January 11, 1971.
A regular meeting of the Board of Public Works and Safety convened at 9:30
A.M., with all members present. Minutes of previous meetings were reviewed
and approved.
BIDS OPENED - SLURRY SEAL MACHLNES
This -being the date set for receiving bids for slurry seal machines, the
Clerk tendered proofs of publication of notice in the South Bend Tribune
and the Tri County News on January 1 and January 8, 1971, which were read
and found to be sufficient. The following bids were received:
Deeds Equipment Company, Inc., P. O. Box 261.14, Lawrence, Indiana, 46226.
Non collusion affidavit was found to be proper. The bid was accompanied
by a bid bond in the amount of $3,000.00. The bid was as follows:
2 - Hi -Way Slurry Masters, Model SM-10 Resurfacing
Machines, installed on existing Street Department
cabs and chassis. F.o.b. factory less trade-in of
two 1964 Young SB series Slurry Machines. Delivery

Upon motion made, seconded and unanimously carried, the bids were referred
to the Engineering Department for study and recommendation to the Board.
BIDS OPENED - GILMER PARK TRUNK SEWER, DIVISION "A"
This being the date set for receiving bids for the construction of the Gilmer
Park trunk sewer, Division "A." the Clerk tendered proofs of publication of
notice in the South Bend Tribune and the Tri County News on December 19 and
December 26, 1970, which were read and found to be sufficient. The follow-
ing bids were received:
Bartolini Excavating Co., 16242 Day Road, Mishawaka, Indiana. Non
collusion affidavit was found to be proper. The bid was accompanied
by a bid bond in the amount of 5% of the bid, together with bidder's
financial statement (Form 96-a). Total bid - $98,824.92. Completion
time 150 calendar.days.
Bradberry Brothers, Inc., 20061 Dice Street, South Bend, Indiana, 46614.
Non collusion affidavit was found to be proper. The bid was accompanied
by a bid bond 'in the amount of 5% of the bid, together with bidder's
financial statement (Form 96-a). Total bid - $118,588.00. Completion
time 150 calendar days.
H. DeWulf Mechanical Contractor, Inc., 58600 Executive Drive, Mishawaka,
Indiana. Non collusion affidsvit was found to be proper. The bid was
accompanied by a bid bond in the amount of 5% of the bid, together with
bidder's financial statement (Form 96-a). Total bid - $75,443.50..

46514. Non collusion affidavit was found to be proper. The bid was
accompanied by a bid bond in the amount of 5% of the bid, together
with a financial statement of bidder (Form 96-a). Total bid - $109,239.00.
Completion time 120 calendar days.
Murphy Construction Co., 2906 Homer Avenue, Elkhart, Indiana. Non
collusion affidavit was found to be proper. The bid was accompanied
by a bank money order in the amount of $4,500.00 and statement that
bidder's financial statement (Form 96-a) is on file. Total bid
$88,585.50. Completion time 90 calendar days.

Non collusion affidavit was found to be proper. The bid was accompanied
by a bid bond in the amount of 5% of the bid, together with financial
statement of bidder (Form 96-a). Total bid - $96,949.00. Completion
time 150 calendar days.

Non collusion affidavit was found to be proper. The bid wad' accompanied
by a•certified check #10370 in the amount of $4,200.00 and a bank treasurer's
check in the amount of $350.00, together with a financial statement of
bidder (Form 96-a). Total bid - $90,996.25. Completion time 120
calendar days.
Woodruff & Sons. Inc.,, 2125 E. U. S. #12, P. 0. Box 315, Michigan City,
Indiana, 46360. Non collusion affidavit was found to be proper. The
bid was accompanied by a bid bond in the amount of 5% of the bid, together
with financial statement of bidder (Form 96-a). Total bid - $98,554.00.
Completion time 120 calendar days.

the Engineering Department for study and recommendation.
FIRE DEPARTMENT - APPLICATION
The application of Thomas Eugene Bolinger for appointment to the South Bend
Fire Department was filed with the Board and referred to the Personnel Director
for further processing.
POLICE DEPARTMENT - APPLICATIONS
The following applications for appointment to the South Bend Police Department
were filed with the Board and referred to the Personnel Director for further
processing;

POLICE DEPARTMENT - PROMOTIONS
Upon motion made, seconded and unanimously carried,•the Board approved the
recommendation of Chief of Police Loren M. Bussert for the promotion of the
following officers to the rank of lieutenant, retroactive to the date of.
January 1, 1971:

BUILDING DEPARTMENT - SUB -STANDARDS DIVISION
Forrest West Building Commissioner, appeared before the Board and the
following matters were taken up:
1207 King Street. Mr. West reported the Sub -Standards Department as yet
has been unable to contact the owner; that he has an unlisted telephone
number and is employed at Bendix and hard to reach. Upon motion made,
seconded and carried, the matter was continued four weeks.
122 S. Laurel Street. Mr. West reported this property still occupied d
that an effort is being made to relocate the tenants. Upon Motion mae,,
seconded and unanimously carried, the matter pertaining to 122 S. Laurel
Street was continued four weeks.
2116 Western Avenue.,Attorney George Stratigos did not,appear on behalf
of the owner as requested. It was moved, seconded and carried, that
since the representative of the owner has failed to appear as requested
at the past two Board meetings that,the Board award contract on January 18,
1971 (if no appearance is made) for demolition of the structure at 2116
00 Western Avenue to the low bidder.on August 31, 1970, and that the $25.00
depositbe forfeited. _
WEIGHTS & MEASURES DEPARTMENT - REPORT FOR DECEMBER, 1970
The report of the Weights and Measures Department for December, 1970,
was reviewed and ordered filed.
1002 CULVER PLACE - LETTER FROM CHARLES M. MATERNOWSKI
A letter from Charles M. Maternowski, 726 S. Beale Street, South Bend,
Indiana in reference to the demolition of the structure at 1002 Culver
Place and his contemplated purchase was read and ordered filed.
PLANS AND SPECIFICATIONS APPROVED - GILMER PARK SEWER, DIVISIONS "B" AND "C"
Upon motion made, seconded and unanimously carried, plans and specifications
were approved by the Board for the Gilmer Park Sewer, Divisions "B" and
"C," as recommended by the Engineering Department.
PETITION FILED TO VACATE STREETS AND ALLEYS WITHIN THE NEW POST OFFICE
SITE - DEPARTMENT OF REDEVELOPMENT
The Department of Redevelopment files with the Board its petition to vacate
streets and alleys within the new Post Office site at Michigan and Monroe
Streets, more particularly described as follows:
A part of the west Half of Section 12, Township 37 north,
Range 2 east, city of South Bend, St. Joseph County, Indiana,
described as follows:
Beginning at the intersection of the east boundary of South
Michigan Street (U. S. #31) and the north boundary of East
Monroe Street; thence north 0 degrees 29 minutes 07 seconds
west 42.33 feet along said east boundary; thence northeasterly
381.53 feet along an arc to the right and having a radius
of 624.57 feet and subtended by a long chord having a bearing
of north 17 degrees 00 minutes 53 seconds east and a length
of 375.62 feet; thence north 34 degrees 30 minutes 53 seconds
east 9.47 feet to the south boundary of East Western Avenue;

Upon motion made, seconded and unanimously carried, the petition was referred
to the Engineering Department for the location of utilities and then to be
referred to the Area Plan Commission.for study and recommendation.
REMONSTRANCE FILED - VACATION RESOLUTION NO. 3333 1970 - CLAEYS
A letter of remonstrance to the vacation of two alleys in Vacation Resolution
No. 3333, 1970, from Grand Trunk Western Railroad Company, 131 W. Lafayette
Boulevard, Detroit, Michigan, was ordered filed.

Upon motion made, seconded and carried, the offer of Feferman Motor Sales

Identification No. 386690M24976i, for one year at the -same rental of
$165.00 per month, was referred to the Engineering Department for study
and recommendation.
INDEMNITY AGREEMENT FOR FLAG POLES - AMERICAN NATIONAL BANK & TRUST CO.
Upon motion made, seconded and carried an indemnity agreement provided
by the American National Bank and Trust Company to hold the City of
South Bend harmless in connection with the installation of two flag poles
on Main Street in front of the American National Bank and Trust Company
was referred to the Legal Department for recommendation.
COMPLAINT OF GRADY L. THOMPSON
Upon motion made, seconded and carried, the complaint of Grady L. Thompson,
1134 Harvey Street, South Bend, Indiana, concerning alleged treatment
received as a taxicab driver at the Airport was referred to the Board of
Aviation Commissioners of St. Joseph County and to the Human Relations
and Fair Employment, County City Building, South Bend, Indiana.

A letter from Mrs. Lee Swan, 2022 S. Swygart Avenue, South Bend, Indiana,
complaining of careless garbage collection was read and ordered filed.

Upon motion made, seconded and carried, the termination of contractor's

Company, Inc., was approved for any work done on and after January 11, 1971.
