A regular meeting of the Board of Public Works and Safety convened at 9:30
A.M., with S. J. Crumpacker, City Attorney, and James A.,Bickel, City
Controller, present. Mr. Crumpacker acted as chairmen of the meeting.
The minutes of the previous meeting were reviewed and approved.
FIRE DEPARTMENT - APPLICATIONS
The following applications for appointment to the South Bend Fire Department
were filed and referred to the Personnel Director for further processing:

POLICE DEPARTMENT - APPLICATIONS
The following applications for appointment to the South Bend Police Depart-
ment were filed and referred to the Pi3r.sonnel Director for further processing:

MUNICIPAL PARKING GARAGES - PROGRESS REPORT
J. J. McNeile, Parking Manager, presented a progress report for the municipal
parking garages at Jefferson Boulevard and St. Joseph Street and at Main and
Colfax Streets, which was read and ordered filed.
Mr. McNeile reports the garage at Jefferson and St. Joseph Street,will be
open for business on or about October 5, 1970, and the garage at Main and
Colfax will open for business early in November, 1970; that parking rates
have been established at $20.00 per month, at 35� for the first hour and
15� for each additional,hour up to 95� per day, and that a validation
program of 25� by downtown merchants,has been established. Mr. McNeile is
to report further on week end parking.
BUILDING DEPARTMENT - SUB -STANDARDS DIVISION
J. W. Adamson, Sub -Standards Director, appeared before the Board and the
following matters were taken up:
1505 Miami Street. Neither Gordon L. nor Ada M. Roseberry appeared as re-
quested. Mr. Adamson reports the Roseberrys have indicated by letter they
are agreeable to the demolition of the building. Upon motion made, seconded
and carried, the Sub -Standards Director was authorized to seek bids for the
demolition of the front structure at 1505 Miami Street.
1210 South Bend Avenue. Neither Lloyd nor Mabel R. Rough appeared as requested.
Mr. Adamson reports mail addressed to them has been returned by the Post
Office. Upon motion made, seconded and carried, the matter was continued two
weeks for further investigation by the Sub -Standards Director.
925 W. Washington Street. Attorney William 0. Jackson appeared on behalf of
Theresa Grear and stated they are agreeable to the demolition of the property.
Upon motion made, seconded and carried, the Sub -Standards Director was
authorized to seek bids for the demolition of the structure at 925 W. Washington
Street.
1629 S. Franklin Street. Nicholas P. Cholis did not appear as requested. Mr.
Adamson reports Mr. Cholis has indicated they are agreeable to the building
being demolished. Upon motion made, seconded and carried, the Sub -Standards
Director was authorized to seek bids for the demolition of the structure at
1629 S. Franklin Street.
505 Kalorama. Mr. Adamson reports certified notice to the owners Sergio and
Hass was returned by the Post Office "unclaimed." Upon motion made, seconded
and carried, the matter was continued two weeks for further investigation by
the Sub -Standards Department.
2410-2412 W. Ford Street (on the complaint of A. C. Dillon and others).
r, AZIamson reports no response has been received from the owner Gene
Arnett, 616 S. 3rd Street, Niles, Michigan to notice addressed to him on
September 8, 1970. Upon motion made, seconded and carried, the matter was

continued two weeks.
2116 Western Avenue. Mr. Adamson reports attorney Stratigos has provided -
him with the names of creditors of the owner of this building and that these
persons have been notified of the pending demolition of the structure. Upon
motion made, seconded and carried, the matter was continued two weeks.
Demolition bids opened:
This being the tme set, bids were opened for demolition of the following
structures. Non collusion affidavits were examined and found to be proper.

Upon motion made, seconded and carried, contract for demolition of the
structure at 1005 Queen Street was awarded to Midwest Demolition Company on
its low bid of $231.00.

Upon motion made, seconded and carried, contract for demolition of the structure
at 314 E. Keasey Street was awarded to O'Neal Trucking Company on its low bid
of $414.00.

Mr. Adamson, Sub -Standards Director, reports he has had a request from attorney
Robert DuComb, who represents the mortgagee, for a continuance of one week and
that they will deposit $25.00,as requested, for the benefit of the low bidder
in the event contract is not -awarded for demolition. Upon motion made, seconded
and carried, the matter of awarding contract for the demolition of the structure
at 3509 E. Pleasant Street was continued one week.

Upon motion made, seconded and carried, the Board approved the request of the
Sub -Standards Director for the following persons to appear before the Board on
October 5, 1970, to show cause, if any they have, why the structures at the
following addresses should not be demolished:

Having been continued from September 14, 1970, hearing was resumed on Vacation
Resolution No. 3326, being for the vacation of:
(1) The east -west alley between Napier Street and Jefferson Street
between the east line of Kaley Street and the west line of the
first alley east of Kaley Street.

(18) The east -west alley between Lots 624 and 625 between the east
line of Meade Street and the west line of the first north -south

(19) The east -west alley between Lots 597 and 598 between the east
line of Meade Street and the west line of the first north -south
alley east of Meade Street.
Glenn L. Barbe, of the Department of Redevelopment, reported that all persons
had been contacted as requested by the Board on September 14, 1970, except
O'Dell Coates who was unavailable.
Mr. Barbe reports Mrs, Rose Baetsle, 126 N. Meade Street, and Mrs. Henry
Jones, 2629 W. Washington A:�enue, had been mistaken as to the alleys re-
ferred to and are now in agreement for the vacation; that Mrs. James Scott,
2629 Newcome Street, has a valid objection because of her business and he
therefore recommends that alley #9 be deleted from the vacation; that Leo
Verhaegen, 137 S. Meade Street, objects to the closing of alley #6 and
alley #8 as he plans to build a garage facing the alley.
Mvs:-.James..Scott, :2629rW, Washington Avenue, was present at .the meeting.
No one further appearing, the motion was made to amend Vacation Resolution
No. 3326, 1970, by deleting from it the alley marked #9 and the alleys
marked #6 and #8 (north -south alleys between Kaley and Meade Streets). The
motion was seconded and carried.
The motion was then made, seconded and carried, to adopt Vacation Resolution
No. 3326, 1970 as amended.
And the City Engineer was directed to prepare an assessment roll showing the
assessment of benefits and the award of damages to the surrounding properties.
HEARING ON VACATION RESOLUTION NO. 3329 - MIDWEST TURNKEY BUILDERS, INC.
This being the date set, hearing was held on Vacation Resolution No. 3329,
being for the vacation of:
Frances Street from the north line of Miner Street extending
north 105 feet to the south right of way line of a.12 foot
alley as shown on the recorded Plat of Lederer and Longley's
Subdivision of Out Lot numbered 1 in Samuel L. Cottrell's
First Addition to the town of Lowell, now a part of the city
of South Bend. This portion of the street was formerly
Lots 35 and 36 of said Addition.
The Clerk tendered proofs of publication in the South Bend Tribune and the Tri
County News on September 11 and September 18, 1970, which were read and found
to be sufficient.
Attorney Robert L. Miller, 112 Lafayette Building, South Bend, Indiana, and
Keith Slabaugh, 305 N. Studebaker Street, Mishawaka, Indiana, for Midwest
Turnkey Builders, Inc., appeared before the Board in favor of the vacation.
Attorney F. Jay Nimtz, 511 W. Colfax Avenue, South Bend, Indiana, appeared
before the Board on behalf of persons who signed a remonstrance filed with
the Board on September 8, 1970.
Approximately 18 other ;interested persons were present at the meeting.
Mr. Miller explained the purpose of the request to vacate the street was to
provide off street parking in connection with the turnkey project of the
petitioner. The residents complained that the closing of this portion of
Frances Street would create a bottleneck and would increase the traffic
problems that already exist and make it difficult or impossible to get to
their garages. Mr. Nimtz stated that the solution to the problem would be
to extend Frances Street.
Mr. Miller stated that Midwest Turnkey Builders, Inc. is willing to provide
a 14 foot easement as recommended by the Area Plan Commission, and there
followed a discussion as to the location of this easement.

2, and October 9, 1970.
REQUEST TO ADVERTISE FOR BIDS FOR LAGOON "A"
Upon motion made, seconded and carried, the Board approved the request of
the City Engineer for permission to advertise for bids for construction
of a storm sewer and Lagoon "A" in the Hepler-34th Streets area.
October 19, 1970, was set as the time for receiving bids, and the Clerk
was directed to give notice by publication in the South Bend Tribune and
the Tri County News on September 25, 1970 and October 2, 1970.
REQUEST TO ADVERTISE FOR BIDS FOR LAGOON "K"
Upon motion made, seconded and carried, the Board approved the request of
the City Engineer for permission to advertise for bids for construction

Lloyd S. Taylor, City Engineer, files with the Board, in connection with
the construction of a storm sewer and Lagoon "K" in the Logan-36th Streets
area, his petition to vacate:
36th Street, from the south line of Lots 40 and 65 in Belmont
Addition to the City of South Bend, north to the south line
of Washington Street;
Also, the north -south alley lying between 35th and 36th
Streets, from the south line of Lot 101 and 62 t( north
to the south line of Washington Street;
Also, the east -west alley running from 35th Street to 36th
Street and lying between Lots 101 and 102 and Lots 61 and 62.
Also, the east -west alley running from 36th Street east to

Upon motion made, seconded and carried, the petition was referred to the
Engineering Department for the location of utilities and then to be referred
to the Area Plan Commission for study and recommendation to the Board.
REQUEST FOR CAB STANDS - INDIANA CAB COMPANY
Upon motion made, seconded and carried, the request of the Indiana Cab Company,
710 N. Niles Avenue, South Bend, Indiana, for a two -cab stand in front of the
American National Bank and Trust Company, on the west side of Main Street
and for a two -cab stand in,the 200 block of W. Washington Street, on the north
side of the street, just west of the alley, was referred to the Traffic
Engineering Department for study and recommendation to the Board,
REQUEST TO HOLD BONFIRE - MACEDONIA BAPTIST CHURCH
Upon motion made, seconded and carried, the Board approved the request of the
Macedonia Baptist Church, 1826 N. Olive Street, South Bend, Indiana, for the
Junior Choir to hold a bonfire on September 26, 1970, between 7:00 P.M. and
10:00 P.M., in the field near the Church, subject to the approval of the Fire
Department.
BONFIRES - TO BE DISCONTINUED
Upon motion made, seconded and carried, the Board adopted a policy henceforth
whereby it will no longer approve' any request to hold a bonfire.
HOLIDAY - MONDAY, OCTOBER 12, 1970
Monday, October 12, 1970, being an official holiday, it was moved, seconded
and carried that the meeting of the Board of Public Works and Safety scheduled
for that day be eliminated. And the Clerk was directed to so notify all
Departments.
CONTRACTOR'S BOND
Upon motion made, seconded and carried, the Board approved certificate continuing
contractor's bond of Cohagan Equipment Company, Inc., to 10/5/71.
IMPROVEMENT RESOLUTION5NO. 3284, 3285 , 3286 - VINE STREET, 32ND TO 36TH STREET
ENGINEER'S REPORT
PRELIMINARY ORDER FOR CLASS C, TYPE III -A PAVEMENT
FINAL ORDER FOR CLASS C, TYPE IV PAVEMENT
CONTRACT AWARDED
NOTICE TO PROCEED
For the improvement of Vine Street, from 32nd Street to 36th Street, by con-
structing a Class C pavement with curb repair.
Clyde E. Williams and Associates, Inc., consulting engineers, having examined
the bid of Rieth Riley Construction Company, Inc., recommends to the Board that
said streets be paved with Class C, Type III -A asphalt pavement.
The Board having considered the bid and the recommendation of the consulting
engineer, the motion was made, seconded and carried that said streets be
paved with Class C, Type III -A asphalt pavement.
Whereas 51% and more of the resident property owners on said Vine Street
have requested in writing that Class C, Type IV pavement be used, upon motion
made, seconded and carried, the preliminary order is hereby rescinded and the
street ordered paved with Class C, Type IV pavement.
