A regular meeting of the Board of Public Works and Safety convened at 9:40
A.M.., with all members present. The minutes of the meeting August 10, 1970
were reviewed and approved.
BIDS OPENED - IMPROVEMENT RESOLUTION NO. 3318 - E. WASHINGSON AVENUE
This being the date set for receiving bids for the improvement of East
Washington Avenue, from Greenlawn to Ironwood Drive, by constructing a
Class C, pavement with curbs, the Clerk tendered proofs of publication of
notice in the South Bend Tribune and the Tri County. News on August 7 and
August 14, 1970, which were read and found to be sufficient. The following
bids were received:
.Bituminous Materials Company, Inc., Room 417 Ma`ycrest Building, 2015
Western Avenue, South Bend, Indiana. The bid was accompanied by a bid bond
in the amount of 5% of the bid, bidder's financial statement (Form 96a),
and non collusion affidavit which was found to be proper. Bid was for
r_q Class C, Type III A, asphalt $28,502.00
90 Class C, Type IV asphalt $22,087.00
lt`. Completion time - 40 days.
Rieth Riley Construction Company, Inc. P. 0. Box 775, South Bend, Indiana,
Q46624. The bid was accompanied by a bid bond of 5% of the total bid, by
bidder's financial statement (Form 96a) and non collusion affidavit which
was found to be proper. Bid was for
Class C, Type III A, asphalt $26,997.50
Class C, Type IV asphalt $21,887.50
Completion time - 45 days.
Upon motion made, seconded and unanimously carried, the bids were referred to
Clyde E. Williams, consulting engineers) for review and recommendation.
HEARING ON VACATION RESOLUTION NO. 3322 - STANLEY PIETZAK
This being the date set, hearing was held on Vacation Resolution No. 3322,
1970, for the vacation of a portion of Ivy Road, running north from the north
right of way line of South Bend Avenue to the south right of way line of
Edison Road.
The Clerk tendered proofs of publication of notice in the South Bend Tribune
and the Tri County News on August 7 and August 14, 1970, which were read and
found to be proper.
Stanley Pietzak, 302 Ostemo Place South Bend, Indiana, one of the petitioners,
and attorney Irving J. Smith, 806 Tower Building, South Bend, Indiana, appeared
before the Board.
Mr. Smith stated.he represents the petitioners; that the petitioners contemplate
building a motel in this area and have petitioned for the vacation of a portion
of Ivy Road which would provide more parking space for the motel; that upon
such vacation, petitioners propose to dedicate an 80 foot strip of land to the
City of South Bend for the purpose of extending Twyckenham Drive north to
Edison Road.
No other persons appeared for or -against the vacation.
Following a discussion as to who should be responsible for the cost of the im-
provement to Twyckenham Drive, upon motion made seconded and unanimously
carried, the matter was taken under advisement by the Board.
FIRE DEPARTMENT - REQUEST TO ATTEND FIRE CHIEF'S CONFERENCE
Upon motion made, seconded and unanimously carried, Fire Chief Joseph L. Zurat
was authorized to attend the Indiana Fire Chiefs' Conference in Fort Wayne,
Indiana August 26, 27 and 28, 1970.-

FIRE DEPARTMENT - APPLICATION
The application of Allen Gene Viduka for appointment to the South Bend Fire -
Department was filed with the Board and referred to the Personnel Director
for further processing.
P&LICE DEPARTMENT - REPORTS
Police Department statistical report for the month of July, 1970, traffic
report for July, 1970, and a crime survey report in the LaSalle Park area
under redevelopment covering a period from 1966 .thr.ough 1969 showing a
decrease in offenses reported were reviewed by the Board and ordered ,filed.
POLICE DEPARTMENT APPLICATIONS
The following applications for appointment to the South Bend Police Depart-
ment were filed with the Board and referred to the Personnel Director for
further processing:

COMPLAINT - JOHN McCARTNEY
John McCartney, 1133 W. Bryan Street, South Bend, Indiana, appeared before the
Board and complained of the condition of the sewer and the street at the
intersection of Bryan and Inglewood and of weeds and trash on vacant lots
on the west side of Inglewood. The Board will look into the matter.
REQUEST TO HOLD BLOCK PARTY - PARK AVENUE - MANITOU PLACE
Upon motion made, seconded and unanimously carried, the Board approved the
request of Mrs. Charles M. Veen, 803 Park Avenue, South Bend, Indiana'to
close Manitou Place on August 20, 1970, for a block party from 6:30 P.M.
to 9:00 P.M.
BOARD MEETING - LABOR DAY
Monday, September 7, 1970, the regular Board meeting date being a legal holiday,
the motion was made, seconded and unanimously carried that the Board meeting
which would normally be held on Monday, September 7, 1970, be held on Tuesday,
September 8, 1970.
STREET LIGHTING APPROVED
Upon motion made, seconded and unanimously carried, the Board approved the
recommendation of the Traffic Engineering Department for street lighting as
follows:

ASSESSMENT ROLL FILED - IMPROVEMENT RESOLUTION NO.3283 - FELLOWS STREET SEWER
Clyde E. Williams and Associates, Inc., having certified that the DeWulf
Construction Company,olnc., has completed the construction of a local sewer
on Fellows Street, from Barbie Street to Ireland Road and in Walters Street
from Fellows Street to approximately 345 feet west of fellows Street.
And the City Engineer having filed assessment roll, with the names of the::
owners and the description of property subject to be assessed with the
amount of the prima facie assessment.
The Board, upon motion made, seconded and unanimously carried, adopts a
00 resolution accepting said assessment roll and sets 9:30 A.M. on Tuesday,
September 8, 1970, in Room 1308 County City Building, as the time and place
for receiving remonstrances against the amounts assessed on said roll, and
t� will determine whether such lots or tracts of land have been or will be
benefited by said improvement to the amounts named .
And the Clerk is directed to give notice of such hearing by publication in
the South Bend Tribune and the Tri County News on August 21 and August 28,
1970.
ASSESSMENT ROLL FILED — IMPROVEMENT RESOLUTION NO. 3294 - ALLEY (200 BLOCK)
BETWEEN NOTRE DAME AVENUE AND ST. PETER STREET
Clyde E. Williams and Associates, Inc., consulting engineers, having certi-
fied that McIntyre and Jones Construction Company, Inc., has completed the
paving of the alley in the 200 block of Notre Dame Avenue between Notre Dame
Avenue and St. Peter Street.
And the City Engineer having filed assessment roll with the names of the
owners and a description of the property subject to be assessed with the
amount of the prima facie assessment.
The Board, upon motion made, seconded and unanimously carried, adopts
a resolution accepting said assessment roll and sets 9:30 A.M. on Tuesday,
September 8, 1970, in Room 1308 County City Building, as the time and place
for receiving remonstrances against the amounts assessed on said roll,
and will determine whether such lots or tracts of land have been or will be
benefited by said improvement to the amounts named.

PLANS AND SPECIFICATIONS APPROVED

Upon motion made, seconded and unanimously carried, the Board adopts Resolution
No. 3323, 1970, for the improvement of Humboldt Street, from Elmer to Huey,
by constructing a Class C pavement with curbs, and approves plans and specifi-
cations submitted by Clyde E. Williams and Associates, Inc., consulting
engineers, for such improvement.
Tuesday, September 8, 1970, at 7:30 P.M., in Room 1308 County City Building
is fixed as the time and place when and where all persons whose property may
be affected by such improvement may appear and be heard.
And the Clerk is directed to give notice of such hearing by publication in
the South Bend Tribune and the Tri County News on August 21 and August 28, 1970.

IMPROVEMENT RESOLUTION NO. 3324P 1970 ADOPTED - OLIVE STREET SIDEWALK REPAIR
PLANS AND SPECIFICATIONS APPROVED
NOTICE TO PROPERTY OWNERS
Upon motion made, seconded and unanimously carried, the Board adopts Resolution
No. 3324, 1970, for the improvement of Olive Street, from Ford Street to
Western Avenue, by repairing concrete sidewalk and curbs, and approves plans
and specifications submitted by Clyde E. Will,iams and Associates, Inc., con-
sulting engineers, for such improvement.
Tuesday, September 8, 1970, at 7:30 P.M., in Room 1308 County City Building,
is fixed as the time and place when and -where all persons whose property may
be affected by such improvement may appear and be heard.
And the Clerk is directed to give notice of such hearing by publication in

25, 1970 ADOPTED - ALLEY BETWEEN HUEY AND O'BRIEN
Upon motion made,.seconded and unanimously carried, the Board adopts Resolution
No. 3325, 1970, for the improvement of the alley between Huey and O'Brien Streets
from Humboldt Street north to the "T" end by constructing a Class C, Type i
concrete pavement, and approves plans and specifications submitted bjr Clyde
E. Williams and Associates, Inc., consulting engineers, for such improvement.
Tuesday, September 8, 1970, at 7:30 P.M., in Room 1308 County City Building,
is fixed as the time and place when and where all persons whose property may
be affected by such improvement may appear and be heard.

CONTRACTORS' BONDS
Contractor's bond on behalf of S. E. Price to 8/5/71 was approved by the Board
and ordered filed.
Certificate continuing contractor's bond on behalf of Emmett K. Troyer to 8/29/71
was approved by the Board and ordered filed.
Certificate continuing contractor's bond on behalf of Jack Enders and Ernest L.
Longway, d/b/a Enders and Longway Builders to 9/17/71 was approved and ordered
filed.
STREET LIGHT OUTAGE REPORTS
Street light outage reports for the period 8/4/70 to 8/14/70 were ordered filed.
There being no further business to come before the Board, the meeting adjourned
at 10:50 A.M.
