Committee Chair Oliver Davis called the meeting order with four (4) items on the agenda.
Bill No. 52 -16: Portage Ave. Rezoning & Special Exception
Keith Chapman, Area Plan Commission with offices on the 11th Floor of the County -City
Building, served as the presenter of this bill. The petitioner is requesting to rezone from PUD
Planned Unit Development and MU Mixed Use to MU Mixed Use. On site is currently a
building and vacant land. To the north of the site are single - family homes zoned SF2 Single
Family as well as a parking lot zoned MU Mixed Use. To the east are single family homes zoned
SF2 Single Family. To the west are single family homes zoned SF2 and MU Mixed Use. Mr.
Chapman provided images of the site which are on file with the City Clerk's Office. The site
plan and proposed building sketch are also on file with the City Clerk's Office. This bill comes
to the Council with a favorable recommendation from the Area Plan Commission. Rezoning this
site to MU Mixed Use will allow for the reuse and redevelopment of an underutilized building
and vacant land. The special exception use will serve the residents and retail users of the site.
The proposed development will fill a need in the neighborhood for affordable housing and local
retail. The special exception use comes to the Council with no recommendation.

Mike Danch, 1643 Commerce Drive South Bend, served as the petitioner for this bill. What we
are doing is taking the Ford distribution building and changing it into a Mixed Use project for
residential development and some commercial development. This project has been before
Council before and it is almost the same as this one (1) but before we had forty -two (42)
residential units and this time we are up to fifty -six (56) units of residential development along
with commercial development. The property that is on the corner of Rex and Portage has also
been added to this project site and it is currently owned by the City of South Bend. That will
allow for additional parking for this project. The parking areas have screening so all adjacent
residential areas will be screened from the parking lot. One (1) of the other things we are asking
the Council to do is approve two (2) special exceptions. The reason for them is because we have
off -site parking. The parking lot to the south and also the five (5) spaces to the east on California,
because they are not on the same piece of property that the building is located on. We have to
have a special exception approved for off -site parking. We have been working with Community
Investment, who originally wanted half of the parking lot to be used for additional development
but with the Area Plan Commission requirements for parking that goes away. The Area Plan
Commission gave no recommendation on that due to some confusion between what was
approved for the parking variance. All lighting will have to stay on -site and there will be no
spillage over to the other properties. From our standpoint we believe we have met all conditions
required. There will be some tax credits that need to be authorized by the State of Indiana.
Committeemember Ferlic asked if this is contingent on receiving those tax credits.
Mr. Danch responded, yes. We will know in March if we receive them.
Councilmember Williams- Preston asked what kind of commercial space will go in at the
property.
Mr. Danch responded we have secured some early commitments from Goodwill and a veteran
group. It will be light commercial that will complement the area. This site is also on the bus route
which is beneficial to the parking situation. There also is parking on the street but we are not
allowed to use that in our calculations. We have also received confirmation that visitors could
park at the Near North West Organization's parking lot but we also can't include those figures as
well. We are aiming not to have any parking on the street.
Councilmember Scott asked about potential screening for the parking lot.
Mr. Danch responded we will have screening along the entire parking lot as is required.
Councilmember Jo M. Broden asked if the site is a brownfield.
Mr. Danch stated there was a gas station on the corner lot and the City has to work that out.
Councilmember Scott stated there was a little gas station there at one (1) point and also a dry
cleaner. He stated he does believe it is a brownfield and the best thing to do is cap it.
No one from the public spoke either in favor of or in opposition to the bill.

Committeemember Gavin Ferlic made a motion to send Bill 52 -16 to the full Council with a
favorable recommendation. Committeemember John Voorde seconded the motion which carried
by a voice vote of four (4) ayes.
Bill No. 53 -16: 331 Wayne Street Rezoning
Committeemember Gavin Ferlic made a motion to continue Bill 53 -16 until November 28tH
2016. Committeemember John Voorde seconded the motion which carried by a voice vote of
four (4) ayes.
Bill No. 54 -16: 1037 Elmer St. Rezoning
Keith Chapman, Area Plan Commission with offices on the 11th Floor of the County -City
Building, served as the presenter of this bill. The petitioner is requesting to rezone from SF
Single Family to MU Mixed Use. On site currently is vacant lands. To the north are single family
homes. To the east are single family homes. To the south and west are businesses zoned MU
Mixed Use. Mr. Chapman provided images of the property which are on file with the City
Clerk's Office. This comes to the Council from the Area Plan Commission with a favorable
recommendation, rezoning this property would allow for the expansion of an existing business.
With the appropriate buffering, the business will be a positive asset for the neighborhood.
There was no petitioner for this bill. City Clerk Fowler stated she would make sure to contact the
petitioner to see if they would be able to make it to this evening's full Council meeting.
Committeemember Gavin Ferlic made a motion to send Bill 54 -16 to the full Council with no
recommendation. Committeemember Jo M. Broden seconded the motion which carried by a
voice vote of four (4) ayes.
Substitute Bill No. 41 -16: Commerce Center PUD Rezoning at 401 E. Colfax
Committee Chair Davis distributed a letter to the Committee. He stated they are asking for
information to be submitted by the Administration to receive more updates on the rezoning.
Everything submitted by the Administration and Mr. Mathews will be online. There have been a
number of letters both in favor and in opposition to the bill. Committee Chair Davis detailed the
reports that they have received so far from the Administration. We still need to receive a letter
from the Mayor related to this bill. A notice will be sent out with all the information we still need
to receive. Right now it is scheduled for hearing on November 10, 2016 and we could vote that
night or delay until the first meeting in December. We still have a lot of information we need to
receive from a number of parties.
With no further business before the Committee, Committee Chair Oliver Davis adjourned the
meeting at 5:58 p.m.
