December 28, 1970
A regular meeting of the Board of Public Works and Safety convened at 9:30
A.M., on December 28, 1970. Lloyd S. Taylor and S. J. Crumpacker were
present.
BIDS OPENED - SANITARY SEWER, AIRPORT INDUSTRIAL PARK, PHASE III
This being the date set, bids were opened for construction of a sanitary
sewer in the Airport Industrial Park, Phase III. The Clerk tendered proofs
of publication of notice in the South Bend Tribune and the Tri County News
on December 4 and December 11, 1970, which were read and found to be proper.
The following bids were received for the furnishing of all material for
construction of 877 lineal feet of 24" clay sewer, 198 lineal feet of 8"
clay sewer, 3 manholes and miscellaneous appurtenant work items:
H. DeWulf Mechanical Contractor, Inc., 58600 Executive Drive, Mishawaka,
Indiana. Nbn collusion affidavit was found to be proper. Bid bond in
the amount of 5% of the bid and financial statement of bidder accompanied
the bid.
Total bid---------------------------------$22,183.60
Haskins, Inc., Lakeville, Indiana. Non collusion affidavit was found to
be proper. The bid was accompanied by a bid bond in the amount of 5%
of the bid and financial statement of bidder.
Total bid---------------------------------$20,798.00
Woodruff & Sons, Inc., P. 0. Box 315, Michigan City, Indiana. Non
collusion affidavit was found to be proper. The bid was accompanied
by a bidder's financial statement. No bid bond was included.
Total bid ---------------------------------- $24,896.00
Upon motion made, seconded and carried, the bids were referred to the
Engineering Department for review and recommendation.
CONTRACT AWARDED FOR PUMPING FIRE ENGINE
Upon motion made, seconded and carried, the Board approved the recommendation
of Fire Chief Joseph L. Zurat for the award of contract for a 1500 gallon
Ward LaFrance pumping fire engine to Midwest Fire and Safety Equipment Company
at a net price of $42,880.00, and certain optional equipment as recommended
by the Fire Chief.
POLICE DEPARTMENT - PROMOTIONS
Upon motion made, seconded and carried, the following police officers were
promoted to the rank of sergeant effective January 1, 1971:

BUILDING DEPARTMENT - SUB -STANDARDS DIVISION
Forrest West, Building Commissioner, appeared before the Board and the follow-
ing matters were taken up.
1618 and 1620 W. Dunham Street. Clem Wrzesien appeared before the Board and
stated that he intends to repair these two buildings. Upon motion made,
seconded and carried, the matter of 1618 and 1620 W. Dunham Street was con-
tinued indefinitely on condition that the owner keep the premises closed and
the yards free of debris and junk.
1207 King Street. Mr. West reported this property open as of December 23,
1970. Upon motion made, seconded and carried, the matter of 1207 King Street
was continued one week, and the Sub -Standards Department was requested to con-
tact the owner to find out his intentions.

2116 Western Avenue. Upon motion made seconded and carried, the matter
pertaining to 2116 Western Avenue was continued one week for the Sub -
Standards Department to contact the representative of the owner.
2018 S. Michioan Street. Upon motion made, seconded and carried, the
matter'of 2018 S. Michigan Street was continued one week for the Sub -
Standards Department to contact the representative of the owner to ascer-
tain their.intentions.
122 S. Laurel Street. Upon motion made, seconded and carried, the matter
of 122 S. Laurel Street was continued one week for the Sub -Standards De-
partment to make further investigation.
1312 S. St. Joseph Street. Upon motion made, seconded and carried, the
matter of 1312 S. St. Joseph Street was continued indefinitely, and the
Sub -Standards Department was requested to keep the property under sur-
veillance.
1631 S. Franklin Street. Upon motion made, seconded and carried, the matter
of 1631 S. Franklin Street was continued two weeks, and the Sub -Standards
�r Department was directed to r3quest the owner to close up the open windows.

Demolition bids opened:
This being the date set, bids were opened for demolition of the following
G" structures. Non collusion affidavits were found to be proper. The bids
were as follows:
1039 LaSalle Court:

O'Neal Trucking Co. $629.00
Upon motion made, seconded and carried, contract for demolition of the
structure at 1039 LaSalle Court was awarded to Midwest Excavating Company
on its low bid of $403.00.
1011 S. Rush Street:

B & J Demolition Co. $400.00
Midwest Demolition Corp. $315.00
O'Neal Trucking Co. $549.00
Upon motion made, seconded and carried, contract for demolition of the
structure at 1011 S. Rush Street was awarded to Midwest Demolition Company
on its low bid of $315.00.

O'Neal Trucking Co. $570.00
B & J Demolition Co. $465.00
Upon motion made, seconded and carried, contract for demolition of the
structure at 325 S. Taylor Street was awarded to Midwest Demolition
Corporation 6n its low bid of $399.00.
CONTRACT AWARDED - JANITORIAL SERVICES FOR 1971, MUNICIPAL SERVICES FACILITY
Upon motion made, seconded and carried, contract for janitorial services for
1971 at Municipal Services Facility was awarded to ABC Janitor Service on
its low bid of $19,200.-00 annually.
DISPLAY OF MODEL HOME AT MICHIGAN AND CHIPPEWA - EXTENDED
Richard Hummer of Heckaman Industries, R. R. #1, P. 0. Box 60A, Nappanee,
Indiana, appeared before the Board in connection with his display of a
model home at the corner of Michigan and Chippewa , and was granted 60
additional days in which to display the house.

ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3331, 1970 - DEPARTMENT
OF REDEVELOPMENT
Lloyd S. Taylor, City Engineer, files assessment roll showing award of damages
and assessment of benefits in Vacation Resolution No. 3331, 1970, for the
vacation of:
Portions of streets and alleys, all within the recorded
plat of Raff's First Addition, Raff's Second Addition and
Lewis' First Addition Subdivisions in the northeast Quarter
of Section 14, Township 37 north, Range 2 east, as follows:
(1) Leon Court, an east -west street from the east line of
Kemble Avenue to the west line of Kendall Street
(38,096 sq. ft.);
(2) Catalpa Avenue, a north -south street, from the south
line of Cotter Street to the north line of Leon Court
(9,960 sq. ft.);
(3) Catalpa Avenue, a north -south street, from the south
line of Leon Court south 225 feet (9,000 sq. ft.);
(4) Chapin Street, a north -south street, from the south
line of Cotter Street to the north line of Leon Court
(9,960 sq. ft.);

Municipal City of South Bend, Indiana, to construct and maintain
any facilities, including but not limited to electric, telephone,
gas, water, sewer, surface water control structures and ditches
within the vacated right of way unless such rights are released
by the individual utilities.
The following property may be injuriously or beneficially affected
by such vacation:
The area bounded on the east by Kemble Avenue and Prairie
Avenue, on the south by Cotter Street, on the west by Kendall
Avenue and on the north by Penn Central and New Jersey,
Indiana and Illinois Railroad Company.

And the Board sets January 25, 1971, at 9:30 A.M. as the time for hearing
and receiving remonstrances from all persons interested in or affected by
such vacation. And the Clerk is directed to give notice of such hearing
by publication in the South Bend Tribune and the Tri County News on January 1,
January 8 and January 15, 1971.

REQUEST TO PARK TRAILER DENIED - JOSEPH S. SCHREINER, LOCAL #875
Upon motion made, seconded and carried, the request of Joseph S. Schreiner,
President of Local #875, Brotherhood of Painters, Decorators and Paperhangers,
53120 N. Twyckenham Drive, South Bend, Indiana, to park a trailer on the
north side of W. Washington Street, in the 1900 block, between the curb
and the sidewalk, to be used as an office and first aid station, during
a strike in process at a nearby business, was denied.
CULVERT ON IRONWOOD NEAR RIDGEDALE
Upon motion made, seconded and carried, the Board approved two changes in
the original plans for the construction of the culvert on Ironwood Drive
near Ridgedale and the additional cost of $238.00, and accepted the report
of the Engineering Department that the project has been satisfactorily
completed.
PLANS AND SPECIFICATIONS APPROVED - GILMER PARK SEWER, DIVISION A
Upon motion made, seconded and carried, plans and specifications for the
Gilmer Park Sewer, Division A, were approved, as recommended by the

Engineering Departrent.
PANEL ADS, INC. - LIABILITY INSURANCE
Notice of cancellation of liability insurance, effective 12/29/70, for
Panel Ads, Inc., having been received from the Hanover Insurance Company,
the Board orders that evidence of proper insurance coverage be provided
immediately by Panel Ads, Inc.
RESOLUTION NO. 12-28-70 ADOPTED - GILMER PARK SEWER, DIVISIONS A, B & C
Upon motion made, seconded and carried, the following Resolution was
adopted:
"RESOLUTION N0. 12-28-70
WHEREAS, the Board of Public Works and Safety has found
it in the best interest of the public health and welfare to
construct a sanitary trunk sewer from Ireland Road and Penn
Central right -of way to Jackson Road and Scott Street, south on
Scott Street to Jewell Avenue, west on Jewell to Ruby Street,
south on Ruby to Ritter Avenue extended, east on Ritter Avenue
extended to Main Street, and east along a natural ditch line
to Fellows Street and Johnson Road; and
WHEREAS, The cost of said sewer was paid for out of
funds known as "cumulative sewer building and sinking fund"
and not assessed against the property owners; and
WHEREAS, The construction of said sewer is a benefit
to the abutting properties; and
WHEREAS, The policy of the Board of Public Works and
Safety is to charge the benefited property at a rate of 7� per
square foot up to 150 feet in depth from the property line;
NOW THEREFORE BE IT RESOLVED That the fee for connection
to the above described sewer be at the rate of 7� per square
foot up to a depth of 150 feet from the property line closest
to the sewer.

Upon motion made, seconded and carried, the Board recessed at 10:30
A.M. and reconvened at 2:30 P.M., with Lloyd S. Taylor and S. J. Crumpacker
present.
REQUEST TO ADVERTISE FOR BIDS FOR TWO-WAY RADIOS
Upon motion made, seconded and carried, the Board approved the request to
advertise for two way radios for the various departments, and set January 18,
1971 as the date for receiving bids. And the Clerk was directed to give notice

by publication in the South Bend Tribune and the Tri County News on January 1,
1971 and January 8, 1971.
TRAFFIC REGULATIONS APPROVED
Upon motion made, seconded and carried, the Board approved the recommendation
of the Traffic Engineering Department to make Falcon Street, between Sample
and Linden Streets a snow route and that the snow route on Lake Street be
removed but that it be given priority for snow plowing between Western and
Ford Streets because of Harrison School.
Catalpa and Chapin Streets. Upon motion made, seconded and carried, the Board
approved the recommendation of the Traffic Engineering Department to prohibit
parking on both sides of Catalpa and Chapin Streets for a distance of 50 feet
south of the railroad right of way.
Stop sign on Altgeld at Ironwood Drive. U Pon motion made, seconded and carried,
the Board approved the recommendation of the Traffic Engineering Department
for the installation of a stop sign on Altgeld Street at Ironwood Drive.
PARKING METER REPLACEMENT - 126 Lincolnwav East
Upon motion made, seconded and carried, the Board approved the recommendation
of the Traffic Engineering Department for the replacement of parking meters
#14 and #16 at 126 Lincolnway East, removed during construction of Municipal
Parking Garage #2.
PETITION FOR STREET LIGHTS - COLUMBIA STREET AND DUBAIL STREET
Upon motion made, seconded and carried, the petition of LOcflle P. Wingard,
317 E. Indiana Avenue, South Bend, Indiana, and 24 others, for street light
in the 1500 block of Columbia Street at the alley between Indiana Avenue and
Haney Street and for the relocation of the street light on the northwest corner
of Columbia Street and Dubai] to the southeast corner, was referred to the
Traffic Engineering Department for study and recommendation to the Board.
CERTIFICATES OF LIABILITY INSURANCE FILED
Certificate of public liability insurance on behalf of Decatur Salvage, Inc.,
Thomas Edward, Larry and Zenta Imel to 10/1/71 was ordered filed.
Certificate of public liability insurance on behalf of the South Bend -
Mishawaka Area Chamber of Commerce, Inc., to 12/17/71 was ordered filed.
Certificate of public liability insurance on behalf of Eugene;Hoath to 1/l/72
was ordered filed.
CONTRACTOR'S BOND CANCELLED - LARRY K. MARTSOLF
Upon motion made, seconded and carried, Contractor's Bond #4257935 on behalf
of Larry K. Martsolf was terminated and 'cancelled for any work done by Larry
K. Martsolf on and after December 28, 1970.

Upon motion made, seconded and carried certificates continuing the following
