OPEN BIDS - DIVISION A,,WASTEWATER TREATMENT PLANT ADDITIONS This being the date set for receiving bids for the construction of Division A, Wastewater Treatment Plant Additions, the Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri County News on April 23 and April 30, 1971, which were read and found to be sufficient. The President of the Board stated he would read only the total amount of each bid,if agreeable to the bidders present, and the low bid in its entirety. No objections were made, and the bids were opened as follows: �-{ Acton Construction Company, P. 0. BJx 394, Hugo, Minnesota. Non collusion affidavit was found to be proper. The bid was accompanied by a bid bond in the amount of 5% of the bid, together with bidder's financial statement (State Board of Accounts Form 96-a. The bid was accompanied by a bid bond in the amount of 5% of the bid, together with bidder's financial statement (State Board of Accounts Form 96-a). Total bid --------------------- $7,896,300.00 H. G. Christman Construction, Inc., 850 S. Fellows Street, South Bend, Indiana. Non collusion affidavit was found to be proper. Total bid-------------------- $8,749,000.00 Schumacher Sons, Inc., 321 S. Spring Street, Mishawaka, Indiana. Non collusion affidavit was found to be proper. The bid was accompanied by a bid bond in the amount of 5% of the bid, together with bidder's financial statement (State Board of Accounts Form 96-a). Sollitt Construction Company, 301 Columbia Street, South Bend, Indiana. Non collusion affidavit was found to be proper. Total bid-------------------- $6,540,000.00 The bid of Sollitt Construction Company, being the low bid, was read in its entirety. Upon motion made, seconded and unanimously carried, the bids were referred to Clyde E— Williams and Associates, Inc., consulting engineers, for review and recommendation to the Board. NO BIDS RECEIVED - FOR THE SALE OF REAL ESTATE AT WASHINGTON AND CHAPIN This being the date set for receiving bids for the sale of real estate generally described as a part of Lot 4 in Mary Witherill's Subdivision of Bank Out Lot 32 located on the northwest corner of Washington Avenue and Chapin Street, in the city of South Bend, Indiana, the Clerk tendered proofs of publication of notice in the South Ba'i)d Tribune and the Tri County News on May 14 and May 21, 1971, which were read and found to be sufficient. No bids having been received, it was moved, seconded and unanimously carried that the City Attorney be permitted to negotiate a sale of sa-id property on the open market. 5/24/71 Fi1RE-:DEPARTMENT - REQUEST TO BE EXCUSED FOR MILITARY DUTY Upon motion made, seconded and unanimously carried, the Board approved the request of Fire Chief Joseph L. Zurat for firemen David Daren and Alan J. Dzialakiewicz to be excused for military in the United States Marine Corps May 29 to June 13, 1971. POLICE DEPARTMENT - APRIL, 1971 REPORTS Statistical report and traffic report of the Police Department for the month of April, 1971, were reviewed and ordered filed. BUILDING DEPARTMENT SUB -STANDARDS DIVISION Richard Liszewski, Sub -Standards Director appeared before the Board and the following matters were taken up: 305 E. Wenger Street. Mr. Liszewski reported Alonzo Johnson, the owner, expects to bring the property up to standard within 30 days. Upon motion made, seconded and carried, the matter of 305 E. Wenger Street was con- tinued four weeks. 424 S. Illinois Street. Mr. Liszewski reported the structure at 424 S. Illinois Street has been secured and the premises cleaned up. Upon motion made, seconded and carried, the matter of 424 S. Illinois Street was continued indefinitely, under the surveillance of the Sub -Standards Department. AREA PLAN COMMISSION RECOMMENDATION ADOPTION OF VACATION RESOLUTION NO. 3342, 1971 EAST -WEST ALLEY BETWEEN WESTERN AND MONROE - DEPARTMENT OF REDEVELOPMENT Area Plan Commission files wth the Board its recommendation for the vacation of the east -west alley between Western Avenue and Monroe Street, running west from the west right.of way line of Michigan Street to the east right of way line of the north -south alley between Michigan and Main Streets. Upon motion made, seconded and unanimously carried, the following Resolution was adopted: "VACATION RESOLUTION NO. 3342, 1971 "RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: The east -west alley between Western Avenue and Monroe Street, running west from the west right of way line of Michigan Street to the east right of way line of the north -south alley between Michigan Street and Main Street. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited,to the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are re- leased by the individual utilities. The following property may be injuriously or beneficially affected by such vacation: Lots 13, 14, 15, 16, 17 and 18 in Martin's Subdivision. Notice of this Resolution shall be published on the 28th day of May and the 4th day of June, 1971, in the South Bend Tribune and the Tri County News. This Board, at its office, on the 7th day of June, 1971, at 9:30 o'clock, A.M., will hear and receive remonstrances from all 5/24/71 persons interested in or affected by these proceedings. CONTRACT SIGNED NOTICE TO PROCEED IMPROVEMENT RESOLUTION NO. 3330 - ALLEYS BETWEEN HUEY AND O'BRIEN Contract awarded May 17, 1971, to McIntyre and Jones Construction Company Qfor the improvement of the alleys between Huey and O'Brien Streets, from Humboldt north to the tee and east -west from -Huey to O'Brien Street was signed by the Board, and notice given McIntyre and Jones Construction Company to proceed with the improvement of said alleys by constructing a Class C, Type I pavement. REQUEST TO BLOCK NORTHSIDE BOULEVARD 6/6/71 Upon motion made, seconded and unanimously carried, the Board approved the request of Gordon C. Wolfe, Co -Director, I.U.S.B, Student Foundation, Indiana University at South Bend, 1825 Northside Boulevard, South Band, Indiana, to block Northside Boulevard, from Ironwood Drive to Greeniawn Avenue on June 6, 1971, from 11:00 A.M. to 6:00 P.M., during a rowboat race on the St. Joseph River sponsored by the Indiana University at South Bend Student Foundation, on condition that evidence of proper insurance coverage is provided the Board. STREET LIGHT PETITION - MID -BLOCK ON BLAINE STREET Upon motion made, seconded and carried, the petition for a street light mid -block on Blaine Street, between Lincolnway West and Van Buren Street, signed by Margaret LaRous, 1203 Lincolnway West and 13 others, was referred to the Traffic Engineering Department for study and recommendation. STREET LIGHT REQUEST - MID -BLOCK ON E. WAYNE STREET Upon motion made, seconded and carried, the request of James E. DeFreeuw, 816 E. Wayne Street, for a street light mid -block of 800 E. Wayne Street was referred to the Traffic Engineering Department for study and recommendation. STREET LIGHT REQUEST - LOGAN AND WALL STREETS Upon motion made, seconded and carried, the request of William Sellmeyer, 801 Logan Street, and 17 others for a street light to be reinstalled at Logan and Wall Streets was referred to the Traffic Engineering Department for study and recommendation. CONTRACTORS BONDS APPROVED Upon motion made, seconded and carried, contractors' bonds were approved by the Board for the following: A. L. Cherry - to 4/2/72 Douglas Loomis d/b/a D & L Construction Co. - to 5/19/72 The Board recessed at 11:00 A.M. and reconvened at 11:30 A.M., with all members present. i3- = 5/24/71 INDIANA BELL TELEPHONE COMPANY CONSTRUCTION SITE - REQUEST TO CLOSE ALLEY Charles Boynton, attorney, St. Joseph Bank Building, South Bend, Indiana, John Deering and Gene Staszewski, representing the Hickey Construction Company, appeared before the Board. Mr. Boynton requested the closing of the alley west of Lots 271, 272 and 273 and the alley south of Lot 273 of the original"plat of the town, now city of South Bend, and requests permission to place footings, as shown in their plans, in the alley, an encroachment of approximately 4 feet 6 inches, ranging from 14 to 18 feet in depth. Upon motion made, seconded and carried, the Board deferred'action on the request pending an agreement with Carl Hibberd, owner of the building on Lot 274, for an indemnification to the City of South Bend against claims or damages that might result from the closing of, -.said alley. REQUEST TO SELL POPPIES - BE:NDIX AVIATION UNIT NO. 284 The request of Mrs. Ethel Supernaw, 401 Wakewa Street, South Bend, Indiana, for the Bendix Aviation Unit No. 284, 401 N. Michigan Street, South Bend, Indiana, to sell poppies on May 21, 1971, at the Bendix Corporation gates and in the downtown area, approved by the Board on May 20, 1971, is hereby made of record in these minutes. STREET LIGHT OUTAGE REPORTS Street light outage reports for the period 5/12/71 to 5/21/71 were ordered filed.
