Crumpacker and James A. Bickel present. S. J. Crumpacker acted as chairman of the meeting. W. Adamson, Sub -Standards Director, appeared before the Board and the following matters were taken up. Demolition bids opened; This being the date set, bids for demolition of the following properties were opened. Non collusion affidavits were found to be proper. Bids were: 623 N. Birdsell: Midwest Demolition Co. $ 714.00 O'Neal Trucking Co. 974.00 Bryant Excavating Co. 1,085.00 Upon motion made, seconded and carried, contract for demolition of the structure at 623 N. Birdsell Street was awarded to Midwest Demolition Company on its low bid of $714.00. 2116 Western Avenue: Midwest Demolition Co. $4,413.00 Bryant Excavating Co. 5,700.00 O'Neal Trucking Co. 4,728.00 At the request of the Sub -Standards Director, award of contract for demolition of the structure at 2116 Western Avenue was deferred until Tuesday, September 8, 1970. Upon motion,,made, seconded and carried, the following Vacation Resolution was adopted: "RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: 29 feet of a public Court, as platted in E. Louis Kuhn's Subdivision of the west Half of Large Lot No. 20 i�n Samuel L. Cottrell's First Addition to the town of Lowell, now a part of the city of South Bend. Reserving the rights and easements of all utilities and the municipal city of South Bend, Indiana, to construct and main- tain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control ,..� structures and ditches, -within the vacated right of way, unless 00 such rights are released by the individual utilities. 1� The following property may be injuriously or bene- ficially affected by such vacation: Q Lots in E. ARMAND RIGAUX Area Plan Commission files with the Board its recommendation for the vacation of a portion of the north -south alley between Penn Central right of way and Otsego Avenue from the south right of way line of Angela Boulevard running south 126 feet, with the recommendation that the curb cut be discontinued and the present cut be curbed. And the City Engineer is directed to prepare a vacation resolution. ADOPTION OF VACATION RESOLUTION NO. 3328 1970 - DR. ARMAND RIGAUX Upon motion made, seconded and carried, the following Vacation Resolution No. 3328, 1970 was adopted: "RESOLVED (9Y.7HE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: A portion of the north -south alley between Penn Central right of way and Otsego Avenue from the south right of way line of Angela Boulevard running south 126 feet. Taylor, City Engineer, files assessment roll showing award of damages and assessment of benefits in Vacation Resolution No. 3270, 1968, being for the vacation of: A 14 foot alley running north and south and located immediately west of Lots 15, 14, 13 and the south 16 feet of Lot 12 as shown on the recorded plat of Harlin's Subdivision of a part of Bank Out Lot 82 of the 2nd plat of Out Lots of the town (now city) of South Bend, platted by the State Bank of Indiana. And the Clerk is directed to give notice of such hearing by publication in the South Bend Tribune and the Tri County News on September 4, September 11 and September 18, 1970. ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3317, 1970 - MILL RACE, INC. 30' EASEMENT Lloyd S. Taylor, City Engineer, files assessment roll in Vacation Resolution No. 3317, 1970, being for the vacation of an easement described as follows: That part of the west Leg of the East Race which is located northerly of a line parallel to and 30 feet southerly of the southerly line of Hydraulic Avenue and located westerly of the west line of the East Race, which said west Leg of the East Race is the Race located on the southeaterly and east sides of Hydraulic Avenue in Section 1 and in Section 12, Township 37 north, Range 2 east in the city of South Bend, Indiana. The following property will not be injuriously or beneficially affected by/ such vacation: 8/31/70 Lots numbered 12 through 21 and an unplatted area adjacent to Lot 12, all in Miller and Green's Second Addition. The following property will be beneficially affected by such vacation: Lots numbered 22 through 29 in Miller and Green's Second Addition. The City of South Bend having purchased the easement of the above described 30 feet of realty adjacent to Hydraulic Avenue for $2400.00 as per excerpt from the minutes of the Board of Public Works and Safety December 7, 1953 (Book 19, page 98) as follows: ''An easement over 30 feet of realty adjacent to Hydraulic Avenue in the city of South Bend, Indiana, as more particularly described in the form of grant of easement submitted at this meeting, incorporated herein by reference and ordered filed with the minutes of this meeting, which easement has been heretofore/ 00 --appraised by said Robert G. Happ, Percy H. Walsh and William S. Moore at the fair cash market value of $2400.00.,, Q it is hereby determined by the Board of Public Works and Safety that the value of this easement to the adjacent property is: Net benefits $2400,00 Net damages $ 00.00 Upon motion made, seconded and carried, the Board adopted said assessment roll and set 9:30 A.M. on September 28, 1970, as the date for hearing all persons interested in or affected by said vacation. NOTICE TO PROCEED - IMPROVEMENT RESOLUTION N0. 3318 - E. WASHINGTON AVENUE Contract for the improvement of East Washington Avenue, from Greenlawn Avenue to Ironwood Drive by constructing a Class C, Type IFV pavement with curbs, having been awarded on August 24, 1970, the Board hereby directs the Rieth Riley Construction Company, Inc., to proceed with such improvement. REQUEST FOR NO SLURRY SEAL ON LOMBARDY STREET Mrs. Richard Grontkowski, 926 Lombardy Street, South Bend, Indiana, appeared before the Board to protest the slurry sealing of Lombardy Street, stating that the street in her area does not need repair and that she and 25 others do not want it. Upon motion made, seconded and carried, the matter was re- ferred to the City Engineer. IRONWOOD DRIVE - (CITY OF MISHAWAKA AND CITY OF SOUTH BEND) It was moved, seconded and carried that the City of South Bend reimburse the City of Mishawaka for the construction of the west side of Ironwood Drive, from Lincolnway East to River Avenue, at an estimated cost to the City of South Bend of $6,670.00. REQUEST OF J. E. WALZ, INC. TO ERECT TENT Upon motion made, seconded and carried, the request of J. E. Walz, Inc., 3423-31 S. Michigan Street, South Bend, Indiana, to erect a tent for its annual tent sale at 3423 S. Michigan Street from September 8 to October 20, 1970, was approved subject to the approval of the Buil'ding Department and the Fire Department. REQUEST TO HOLD BONFIRE AND PARADE - ST. JOSEPH HIGH SCHOOL Upon motion made, seconded and carried, the request of Brother Charles Gregg, C.S.C., on behalf of St. Joseph's High School, 1441 Michigan Street, South Bend, Indiana, for permission to hold a bonfire west of the high school on Angela Boulevard at 8:30 PM., on October 16, 1970, and to hold a parade 8/31/70 from the school parking lot to the Jackson High School Athletic Field, commencing at 6:30 P.M. on October 17, 1970, was referred to the Fire Depart- ment and to the Traffic Engineering Department for review and recommendation. STREET LIGHT PETITION A petition by Arthur J. O'Neill, 601 E. Dayton Street, South Bend, Indiana, and others for street light at the alley between Dayton and Dubail Streets on Rush Street was filed with the Board and upon motion made, seconded and carried was referred to the Traffic Engineering Department for review and recommendation. CONTRACTOR'S BOND APPROVED Upon motion made, seconded and carried, contractor's bond for Richard E. Strozewski to 8/17/71 was approved by the Board and ordered filed. EXCAVATION BOND APPROVED Upon motion made, seconded and carried, excavation bond for Haskins, Inc., to 8/27/71 was approved by the Board and ordered filed. CONTRACTOR'S BOND CANCELLED Upon motion made, seconded and carried, the Board approved the termination of contractor's bond dated September 9, 1969, on behalf of Portage Realty Corporation for all work done on or after September 9, 1970. STREET LIGHT OUTAGE REPORTS Street light outage reports for the period 8/20/70 to 8/26/70 were ordered filed.
