A regular meeting of the Board of Public Works and Safety convened at 9:35_
A.M:, on September 14, 1970, with all members present. The minutes of the
meetings August 24 and August 31, 1970, were reviewed and approved.
OPEN BIDS
IMPROVEMENT RESOLUTION NO. 3284 —VINE STREET, 32nd STREET TO 34th STREET

This being the date set for receiving bids for the improvement of Vine Street,
from 32nd,Street to 36th.Street, by constructing a Class C pavement, the Clerk
tendered proofs of publication of notice in the South Bend Tribune and the Tri
County News 'on.August 28 and September 4, 1970, which were read and found to
be sufficient.
The bid of Rieth-Riley Construction Company, Inc., P. 0. Box 775, South Bend,
Indiana, 46624 was the only bid received. Non collusion affidavit was found
to.be proper. .The bid was accompanied by a bid bond of 5%.of the bid and
by financial statement of bidders (Form.96-a.of.*the;State.Board of Accounts)

Completion date - 60 calendar days after contract is awarded.
Upon motion made, seconded and unanimously carried, the bid was .referred to
Clyde E. Williams and Associates, Inc., consulting engineers, for study and
recommendation.
BUILDING DEPARTMENT - SUB -STANDARDS DIVISION
J. W. Adamson, Sub -Standards Director, appeared before the Board and the
following matters were taken up.
1005 W. Queen Street. The Sub -Standards Director submitted to the Board
a letter from the South Bend Lathe Credit Union agreeing to the demolition
of this structure. Thereupon, the motion was made, seconded and unanimously
carried to authorize the Sub -Standards Director to seek bids for demolition
of the structure at 1005 Queen Street.
505 Kalorama Street. Neither Joseph Sergio nor Charles Hass appeared before
the Board as requested and the Sub -Standards Director reported he has heard
nothing from them. `Upon motion made, seconded and unanimously carried, the
matter was continued one week.
314 E. Keasey. John Kapsalis appeared before the Board as requested. Neither
Mary Lee Brown nor Cleveland Brown, land contractor buyers, appeared as re-
quested. Mr. Kapsalis stated the land contract buyers are behind in their
payments and he is agreeable to the structure being demolished. It was moved,
seconded and unanimously carried that the Sub -Standards Director be.authorized
to seek bids for demolition of the structure at 314 E. Keasey Street. _
1150-11502 S. Franklin Street. Mrs. Brinley, daughter of Marian and Liewiecki,
appeared before the'Board and stated her parents are willing to have the
structure taken down. Upon motion made, seconded and unanimously carried,
the matter of 1150-T1502 S. Franklin Street was continued two weeks to permit
the owners to close up the building or have it demolished.
138 S. Meade Street. Y. B. Williams appeared as requested. Mr. Williams
stated he is waiting to sell the property to the Department of Redevelopment
and will close it�up in the meantime. Upon motion made, seconded and carried,
the matter was continued indefinitely.on the condition that the owner close
the premises and remove all debris from the exterior and keep it that way.

3509 Pleasant Street. Neither Frank nor Dorothy Buck appeared as requested.
Mr. Adamson reported nothing has been done to rehabilitate this property.
Upon motion made, seconded and unanimously carried, the Sub -Standards Director
was authorized to seek bids for demolition of the premises at 3509 Pleasant
Street.
626 Harrison Street. Upon motion made, seconded and carried, the matter of 626
Harrison Street was continued two weeks to permit the owner to complete the,
demolition of the premises.
717 E. Broadway. Cecil Clarkson, realtor, 333 Lincolnway West, South Bend,
Indiana, appeared on behalf of the owners of this property, Nan Kercheval
and the estate of Pearl Kercheval, and stated the owners intend to rehabilitate
the property. Upon motion made, seconded and unanimously carried, the matter
was continued two weeks to permit the owners to close up the building.

Paul Goldberg, one'of the owners of the property -at 740 N. Frances Street,
appeared before the Board and stated they have no money with which to repair
or tear down•the structure; and stated they have stored some kitchen cabinets
and siding in the building which they would like to remove.
The motion was made to tentatively award contract for demolition of the
structure at 740 N. Frances Street to B & J Demolition Company on its low bid

of $400.00, on the condition that:
(1) the owners be allowed one week in which to remove any
materials stored in the building;
(2)the B J Demolition Company be permitted to withdraw
their bid if they.have counted on any of the materials
stored in the building as a part of their bid..
(3) if the bid of B & J Demolition Company is withdrawn the
property will be readvertised for demolition.
The motion was seconded and carried.

Upon motion made, seconded and unanimously carried the Board approved the re-
quest of the Sub -Standards Director for the following persons to appear be-
fore the Board on September 28, 1970, to show cause, if any they have, why

HEARING ON ASSESSMENT ROLL - IMPROVEMENT RESOLUTION NO. 3297 - HAWTHORNE DRIVE
This being the date.set,. hearing was held on the assessment roll in Improvement
Resolution No. 3297, for the improvement of Hawthorne,Drive, from McKinley Drive
to Colfax Avenue, by constructing a Class C, Type IV, pavement.
The Clerk tendered proofs of publication of notice in the South Bend Tribune
and the Tri County News on August 28_and September 4, 1970, which were read
and found to be sufficient.
No remonstrators having appeared and no written remonstrances,havi.ng been
received, upon motion made seconded and unanimously carried, the assessment
roll was approved and confirmed as adopted August 24, 1970.

Appearing for the vacation was Glenn L. Barbe, representing the Department
of Redevelopment.
Appearing against the vacation were Mrs. Rose Baetsle, 126 N. Meade Street,
South Bend, Indiana; Mrs. Henry Jones, 2629 W. Washington Avenue, South Bend,
Indiana and Mrs. James Scott, 2629 Newcome Street, South Bend, Indiana, who
objected to the vacation because they use the alleys in their vicinity.
Mrs. James Scott, 2629 Newcome stated she operates a beauty shop right on the
alley and that taxicabs use the alley to pick up and discharge customers.
Mr. Barbe explained the vacation plan in the LaSalle Park Redevelopment
project is to vacate those alleys which can be closed without affecting
utilities and existing garages, in an endeavor to provide off-street parking.
After hearing all who wished to speak, upon motion made, secc"ded and carried,
the hearing was continued until September 21, 1970, for the Department of
Redevelopment to further contact property owners.
HEARING ON VACATION RESOLUTION NO. 3327 - ASSOCIATES DISCOUNT CORPORATION
This being the date set, hearing was held on Vacation Resolution No. 3327,
being for the vacation of;
29 feet of a public court as platted in E. Louis
Kuhn's Subdivision of the west Half of Large Lot
No. 20 in Samuel L. Cottrell's First Addition to
the town of Lowell, now a part of the city of South
Bend.
The Clerk tendered proofs of publication of notice in the South Bend Tribune
and the Tri County News on September 4 and September 11, 1970, which were
read and found to be sufficient.
Attorney Arthur W. Frisk, 2310 S. Main Street, South Bend, Indiana, appeared
before the Board on behalf of the petitioner Associates Discount Corporation

and explained the purpose of the vacation.
Mrs. Robert Jernigan, 226 S. Notre Dame Avenue, South Bend, Indiana, appeared
in response to notice received. It was determined that her property would
in no way be affected by the vacation.
No remonstrators having appeared and no written remonstrances having been re-
ceived and having heard all who wished to speak, upon motion made, seconded
and carried, the Resolution adopted on August 31, 1970 was in all things
approved and confirmed and the vacation granted.
And the City Engineer was directed to prepare an assessment roll covering
the assessment of benefits and the award of damages to the surrounding
properties.
HEARING ON VACATION RESOLUTION NO. 3328 - DR. ARMAND RIGAUX
This being the date set, hearing was held on Vacation Resolution No. 3328,
being for the vacation of:
A portion of the north -south alley between Penn
Central right of way and Otsego Avenue from the
south right of way line of Angela Boulevard
running south 126 feet.
The Clerk tendered proofs of publication of notice in the South Bend Tribune
and the Tri County News on September 4 and September 11, 1970, which were
read and found to be sufficient.
Mr. and Mrs. D. J. Goolsby, 1308 Otsego Street, South Bend, Indiana, appeared
before the Board and stated they are in favor of the vacation providing their
garbage and trash can be picked up.
No one further appeared either for or against the vacation.
Since the petitioner was not present and several questions were raised, it
was moved, seconded and carried that the hearing be continued until September
28, 1970.
ASSESSMENT ROLL FILED - IMPROVEMENT RESOLUTION NO. 3311 - ALLEY BETWEEN
INGLEWOOD AND HOLLYWOOD
Lloyd S. Taylor, City Engineer, files assessment roll, with the names of the
owners and a description of the property.: subject to be assessed, with the
amount of the prima facie assessment in the total sum of $10,076.51, in the
matter of the improvement of the alley between Inglewood Place and Hollywood
Place; from Woodlawn Avenue to Oakwood Avenue, by constructing a Class C,
Type I concrete pavement.
Upon motion made seconded and unanimously carried, the Board adopts a
resolution accepting said assessment roll and sets 9:30 A.M. on October l9;
1970, Room 1308 County City Building, as the time and place for receiving
remonstrances against the amounts assessed on said roll and will at such time
determine whether such lots or tracts of land have been or will be benefited
b y such improvement to the amounts named.
And the Clerk is directed to•give notice of such hearing by publication in the

REQUEST TO ADVERTISE FOR VEHICLES FOR ENGINEERING DEPARTMENT
Upon motion made, seconded and unanimously carried, the Board approved the
request of the City Engineer for permission to advertise for two vehicles
for the Engineering Department. September 28, 1970, was set as the time for
receiving bids, and the Clerk was directed to give notice by publication in
the South Bend Tribune and the Tri County News on September 18 and September
25, 1970.

PARK DEPARTMENT - $50,000.00 "LAND" ACCOUNT
Upon motion made, seconded and carried, a letter from Robert 0. Laven,
President of the Common Council, directing the reservation of $50,000.00
in the Cumulative Capital Improvement Fund for the "Land" account of the
Park Department, was referred to the City Controller for appropriate action.
REQUEST TO HOLD CIRCUS PARADE - UNIVERSITY OF NOTRE DAME
Upon motion made, seconded and unanimously carried, the Board approved the
request of Joe P. Sassano, Assistant Director, Athletic and Convocation Center,
University of Notre'Dame, Notre'Dame, Indiana, 46556, for permission to hold
a circus parade on September 17, 1970, at approximately 3:30 P. M., from
Garst and Prairie Streets, going north on Michigan Street to Angela Boulevard
and east on Angela to Juniper Road to the rear of the Convocation Center, on
condition that the Board be provided with evidence of proper insurance
coverage to hold the City of South Bend harmless.
TOPICS PROGRAM
r-1 It was moved, seconded and carried that the City of South Bend enter into
JO an agreement with Clyde E. Williams and Associates Inc., whereby Clyde E.
Williams and Associates, Inc., will render engineering services and technical
assistance in connection with a TOPICS program, subject to the availability
Q of funds.
SIDEWALK REPAIR AT R. R.—CROSSING, TWYCKENHAM DRIVE - REPORT
In reference to the request of Common Council President Robert 0. Laven re-
garding repair of the sidewalk on Twyckenham Drive at the Grand Trunk Railroad
crossing, Traffic Director Clem F. Hazinski reports meeting with the Grand Trunk
people and reports that a crew was assigned to repair the walk with new
planking and should be completed within a few days.
PARKING METER REPLACEMENT APPROVED
Upon motion made, seconded and carried, the Board approved the recommendation
of the Traffic Director for the replacement of parking meter #8 on the east
side of South Michigan Street just south of Sample Street.
TRAFFIC REGULATIONS APPROVED
Upon motion made, seconded and unanimously carried, the Board approved the
following traffic regulations as recommended by the Traffic Engineering
Department:
1. Install 30 minute time limit signs, with right and left arrows,
in front of 1001 E. Jefferson Boulevard.
2. Install two-hour parking limit sign at 2611 S. Main Street.
3. Install no parking passenger loading zone signs on the east side
of the 1900 block of N. Brookfield, alongside Marquette School,.
limited to 150 feet.
4. Install stop sign and post on the northwest and on the southeast
corners of Ireland Road and Fellows Street.
5. Install two-hour parking limit signs at 1303 S. Michigan Street.
6. Replace stop sign and post on the southwest corner of Widener
Lane at Miami Street.
STREET LIGHT REQUEST
Upon motion made, seconded and carried, the request of residents of the800
block of S. Kosciusko Street for a street light at the alley near Dunham
Street was referred to the Traffic Engineering Department for study and
recommendation.

STREET LIGHTING APPROVED - KUNTSMAN COURT
Upon motion made, seconded and unanimously carried, the Board approved the
recommendation of the Traffic Engineering Department for street lighting in
Kuntsman Court as follows:
Replace 4,000L INC with 7,000L MV
Install - 7,000L MV mid -block
at a total cost to the City of $55.80 per year.
STREET LIGHT OUTAGE REPORTS
Street light outage reports for the period 9/8/70 to 9/14/70 were ordered
filed.
There being no further business to come before the Board, the meeting ad-
journed at 11:30 A.M.
