SECTION IV. ASSURANCES
1.01 The undersigned Bidder proposes and agrees, if this Bid is accepted, to enter into an
Agreement with OWNER in the form included in the Bidding Documents to perform
all Work as specified or indicated in the Bidding Documents for the prices and within
the times indicated in this Bid and in accordance with the other terms and conditions
of the Bidding Documents.
2.01 Bidder accepts all of the terms and conditions of the Notice to Bidders and
Instructions to Bidders, including without limitation those dealing with the
disposition of Bid security. This Bid will remain subject to acceptance for 60 days
after the day of Bid opening, or for such longer period of time that Bidder may agree
to in writing upon request of OWNER.
3.01 In submitting this Bid, Bidder represents, set forth in the Agreement, that:
A, Bidder has visited the Site and become familiar with and is satisfied as to the
general, local and Site conditions that may affect cost, progress, and
performance of the Work.
B. Bidder is familiar with and is satisfied as to all federal, state and local Laws
and Regulations that may affect cost, progress, and performance of the Work.
C. Bidder has obtained and carefully studied (or assumes responsibility for
having done so) all additional or supplementary examinations, investigations,
explorations, tests, studies and data concerning conditions (surface,
subsurface and Underground Facilities) at or contiguous to the Site or
otherwise which may affect cost, progress, or performance of the Work or
which relate to any aspect of the means, methods, techniques, sequences and
procedures of construction to be employed by Bidder, including applying the
specific means, methods, techniques, sequences, and procedures of
construction expressly required by the Bidding Documents to be employed by
Bidder, and safety precautions and programs incident thereto.
D. Bidder does not consider that any additional examinations, investigations,
explorations, tests, studies or data are necessary for the determination of this
Bid for performance and furnishing of the Work at the price(s) bid and within
the times and in accordance with the other terms and conditions of the
Bidding Documents.
E. Bidder is aware of the general nature of work to be performed by OWNER
and others at the Site that relates to the Work as indicated in the Bidding
Documents.

F Bidder has correlated the information known to Bidder, information and
observations obtained from visits to the Site, repots and drawings identified
in the Bidding Documents, and all additional examinations, investigations,
explorations, tests, studies and data with the Bidding Documents.
G. Bidder has given ENGINEER written notice of all conflicts, errors,
ambiguities or discrepancies that Bidder has discovered in the Bidding
Documents, and the written resolution thereof by ENGINEER is acceptable to
Bidder.
It The Bidding Documents are generally sufficient to indicate and convey
understanding of all terms and conditions for performance of the Work for
which this Bid is submitted.
Bidder is not in arrears to the City of South Bend, upon debt or contract; is
not a defaulter, as surety or otherwise, upon any obligation to the City of
South Bend; and has not been delinquent or unfaithful in any former contract
with the City of South Bend.
That no officer or employee or person whose salary is payable in whole or in
part by the Ovnier is, shall be or become interested, directly or indirectly, as a
contracting party, partner, stockholder, surety or otherwise, in this Bid, or in
the performance of the Contract, or in the supplies, materials, or equipment
and Work or labor to which it relates, or in any portion of the profits thereof:
K. That the Bidder is a duly registered Contractor in the State of Indiana and has

L. Bidder agrees that the Work will be substantially complete within 300
calendar days after the notice -to -proceed as provided in paragraph 2.03 of
the General Conditions, and completed and ready for final payment in
accordance with paragraph 14.07 of the General Conditions within 330
calendar days of the Notice -to -Proceed.
M. Milestone 1 — Bidder agrees that all submittals will be submitted to
ENGINEER within 90 calendar days ofNotiee-to-Proceed.
4.01 Bidder further represents that this Bid is genuine and not made in the interest of or on
behalf of any undisclosed individual or entity and is not submitted in confornity with
any agreement or rules of any group, association, organization or corporation; Bidder
has not directly or indirectly induced or solicited any other Bidder to submit a false or
sham Bid; Bidder has not solicited or induced any individual or entity to refrain from
bidding; and Bidder has not sought by collusion to obtain for itself any advantage
over any other Bidder or over OWNER.

SECTION VI ADDITIONAL PROVISIONS
Unit Prices have been computed in accordance with paragraph 11.03 of the General
Conditions.
2. Bidder acknowledges that quantities are not guaranteed and final payment will be
based on actual quantities determined as provided in the Contract Documents.
Bidder agrees that the Work will be substantially completed and completed and ready
for final payment in accordance with paragraph 14.07.B of the General Conditions on
or before the dates or within the number of calendar days indicated in the Agreement.
4. Bidder accepts the provisions of the Agreement as to liquidated damages in the event
of failure to complete the Work within the times specified above, which shall be
stated in the agreement.
The following documents are attached to and made a condition of this Bid
a. Required Bid Security in the amount of five percent (5%) of the bid in the
form of a certified check, a bank cashier's check, or a Bid Bond on the
attached form. The Bid Security will be retained or returned in accordance
with Article S of the Instructions to Bidders.
b. Required Bidder's Qualification Statement with supporting data; including
Bidder's Financial Statement in a separately sealed envelope in accordance
with Article 3.01 of the Instruction to Bidders.
C. Executed copy of Contractor's Non -Collusion and Non -Debarment
Affidavit, Certification Regarding Investment with Iran, Employment
Eligibility Verification, Non -Discrimination Commitment and Certification
of Use of United States Steel Products or Foundry Products, available in
Exhibit SC-B.
5. The terms used in this Bid which are defined in the General Conditions or
Instructions to Bidders will have the meanings indicated in the General Conditions or
Instructions to Bidders.

1. Bidder and Surety, jointly and severally, bind
themselves, their heirs, executors, administrators,
successors and assigns to pay to Owner upon default of
Bidder the penal sum set forth on the face of this Bond.
Payment of the penal suns is the extent of Surety's liability.
2. Default of Bidder shall occur upon the failure of Bidder
to deliver within the time regwred by the Bidding
Documents (or any extension tlicroof agreed to in isruing by

G. No suit or action shall be commenced under this Bond
prior to 30 calendar days afler the notice of default required
in Paragraph 4 above is received by Bidder and Surety and
in no cruse later than one year alter Bid due date.
7. Any suit or action under this Bond shall be commenced
only in a coed of competta tjurisdiction located in the state
in which the Project is located.
8. Notices required hereunder shall be in writing and sent
to Bidder and Surety at their respective addresses shown on
the face of this Bond. Such notices may be sent by personal
delivery, commercial courier, or by United Stales
Registered or Certified Mail, return receipt reques
postage prepaid, and shall be deemed to be effective upon
receipt by the party concened.
9. Surety shall cause to be attached to this Bond a current
and effective Power of Attorney evidencing the nmltoiily of
the officer, agent, or representative who executed this Bond
on behalf of Surety to execute, seal, and deliver such Bond
and bind the Surety thereby.
10. This Bond is intended to conform to all applicable
statutory requirements. Any applicable requiremew of any
applicable statute that has been omitted from this Bond shall
be deemed to be included herein as if set forth at length if
any provision of this Bond conflicts with any applicable
statute, then the provision of said statute shall govern and
the remainder of this Bond that is not in conflict therewith
shall continue in full force and effect.

3. If you intend to sublet any portion of the work, attach the name and address of each
subcontractor, equipment to be used by the subcontractor, and whether you will require a
bond. However, if you are unable to currently provide a listing, please understand a listing
must be provided prior to contract approval. Until the completion of the proposed project, you
are under a continuing obligation to immediately notify the City of South Bend in the event that
you subsequently determine that you will use a subcontractor on the proposed project.

LIST(S): The bidder reviewed the City of South Bend's Minority and Women Business
iversity Development Program, which uses the IDOA approved list of Minority and Women
as found on their website (http://www.in.gov/idoa).
ON (ADVERTISE/CONTACT): In order for your bid to be deemed responsive, the City of South
requires that all perspective bidders complete no less than 2 of the following:
. Attend all pre -bid meetings scheduled by the City to inform MBENVBEs of contracting and
subcontracting opportunities.
2. Advertise in general circulation and/or trade association publications concerning subcontracting
opportunities, and allow MBE/WBEs reasonable time to respond.
X 3. Perform any and all necessary steps to provide written notice in a manner reasonably calculated
to inform MBENVBEs of subcontracting opportunities and allowed sufficient time for them to
participate effectively.
4. Utilize pre-existing services of available community organizations, small and/or disadvantaged
business assistance offices and other organizations that provided assistance in the recruitment
and placement of MBENVBE firms.
"Bidder must circle or otherwise notate which of the two (2) required actions were performed.
.ODD FAITH NEGOTIATIONS: The bidder negotiated in good faith with interested MBENVBEs,
including providing such MBENVBE's with adequate information about the plans, specifications and other
requirements of the subcontract and did not reject MBEIVVBEs as unqualified without sound business
reasons based on a thorough investigation of their capabilities.
MALL CONTRACT(S): The bidder selected specific portions of the work to be performed by
