A regular meeting of the Board of Public Works and Safety convened at
9:30 A.M. on'February 22, 1971, with all members present. The minutes
of the previous meeting were reviewed and approved.
FIRE DEPARTMENT - APPLICATIONS
The following applications for appointment to the South Bend Fire Depart-
ment were filed with the Board and referred to the Personnel Director for
further processing:

Q POLICE DEPARTMENT - RETIREMENT
The retirement of Corporal John Thompson from the South Bend Police Depart-
ment effective March 1, 1971, was accepted and approved by the Board upon
the recommendation of Chief of Police Loren M. Bussert.
POLICE DEPARTMENT - STATISTICAL REPORT
Statistical report of the Police Department for the month of January, 1971,
was reviewed and ordered filed.
APPOINTMENT OF SPECIAL POLICE OFFICER
Upon motion made, seconded and carried, the Board approved the appointment
of Milton Pittman, Sr., as a special police officer in the employ of Con-
solidated Negro Contractors, Inc., upon the recommendation of Chief of
Police Loren M. Bussert.
WEIGHTS AND MEASURES DEPARTMENT - MONTHLY REPORT
The report of the City Sealer for the month of January, 1971, was reviewed
and ordered filed.
BUILDING DEPARTMENT - SUB -STANDARDS DIVISION.
Richard B. Liszewski, Sub -Standards Director, appeared before the Board
and the following matters were taken up:
321--N-Brook€+e;d-Street. Harold Personette, 525 E. Dubai] Street, South
Bend, Indiana, appeared before the Board as requested. He stated there
had been a fire in the structure December 5, 1970, and that the house will
have to be demolished if he is unable to sell the property. Upon motion
made, seconded and carried, the matter was continued one week for the owner
to decide what he intends to do.
223 N. Johnson Street. Mr. and Mrs. Ervin Cudowski appeared before the
Board as requested. They stated they intend to repair the -,property and
will secure the building. Upon motion made, seconded and carried, the
matter was continued one week to permit the owners to secure the building.
1207 King Street. Mr. Liszewski stated he had received a letter from Chester
Rose giving permission "to do whatever he wants with the property;" and
that a title search had been made to ascertain the owner of the property.
Upon motion made, seconded and carried, the Sub -Standards Director was
authorized to seek bids for the demolition of the property at 1207 King
Street.

bids opened J r removing debris and securing property at 1613 S. Leer Street
Bids for removing debris from the interior and exterior of the property at
1603 S. Leer Street and securing the building were opened. Non collusion affi-
davits were found to be proper and the bids were as follows:
O'Neal Trucking Company $650.00
Bryant Excavating Company $290.00
Upon motion made, seconded and carried, contract for demoving the debris
from the exterior and interior of the property at 1213 S. Leer Street and
for closing the building was awarded to Bryant Excavating Company on its low
bid of $290.00. The Sub -Standards Director was requested to contact the
owner, Mrs. Lottie King, in reference thereto.

Upon motion made, seconded and carried, the request of the Sub -Standards
Director for the following persons to appear before the Board on Marck 8,
1971, to show cause, if any they have, why the following properties should not
be demolished, was granted:

St. Joseph County the
as result of unpaid taxes; that the former owner still
lives in the house; that it is in a hazardous condition; that contract for
demolition was awarded December 28, 1970, pending relocation of the occupant;
that the Sub -Standards Department has been unsuccessful in obtaining any
commitment from the St. Joseph County Commissioners. It was moved, seconded
and carried that the matter be referred to the Legal -Department for recommendation.
HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3333 - JEROME F. CLAEYS
This being the date set, hearing was held on the assessment roll in Vacation
Resolution No. 3333 for the vacation of:
The first north -south alley west of Taylor Street, running north
from South Street to the first east -west alley north of South Street.
Also, the first east -west alley north of South Street running west
from Taylor Street to 152.56 feet west of Taylor Street.
The Clerk tendered proofs of publication in the South Bend Tribune and'the
Tri County News on January 29, February 5 and February 12, 1971, which were
read and found to be proper. No remonstrators having appeared and no written
remonstrances having been received, upon motion made, seconded and carried,
the assessment roll is hereby approved as presented and the resolution in
all things ratified and confirmed, the proceedings closed and the property
vacated.
HEARING ON VACATION RESOLUTION NO. 3334 - JOHN C. PERRY
This being the date set, hearing was held on Vacation Resolution No. 3334 for
the vacation of:
The east -west alley between Dubai] Avenue and Calvert Street from
the east right of way line of Grant Street to the west right of
way line of the north -south alley between Dubai] and Calvert Street,
and from the east right of way line of the said north -south alley
to the west right of way line of Brookfield Street, situated In

and the Tri County News on February 12 and February 19, 1971, which were
found to be proper. No remonstrators appeared and no written remonstrances
were received. Upon motion made, seconded and unanimously carried, the
Resolution was ratified and confirmed. And the City Engineer was directed
to prepare an assessment roll covering the assessment of benefits and the
award of damages to surrounding property owners.

This being the date set, heating was held on Vacation Resolution No. 3335,

from Michigan Street east 165 feet to the first -north -south
alley. The alley to be vacated is between Lots 126 and 127 in
the original plat of South Bend.

Ajax Arvin appeared on behalf of the petitioners Marie J. Pfeil and Charles
D. Hills. No other persons appeared for or against the vacation. No
remonstrators having appeared and no written remonstrances having been re-
ceived, upon motion made, seconded and unanimously carried, the resolution
adopted February 8, 1971, was ratified and confirmed. And the City Engineer
was directed to prepare an assessment roll covering the assessment of
benefits and the award of damages to surrounding property owners.
REQUEST TO ATTEND FUNERAL OF STATE TROOPER JOHN STREU
Upon motion made, seconded and unanimously carried, the Board approved the
request of Assistant Chief Kenneth McDonald to send an honor guard to
Logansport, Indiana, to attend the funeral of State Trooper John Streu
February 23, 1971, who was killed in the line of duty, and to use a Police
Department vehicle for transportation.
AREA PLAN COMMISSION RECOMMENDATION AND
ADOPTION OF VACATION RESOLUTION NO. 3336, 1971 - NATHAN LERMAN
Area Plan Commission files with the Board its recommendation that Jennings
Avenue and the alley north and parallel to Jennings Avenue be vacated, but
that Tasher Avenue remain a publicly dedicated thoroughfare until other
means of access is provided for Lot No. 5 in Crestview Second Addition.
Upon motion made, seconded and unanimously carried, the following resolution
was adopted:
"VACATION RESOLUTION NO. 3336, 1971
"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF
THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the
following:
The east -west alley between Tasher Avenue and Jennings
Avenue from the east line of Lot 19 to the west line of
Lot 27 in Crestview First Addition.
Also, Jennings Avenue from the east line of Lot 19 to the
west line of Lot 27 in Crestview First Addition.
Reserving the rights and easement-s of all utilities and
the municipal city of South Bend, Indiana, to construct and main-
tain any facilities, including, but not limited to, the following:
electric, telephone, gas, water, sewer, surface water control
structures and ditches, within the,vacated right of way, unless
such rights are released by the individual utilities.

ficially affected by such vacation:

REQUEST TO VACATE COLUMBIA COURT TO VEHICULAR TRAFFIC
The Department of Redevelopment having proposed�iwionn the next three
years Columbia Court, between Colfax Avenue andxNalm wireet, from Michigan
Street to Main Street, will be made a part of the Michigan Street pedestrian
mall and since said Columbia Court, in its present condition, is not
adequate for either pedestrian or vehicular traffic, the Engineering Depart-
ment submits to the Board a request that said Columbia Court be vacated
to vehicular traffic so that a pedestrian walkway may be constructed.
Upon motion made, seconded and unanimously carried, the request was referred
to the Legal Department for study and recommendation.
PETITION TO VACATE PORTIONS OF ST. JOSEPH STREET WESTERN AVENUE; CARROLL
STREET, WAYNE AND SPENCER STREETS AND THREE ALLEYS 7NORTH OF POST OFFICE SITE)
The Department of Redevelopment, 1200 County City Building, South Bend,
Indiana, files with the Board its petition to vacate:
St. Joseph Street, from east Western Avenue to East Wayne Street;
E. Western Avenue, from St. Joseph Street to Columbia Street;
Carroll Street, from,E. Western Avenue to Lincolnway East;
E. Wayne Street, from St. Joseph Street to Carroll Street;

COMMUNICATION FROM LOCAL UNION NO. 364
A letter dated February 15, 1971,from the Chauffeurs, Teamsters and Helpers
Union No. 364, Roland A. Wardlow, President, 2405 E. Edison Road, South Bend,
Indiana, giving notice that it desires to"negotiate certain changes and
modifications" in fts agreement concerning the Sanitation, Street, Municipal
Services, Traffic and Cemetery Departments, was filed with the Board and,
upon motion made, seconded and carried, referred to the Legal Department and
the Personnel Director for appropriate action.
REQUEST TO CONDUCT "TAG DAY" SALES 3/6/71
Upon motion made, seconded and carried, the Board approved the request of
Thomas L. Parnell, District Director, Muscular Dystrophy Association, 119 W.
Mishawaka Avenue, Mishawaka, Indiana, to conduct "tag day" sales of shamrocks
in the downtown area on March 6, 1971.
STREET LIGHT PETITION - KENTON D. MOON - WHITEHALL DRIVE
A petition for a street light on -Whitehall Drive was filed with the Board
