Kaczorowski, 619 W. Wayne Street, South Bend, Indiana, and William Lawson, 405 Lincolnway West, South Bend, Indiana, the owner of property at 221 S. Taylor Street. The concern of the property owners was for ingress and egress through the new alley and complaint of blocking the present alley. This having been re- solved satisfactorily, upon motion made, seconded and carried, further action was postponed for one week, and the petitioner was requested to provide the Board with a dedication and a written undertaking to complete the improvements within a specified time. APPLICATIONS - POLICE DEPARTMENT The following applications for appointment to the Police Department were filed and referred to the Personnel Director for further processing: Ralph Davis Daniel Anthony Lattimer Douglas William Laymon 4/21/69 BUILDING DEPARTMENT - SUB -STANDARDS DIVISION J. W. Adamson, Sub -Standards Director, appeared before the Board, and the following matters were taken up. 1131 E. Bowman. Mr. Adamson reported this house is open, has had a fire and is in bad condition. Attorney John Montgomery appeared before the Board on behalf of the owner, stating it is up for sheriff's sale on May 8, 1969. Upon motion made, seconded and carried, the matter was post- poned until May 12, 1969, on condition that the building be closed up in the interim. 1529 W. Colfax. This being the date set, bids were opened for the de- molition of this property. INon collusion affidavits, accompanying each bid, were found to be proper. Bids were as follows: O'Neal Trucking Company $335.00 John E. Vanek 396.00 A & J Demolition Co. 375.00 Harvey R. Bryant 435.00 A. Midwest Demolition & Wrecking Co. 580.00 Upon motion made, seconded and unanimously carried, contract for demolition of the property was awarded to O'Neal Trucking Company, that being the lowest and best bid received. 302 E. Pennsylvania. William Marvel, owner of this property, did not appear as requested. Mr. Adamson stated.there had been a fire here about a year ago and that the house is open. Upon motion made, seconded and unanimously carried, permission was granted to advertise for demolition of the property. 1407 S. Rush Street. David C. Sharp, the owner of this property, did not appear as requested. Mr. Adamson stated that this property had been de- molished by the owner in a satisfactory manner. 526 Arthur Street. Mr. Adamson stated the owner of this property, who lives in Chicago, was in to see him and that she is now willing -..to have the property demolished. Upon motion made, seconded and unanimously carried, the Board granted permission to advertise for bids for demolition -of the property. 2117 W. Washington Street. Mr. Adamson stated that he had inspected these premises this morning and that the structure is standing open and that the debris and junk had only partially been cleaned up. Upon motion made, seconded and unanimously carried, permission was granted to advertise for bids for demolition of the premises. 715 Marietta Street. Mr. Adamson stated that his investigation discloses that Gene Oakley of Indianapolis is the owner of this building; that a telephone conversation was had with Mr. Oakley who advised that he expected to be in South Bend shortly and that he would have the materials removed and the building made safe. 1212 Rush Street. Upon motion made, seconded and unanimously carried, the Board granted permission to advertise for bids for the demolition of this building. Upon motion made, seconded and unanimously carried, the Board approved the re- quest of Mr. Adamson for the owners of substandard buildings to appear be- fore the Board on May 5, 1969, to show cause why the following structures should not be demolished: 134 N. Olive Street Anderson Jones 1053 LaSalle Street Martha Faulkner 1509 W. Sample Street (accessory bldg.) George Hunter 7282 S. Fellow Street Mrs. Ella Mae Seward And the Clerk was directed to so advise such owners by certified mail. i IE 4/21/69 REQUEST TO HOLD STREET SERVICES - REV. BRINKLEY COLLIER - WASHINGTON & WALNUT Rev. Brinkley Collier, of the Emanuel Church of God in Christ, 415 W. LaSalle Street, South Bend, appeared before the Board in connection with his request to hold street meetings at the corner of Washington and Walnut Streets on Thursdays and Saturdays, from 5:00 P.M. to 6:00 P.M., commencing immediately and ending about the middle of September, 1969. There being no objection to such meetings by the Police Department, upon motion made, seconded and - unanimously carried, the Board approved the request. REQUEST TO HOLD PARADE - THIRD DISTRICT :'VETERANS OF FOREIGN WARS Upon motion made, seconded and unanimously carried, the Board approved the re- quest of the Third District, Veterans of Foreign Wars, 1047 Lincolnway.East, South Bend, Indiana, to hold a parade on April 26, 1969, between 1:00 P.M. and 4:00 P.M., beginning at Wayne and Lafayette Streets, going east to Michigan, north to Colfax, west on Colfax to Main, south on Main and disband- ing at Jefferson and Main Streets. REQUEST TO HOLD STREET MEETING- SOPHOMORE LITERARY FESTIVAL COUNCIL - NOTRE DAME The=red west of James E. Metzger, chairman of the Sophomore Literary Festival Couneii, 222 Badin Hall; University of Notre Dame, Notre Dame, Indiana, to hold a "demonstration of opinion" meeting April 24, 1959, from 1:00 P.M. to 5:00 P.M., 300 block of West Jefferson Boulevard, was considered by the Board. The Clerk was directed to advise Mr. Metzger no permit is necessary. Mr. Metzger explained about 120 students wished to hold this meeting in front of WSBT TV Station to protest censorship by Columbia Broadcasting System of CBS programs, particularly the program of the Smothers Brothers. REQUEST TO ATTEND 'TRAFFIC INST'-ITUTE Upon motion made, seconded and unanimously carried, the Board approved the re- quest of Lloyd S. Taylor, City Engineer, to attend the Urban Arterial Traffic Institute April 22, and April 23, 1969. STREET PLANS APPROVED - CREST MANOR, IRELAND HEIGHTS City Engineer Lloyd S. Taylor reported that he has reviewed the street plans submitted for Crest Manor, Ireland Heights, and finds them to be in order. Thereupon, the motion was made, seconded and unanimously carried, that such plans be approved. PETITION TO IMPROVE VINE STREET, FROM 32ND TO 34TH STREET The petition of Beatrice Voelkel, 946 33rd Street, South Bend, Indiana, and 13 others to pave Vine Street, from 32nd Street to 34th Street, was filed and, upon motion made, seconded and carried, was referred to the City Engineer for study and recommendation. STREET LIGHT PETITION - 932 E. SORIN STREET The petition of Brinkley Collier, 932 E. Sorin Street, South Bend, Indiana and 19 others for a street light at 932 E. Sorin Street was filed and, upon motion made, seconded and unanimously carried, was referred to the Traffic Engineer for study and recommendation. RELEASE EXECUTED - CITY OF SOUTH BEND VS. VEOLA VAUGHN Release, prepared by the Legal Department, was executed by the Board for the settlement of a claim of the City of South Bend against Veola Vaughn for the sum of $1,284.00 for damage to a police car resulting from a collision on September 19, 1967. TRAFFIC REGULATIONS Action in regard to the following traffic regulations: 30 miles per hour speed limit on York Road, 25 miles per hour speed limit on Berkshire. 1 1 1 was postponed to April 28, 1969. 4/21/69 REQUEST FOR ANNUAL BICYCLE AUCTION Upon motion made, seconded and unanimously carried, the Board approved the request of the Police Department -to sell unclaimed bicycles'at public auction, according to statute. Such auction to be held in the Police Garage at 701 W. Sample Street, starting at.1:00 P.M. on Friday, May 16, 1969. And the Clerk is directed to publish notice on May 2 and M'ay 9,. 1969. STREET LIGHT PETITION - 800-90G BLOCK ON DAYMON Petition for street light between the 800 and 900 block on Dayton was filed with the Board by Mr. and Mrs. John Bloom, 909 E. Dayton Street, and 16 others and, up on motion made, seconded and unanimously carried, was referred to the -Traffic Engineer for study and recommendation. TRAFFIC REPORT - POLICE DEPARTMENT Report of`the Police Traffic Department for March, 1969, was reviewed and "ordered filed. CONTRACTORS' BONDS Contractor's bond on behalf of Cavuria Construction Company, 619 25th Street, South Bend, Indiana, expiring 4/16/70, was approved by the Board. Certificate continuing contractor's bond on behalf of Herman F. Glaser to 4/20/70 was approved by the Board. STREET LIGHT OUTAGE REPORTS Street light outage.reports for the period 4/9/69 to 4/18/69 were ordered filed. There being no further business to come before the Board, the meeting ad- journed at 11:50 A.M. 1
