A.M., with all members present.
RETIREMENT FROM FIRE DEPARTMENT
Public Works and Safety convened at 9:30
Upon motion made, seconded and unanimously carried, the Board accepted and
approved the retirement of Joseph T. Jelinski from the South Bend Fire
Department effective`October 24, 1970.
APPLICATION FOR APPOINTMENT - FIRE DEPARTMENT
The application of David Jay Bailey for appointment to the South Bend -Fire
Department was filed with the Board and referred to the Personnel Director
for further processing.
APPLICATIONS FOR APPOINTMENT TO POLICE DEPARTMENT
The applications of Stephen Lamar Adams and Charles Edwin Weikel, III, were
filed with the Board and referred to the Personnel Director for further
processing.
APPLICATION FOR APPOINTMENT AS SPECIAL POLICE OFFICER
Upon motion made, seconded and unanimously carried, and upon the
recommendation of Police Chief Loren M. Bussert, the Board approved the
appointment of Daniel Charles Dutrieux as a;.special police officer for the
St. Joseph Hospital.
RETIREMENT FROM POLICE DEPARTMENT
Upon motion made, seconded and unanimously carried, the Board accepted and
approved the retirement of Leo Kwasneski from the South Bend Police Depart-
ment effective October 31, 1970.
BUILDING DEPARTMENT - SUB -STANDARDS DIVISION
J. W. Adamson, Sub -Standards Director, appeared before the Board and the
following matters were taken up:
2712 S. Main Street. Mr. Adamson reported'he has heard nothing from the owner
regarding demolition of the structure at 2712 S. Main Street. Upon motion
made, seconded and carried, the matter was continued one week.
618 E. Washington Street. Mr. Adamson reported the building closed. Upon
motion made, seconded and carried, the matter of 618 E. Washington Street
was continued indefinitely and the Sub -Standards Director was requested to
keep the property under surveillance.
122 N. St. Louis Street. Mr. Adamson reported the owner has been unable to
obtain demolitionrbids and wishes the City to demolish the structure. Upon
motion made, seconded and unanimously carried, the Sub -Standards Director
was authorized to seek bids for the demolition of the structure at 122 N.
St. Louis Street.
722 E. Miner Street. Mr. Adamson reported a certified letter addressed to
one of the heirs to this property has been returned "unclaimed", and that he
now has contacted all of the owners to his knowledge; that the building is
open and has been vandalized. Upon motion made, seconded and unanimously
carried, the Sub -Standards Director was authorized to seek bids for demolition
of the structure at 722 E.Miner Street.
1210 South Bend Avenue. Upon motion made, seconded and unanimously carried,
the matter of 1210 South Bend Avenue was continued two weeks for the Sub -
Standards Director to contact the new owners.
2116 Western Avenue. Vpon motion made, seconded and unanimously carried, the
matter of 2116 Western Avenue was continued two weeks at the request of Mr.
Adamson.

401 E. Dubai] Street. Mr. Adamson reported the owner has failed to have the
structure at 401 E. Dubail Street demolished. Upon motion made, seconded and
unanimously carried, contract for demolition of the structure at 401 E.
Dubai] Street was awarded to B & J Demolition Company on its low bid of
$495.00 October 5, 1970.
It was further moved, seconded and carried that the $25.00 deposit made by
Jackie Carpenter on October 2, 1970, be applied to the cost of demolition
and referred to the City Controller's office for credit to the demolition fund.
'13Z E. Elder Street. Upon motion made, seconded and unanimously carried,
the matter of 132 E. Elder Street,was continued one week, and the Sub- .
Standards Director was requested to notify Mrs. Fisher, daughter of theca
owners, to appear before the Board November 2, 1970.
1,137"S "Lafa*dttepBoulevard. Upon motion made, seconded and unanimously carried,
the matter of 1137 S. Lafayette Boulevard was continued one week.

This being the date set, bids were opened for demolition of the following
structures. Non collusion affidavits were examined and found to be proper.

Upon motion made, seconded and unanimously carried, the Board approved the
request of the Sub -Standards Director for the following persons to appear
before the Board on November 9, 1970, to show cause, if any they have, why
the structures at the following addresses should not be demolished.

MUNICIPAL PARKING GARAGES - REQUEST TO REMAIN OPEN ON SUNDAYS (NOV DEC.)
Upon motion made, seconded and unanimously carried, the Board approved
the request of James McNeile, Manager, for the Municipal Parking Garages
at Jefferson and St. Joseph Streets and at Main and Colfax Avenue to remain
open on Sundays from 12:00 noon until 6:00 P.M. from November 8, 1970
through December 20, 1970, during which time the downtown stores will remain
open.
SEWER CONSTRUCTION AGREEMENT - CLYDE E. WILLIAMS & ASSOCIATES INC.
Upon motion made, seconded and carried, the Board approved and executed a
contract by the City of South Bend, Indiana, acting through its Board of
Public Works and Safety, with Clyde E. Williams & Associates, Inc., Engineers,
for the construction of an extension of the 24" sanitary sewer currently
terminated at Maple Road, to the property of City Pattern and Foundry
Company on the north side of Douglas Road, in the Airport Industrial Park
(Phase I11), subject to the availability of appropriate funds.
PROTEST AGAINST REMOVING BOULEVARD LIGHTS - NAVARRE STREET AREA
Mrs. Leonard Pajula, 325 W. Navarre Street, South Bend, Indiana, appeared
before the Board and filed a protest signed by 84 persons against the removal
of the boulevard lights in the area bounded by Lafayette, Forest Avenue,
Riverside Drive and Navarre Street. The City Engineer explained the
difficulty of the Indiana and Michigan Electric Company in maintaining
the older boulevard lights but will make further investigation in reference
to any change.
COMPLAINT OF LACK OF SIDEWALK ON _IRONWOOD - MRS. HELEN HEISLER
Mrs. Helen Heisler, 725 N. Ironwood, South Bend, Indiana, appeared before
the Board and complained of the lack of a sidewalk in front of her home and
for a distance of approximately 3/10 of a mile and the necessity of walking
in the street because of shrubbery growing all the way to the curb. Mrs.
Heisler asked how a.sidewalk could be obtained and was informed by the Board
that it could be constructed under an assessment program or if all the
property owners were agreeable they could themselves construct a sidewalk.
REQUEST TO MOVE HOUSE FROM 2111 S. MIAMI TO 1021 E. ECKMAN
Forrest R. West, Building Commissioner, presented to the Board the request
of Lewis Mitschelen, who was also present at the meeting, for permission to
move a two story frame house and garage from 2111 S. Miami Street to 1021 E.
Eckman Street, and reported that qualifications for moving the structure
had been complied with and that it meets the zoning requirements.

The following residents in the neighborhood of 1021 E. Eckman Street appeared
before the Board and objected to the move:
Mr. and Mrs. Norman J. Konzen - 1017 E. Eckman
Mrs. Raymond M. /Grummell - 1024 E. Eckman
Mr. and Mrs. Andrew Slaboda - 1011 E. Eckman
Mr. and Mrs. Rubin Gould - 1014 E. Eckman
giving as their reasons that the houses in this area are all of brick con-
struction, of a value of not less than $25,000.00, and that the house
proposed to be moved is of frame construction, two stories high, valued
on the tax records at $3950.00; that it would not blend into the neighbor-
hood; and that it would depreciate the values of the existing properties.
Upon hearing all who wished to speak, the motion was made, seconded and
carried to continue the matter one week, to permit the Board members to
view the site.
REQUEST TO BLOCK ALLEYS ABUTTING GOSPEL CENTER CHURCH
Upon motion made, seconded and carried, the request of Thomas P. Murphy,
Pastor of the Gospel Center Church at 930 30th Street, South -Bend, Indiana,
for permission to block two alleys abutting the Church between the hours of
6:30 P.M. and 8:30 P.M., during the week commencing October°26, 1970, was
referred to the Traffic Director for investigation and to work out with the
Church whatever arrangement seems feasible.
HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3326 - DEPARTMENT OF
REDEVELOPMENT
This being the date set, heari-ng, was held on the assessment roll in Vacation
Resolution No. 3326, for the vacation of:
Portions of alleys all within the recorded Third Plat of Summit
Place Addition, a Subdivision in -the northwest Quarter and the
southwest Quarter of Section 10, Township 37 north, Range 2 east,
as follows:
(1) The east -west alley between Napier Street and Jefferson
Street between the east line of Kaley Street and the west
line of the first alley east of Kaley Street.
(2), The east -west alley between Napier Street and Jefferson
Street between the east line of the first north -south alley

The Clerk tendered proofs of publication in the South Bend Tribune and
the Tri County News on October 2, 9 and 16, 1970, which were found to
be sufficient. No remonstrators having appeared and no written remonstrances
having been received upon motion made, seconded and unanimously carried,
the assessment roll was approved as presented and the Vacation Resolution
in all things confirmed as amended and the proceedings closed and the
property vacated.
ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3328 - DR. ARMAND RIP,AUX
Lloyd S. Taylor , City Engineer, files assessment roll, showing award of
damages and assessment of benefits, in Vacation Resolution No. 3328,
being for the vacation of:
a portion of the north -south alley between Penn Central right-
of-way and Otsego Avenue from the south right-of-way line of
Angela Boulevard running south 126 feet.
The Board sets November 23, '1970, as the time for receiving remonstrances
and hearing all persons interested in or affected by said vacation. And
the Clerk is directed to give notice of such hearing, together with the
amount of damages awarded and benefits assessed, by publication in the
South Bend Tribune and the Tri County News on October 30, November 6 and
November 13, 1970.
The following property may be injuriously or beneficially affected,by
such vacation:
Lots 259 to 364, inclusive, in Navarre Place and Penn Central
right of way.

Lloyd S. Taylor, City Engineer, files assessment roll, in Vacation Resolution
No. 3329, for the vacation of:
Frances Street, from the north line of Miner Street extend-
ing north 105 feet to the south right of way line•of a 12
foot alley as shown on the recorded plat of Lederer and
Longley's Subdivision of Out Lot numbered 1 in Samuel L.
Cottrell's First Addition to the town of Lowell, now a part
of the city of South Bend. This portion of the street was
formerly Lots 35 and 36 of said Addition.,
The Board sets November 23, 1970, as the date for receiving remonstrances
and hearing all persons interested in or affected by such vacation. And
the Clerk is directed to give notice of such hearing by publication in the
South Bend Tribune and the Tri County News on October 30, November 6 and
November 11, 1970.

AREA PLAN COMMISSION RECOMMENDATION
ADOPTION OF VACATION RESOLUTION NO. 3332, 1970
FOR THE VACATION OF 36TH STREET AND -THREE ALLEYS (LAGOON "K")
Area Plan Commission recommends favorably for the vacation of:
Thirty-sixth Street, from the south line of Lots 40 and 65
north to the south line of Washington Street. Also, the
north -south alley lying between 35th Street and 36th Street
from the south line of Lots 101 and 62 north to the south
line of Washington Street. Also, the east -west alley running
from 35th to 36th Street and lying between Lots/101 and 102
and Lots 61 and 62. Also, the east -west alley running from
36th Street east to the first north -south alley and lying
between Lots 43 and 44. All in Belmont Addition to the
city of South Bend.
And the Board, upon motion made, seconded and unanimously carried, adopts
the following Resolution:
"RESOLUTION NO. 3332, 1970
"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the
following
36th Street, from the -south line of Lots 40 and 65 north
to the south line of Washington Street.
Also, the north -south alley lying between 35th and 36th
Streets from the south line of Lots 101 and 62 north to
the south line of Washington Street.
Also, the east -west alley running from 35th to 36th Street
and lying between Lots 101 and 102 and Lots 61 and 62.
Also, the east -west alley running from 36th Street east to
the first north -south alley and lying between Lots 43 and
44.
All in Belmont Addition to the city of South Bend, Indiana.
Reserving the rights and easements of all utilities and the
municipal city of South Bend, Indiana, to construct and maintain any
facilities, including, but not limited, to the following: electric,

telephone, gas, water, sewer, surface water control structures
and ditches, within the vacated right of way unless such rights
are released by the individual utilities.
The following property may be injuriously or beneficially
affected by such vacation;
Lots numbered 40 through 65 and 101 through 110 all in
Belmont Addition to the city of South Bend, Indiana.
Notice of this Resolution shall be published on the 30th
day of October and the 6th day of November, 1970, in the South
Bend Tribune and in the Tri County News.
This Board, at its office, on the 9th day of November,
1970, at 9:30 A.M. will hear and receive remonstrances from
all persons interested in or affected by these proceedings.

ASSESSMENT ROLL CONFIRMED AS AMENDED - IMPROVEMENT RESOLUTION NO. 3283
FELLOWS STREET SEWER
Lloyd S. Taylor, City Engineer, files with the Board an amended assessment
roll in Improvement Resolution No. 3283, 1970, for the improvement of Fellows
Street, from Barbie Street to Ireland Road and Walters Street from Fellows
Street to approximately 345 feet west of Fellows Street, to show the
additional assessment to the City of South Bend by extending the sewer
approximately 25 feet westerly to cover the third lot as replatted by Mr. and
Mrs. Joseph Dosmann.
The Board being fully advised, upon motion made, seconded and unanimously
carried, the assessment roll was finally approved as amended.
ASSESSMENT ROLL FILED - IMPROVEMENT RESOLUTION NO. 3318 - E. WASHINGTON STREET
Clyde E. Williams and Associates, Inc., consulting engineers, files with the
Board its certificate of completion of the paving of East Washington Avenue,
from Greenlawn Street to ironwood Drive, in accordance with the plans and
specifications therefor.
And the City Engineer files with the Board an assessment roll, with the names
of the owners and a description of the property subject to be assessed, with
the amount of the prima facie assessment in the total sum of $28,195.42.
And the Board adopts a resolution accepting said assessment roll, and sets
9a30 A.M. on November 23, 1970, as the time when the owners of such real es-
tate may',attend in person or by representative and be heard.
And the Clerk is directed to give notice of such hearing by publication in
the South Bend Tribune and the Tri County'!News on November 6 and November 13,
1970.
CONTRACT AWARDED - IMPROVEMENT RESOLUTION NO. 3321 - BEALE STREET SEWER
Fbr<the.io rovement of Beale Street, from Cushing to Riverside, by construct-
ing a local sewer.
Clyde E. Williams and Associates, Inc., consulting engineers, recommends
that the bid of Dye Plumbing and Heating Company be accepted as the lowest
and best bid received.
And the Board, being duly advised in the premises, upon motion made, seconded
and unanimously carried, awards contract for such improvement to Dye Plumbing
and Heating Company on its low bid of $11,765.50.= And said Company is hereby
notified to proceed with such construction accordingly.

REQUEST FOR FOUR-WAY`.STOP AT COLLEGE AND VASSAR STREETS
Upon motion made, seconded and carried, the request of Norman T. Leverich, Sr.,
1049 College Street, South Bend, Indiana and 12 others for a four-way stop
at College and Vassar Streets, was referred to the Traffic Engineering Depart-
ment for study and recommendation.
STREET LIGHT REQUEST - 800 BLOCK DUNDEE STREET
Upon motion made, seconded and carried, the request of Joseph Muszynski,
837 Dundee Street, South Bend, Indiana, and 4 others fora street light in
the 800 block of Dundee Street was referred to the Traffic Engineering De-
partment.for study and recommendation.
STREET LIGHT OUTAGE REPORTS
Street light outage reports for the period 10/15/70 to 10/22/70 were ordered
filed.
There being no further business to come before the Board, the meeting ad-
journed at 11:10 A.M.
