A regular meeting of the Board of Public Works and Safety convened at 9:33
A.M., on January 25, 1971, with all members present. The minutes of the
previous meeting were reviewed and approved.
FIRE DEPARTMENT - APPLICATIONS
The following applications for appointment to the South Bend Fire Department
were filed with the Board and referred to the Personnel Director for further
processing:

POLICE DEPARTMENT - APPLICATION
The application of Ronald Lee Jackson for appointment to the South Bend Police
Department was filed with the Board and referred to the Personnel Director
for further processing.
POLICE DEPARTMENT - PROMOTION
Upon the recommendation of Chief of Police Loren M. Bussert, the motion was
made, seconded and carried to promote Corporal Joseph Radecki'to the rank of
sergeant effective January 25, 1971.
POLICE DEPARTMENT - REQUEST TO ATTEND MEETING, DETROIT, MICHIGAN
Upon motion made, seconded and unanimously carried, the Board approved the
request of Chief of Police Loren M. Bussert for Division Chief Glenn Terry,
Captain Gerald Knepper and Sergeant Norman Collmer to attend a teleprocessing
course in Detroit, Michigan, January 25-27, 1971, and approved the use of
mechanical unit #5 for the trip.
WEIGHTS AND MEASURES DEPARTMENT - REQUEST TO ATTEND TECHNICAL SCHOOL
Upon motion made, seconded and unanimously carried, the Board approved the
request_ of Bert S. Cichowicz, City Sealer, to attend the Weights and Measures
Technical School in Indianapolis, Indiana January 27-29, 1971,
BUILDING DEPARTMENT - SUB -STANDARDS DIVISION
Richard Liszewski, Sub -Standards Director, appeared before the Board and the
following matters were taken up:
1613 S. Leer Street. The Sub -Standards Director reported the house at 1613
S. Leer Street, owned by Mrs. Lottie King, unoccupied and open, and that junk
still remains in the yard. Upon motion made, seconded and carried, the matter
was further continued two weeks, and the Sub -Standards Director was requested
to write the owner that unless the debris is removed and the premises closed
by February 8, 1971, the Board will order the property demolished.
2116 W. Western. The Sub -Standards Director reported the owner has secured
the building at 2116 W. Western Avenue. Thereupon, the Clerk of the Board
was directed to deliver to the Midwest Demolition Company the $25.00 deposited
for the benefit of the low bidder August 31, 1970, in the event the demolition
contract was not awarded. The Sub -Standards Director was requested to have
the demolition contract voided, and, upon motion made, seconded and carried,
the matter of 2116 W. Western Avenue was continued indefinitely, to be kept
under surveillance of the Sub -Standards Department.
Jerry Davis, demolition contractor, who appeared before the Board and stated
that his bond has been cancelled and he is unable to obtain a bond, was ad-
vised by the Board that when the sidewalk at 715 S. Michigan Street, which
was damaged as the result of demolition of the premises at this address,
has been repaired and paid for, the City will so advise his insurance company.

Upon_ motion made, seconded and unanimously carried, contract was awarded
for 2 cu. yd. dump bodies with hydraulic systems for the Street Department
(Item #8 of bids for miscellaneous equipment 12/21/70) to Stanley Enter-
prises, Inc., on its bid of $1,199.00 each.

HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3331 - DEPARTMENT OF
REDEVELOPMENT
This being the date set, hearing was held onthe assessment roll in Vacation
Resolution No. 3331, for the vacation of:
1/25/71
Portions of streets and alleys, all within the recorded plat of
Raff's First Addition, Raff's Second Addition and Lewis First Addition,
Subdivisions in the northeast Quarter of Section 14, Township 37
north, Range 2 east, as follows:
(1) Leon Court, an east -west street from the east line of Kemble
Avenue to the west line of Kendall Street (38,096 sq. ft.);
(2) Catalpa Avenue, a north -south street, from the south line of
Cotter Street to the north line of Leon Court (9;960 sq. ft.);
(3) Catalpa Avenue, a north -south street, from the south line of
Leon Court south 225 feet (9,000 sq. ft.);
(4) Chapin Street, a north -south street, from the south line of
Cotter Street to the north line of Leon Court (9,960 sq. ft.);
(5) Chapin Street, a north -south street, from the south line of
Leon Court south 225 feet (9,000 sq. ft.);
(6) The north -south alley,,between Prairie Avenue and Catalpa

The Clerk tendered proofs of publication in the South Bend liribune and the
Tri County News on January 1, January 8 and January 15, 1971, which were
read and found to be sufficient. No remonstrators having appeared and no
written remonstrances having been received, upon motion made, seconded and
unanimously carried, the assessment roll was approved as presented and the
vacation resolution in all things ratified and confirmed and the proceedings
closed and the property declared vacated.
ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3333 - JEROME F. CLAUS
Lloyd S. Taylor, City Engineer, files assessment roll showing award of
damages and assessrpent of benefits in Vacation Resolution No. 3333, for the
vacation of;
The first north -south alley west of Taylor Street running north
from South Street to the first east -west alley north of South
Street. Also, the first east -west alley north of South Street
running west from Taylor Street to 152.56 feet west of Taylor
Street.
Reserving the rights and easements of all utilities and the Municipal City
of South Bend, Indiana, to construct and maintain any facilities, including,
but not limited to, the following: electric, telephone, gas, water, sewer,
surface water control structures and ditches, within the vacated right of
way unless such rights are released by the individual utilities.
The following property may be injuriously or beneficially affected by such
vacation:
Lots 1, 2, 3 and 4 of Touhey and Hagerty's Subdivision of Bank
Out Lot 59 and the remainder of the area bounded by South Street
on the south, Scott Street on the west, Western Avenue on the
north and Taylor Street on the east.

SEPH COUNTY COMMISSIONERS TO VACATE

It was moved, seconded and carried thatthe Board of Public Works and Safety
petition the Board of Commissioners of St. Joseph County, Indiana, for
vacation of the streets and alleys within Lagoon "A" storm water retention
basin.
LEASE EXTENDED ON 1970 OLDSMOBILE
Upon motion made, seconded and carried, the extension of the existing lease
with Feferman Motor Sales for 1970 Oldsmobile 98 Luxury Sedan, Identification
No. 386690M249761, for a further period of.12 months, upon the same terms
and conditions was approved by the Board.
EXCAVATION BOND CANCELLED
It was moved, seconded and carried that the excavation bond of Raymond
Guzman, d/b/a ABC Plumbing, Inc., No. 109665, be cancelled and that the
Auto -Owners Mutual Insurance Company be released for any work done there-
under from and after January 25, 1971.
CONTINUATION CERTIFICATES APPROVED
Upon motion made, seconded and carried, certificate continuing excavation
bond on behalf of Wallace Mitchell to l/l/72 was approved.
MEETING CANCELLED 2/1/71
MEETING SET OVER FROM 2/15/71 TO 2/16/71
It was moved, seconded and unanimously carried that the regularly scheduled
meeting for February 1, 1971, be cancelled.
It was further moved, seconded and unanimously carried that the meeting
which would regularly be scheduled on Monday, February 15, 1971, be set over
to Tuesday, February 16, 1971, at 9:30 A.M., since February 15, 1971, is
a legal holiday.
STREET LIGHT OUTAGE REPORTS
Street light outage reports for the period 1/12/71 to 1/20/71 were ordered
filed.
There being no further business to come before the Board, the meeting.ad-
journed at 11:05 A.M.
