J..Crumpacker, who acted as chair- man of the meeting,'and James A. Bickel. The minutes of the previous meet- ing were reviewed and approved. FIRE DEPARTMENT - APPLICATION FOR APPOINTMENT The application of Luther James Taylor for appointment to the South Bend Fire Department was filed with the Board and referred to the Personnel Director for further processing. POLICE DEPARTMENT - APPLICATIONS FOR APPOINTMENT The following applications for appointment to the South Bend Police Depart- ment were filed with the Board and referred to the Personnel Director for further processing: Robert Evan Brown Jimmie Walker V"q POLICE DEPARTMENT - PROMOTION 00 6. Upon motion made seconded and carried the Board approved the recommendation. of Chief of Police Loren M. Bussert for the promotion of Corporal Paul Kozak to the rank of Captain, effective August 1, 1970.. POLICE DEPARTMENT - MILITARY DUTY Upon motion made, seconded and carried, the Board approved leave for military duty at Camp McCoy, Wisconsin, from July 26, 1970 through August 6, 1970, of officer John Brassell. BUILDING DEPARTMENT - SUB -STANDARDS DIVISION J. W. Adamson, Sub -Standards Director, appeared before the Board and the following matters were taken up. 427 N. Hill Street. Mrs. Anna Stancati, owner, and her son Guy Stancati appeared before the Board. Mr. Stancati reported the building has been boarded up many times but has repeatedly been broken into; that the building is solid and they are going to repair it. Upon motion made, seconded and carried, the matter was continued indefinitely and the Sub -Standards Director was requested to keep the property under surveillance. 1501 S. Lebanon. Mr. Adamson reported the owner of this property has advised him that she will close the structure and repair it. Upon motion made, seconded and carried, the matter was continued indefinitely and the Sub - standards Director was requested to keep the property under surveillance. 1022 S. 35th Street (on the complaint of Wm. Munich and others). Mr. Adamson reported this house and the accessory building are open and that old appliances and trash were found on the porch. Mr. Adamson was directed to notify the owner, Patrick Meyers, to appear before the Board. 625 Columbia Street. Upon motion made, seconded and carried, this matter was continued two weeks to permit the Sub -Standards Department more time in which to relocate the occupant of this house. 614 Columbia Street. Mr. Adamson reported he -has had no response from Mrs. Howard, land contract buyer, to a certified letter and a night letter; that the house has had a fire and is wide open; that Maude Montiga is the owner of the property. Upon motion made, seconded and carried, the Sub -Standards Director was authorized to seek bids for the demolition of the structure at 614 South Bend Avenue. 3707 Belle Vista. Mr. Adamson, Sub -Standards Director, reported he has been unable to get in touch with the owner, G. W. Benson, who works out of town; that the property, which was badly damaged by fire several months ago, was partially demolished by a contractor hired by the owner but that the demolition has never been completed, and the garage still stands. Upon motion made, seconded and carried, the matter pertaining to 3707 Belle Vista was referred to the Legal Department for appropriate action. 8/3/70 1217 South Bend Avenue. Samuel Johnson, owner, appeared before the Board and stated he is willing for the City to tear down the house. Upon motion made, seconded and carried, the Sub -Standards Director was given authority to ad- vertise for bids for demolition of the structure at 1217 South Bend Avenue. Demolition bids opened: This being the date set, bids were opened for demolition of the following structures. Non collusion affidavits were examined and found to be proper. The bids were as follows: a 655-657 Lawndale: O'Neal>Trucking Company $933.00 No other bids having been received, and the bid of O'Neal Trucking Company appearing to be reasonable, upon motion made, seconded and carried, contract for demolition of the structure at 655-657 Lawndale was awarded to O'Neal Trucking Company on its bid of $933.00. 1608l Prairie Avenue: O'Neal Trucking Company $549.00 No other bids having been received, and the bid of O'Neal Trucking Company appearing to be reasonable, upon motion made, seconded and carried, contract for demolition of the structure at 1608'—z Prairie Avenue was awarded to O'Neal Trucking Company on its bid of $549.00. POTAWATOMIE PARK DISPLAY BARN Upon motion made, seconded and carried, the matter of awarding contract for the construction of a display barn in Potawatomi Park was further continued four weeks. HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 33o8 - DONALD F. HICKEY This being the date set, hearing was held on the assessment roll in Vacation Resolution No. 3308, for the north -south alley lying between Lots 2 and.4 in Chapin's Subdivision of Bank Out Lot 182 and running south from the south line of Lincolnway West to the southeast corner of Lot 2 and. the southwest corner of Lot 4 in Chapin's Subdivision. The Clerk tendered proofs of publication.in the South Bend Tribune and the Tri County News on July 10, July 17 and July 24, 1970, which were read and found to be proper. No'remonstrators having appeared and no written remonstrances having been re- ceived, upon motion made, seconded and carried, the Board approved said assess- ment roll as adopted and ratifies and confirms said vacation resolution in all things and declares these proceedings closed and the alley vacated. VACATION RESOLUTION N0: 33225, 1970 ADOPTED - UNIVERSITY OF NOTRE DAME AND STANLEY PIETZAK Upon motion made, seconded and carried, the following Resolution was adopted: "VACATION RESOLUTION NO. 3322, 1970 RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, that it is desirable to vacate the following: a portion of Ivy Road running north from the north right of way line of South Bend Avenue to the south right of way line of Edison Road. Reserving the rights and easements of all utilities and the municipal city of South Bend, Indiana, to construct and main- tain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual utilities. 1 4 8/3/70 The following property may be injuriously or beneficially affected by such vacation Lots 1 to 6 inclusive, and lots 31 to 36, inclusive, in the town of Shroedervilie. Also, lots 30 to 47, ,inclusive, in Wooded Estates Addition. Also, a parcel of land in Section 6, Township 37 North, Range 3 east, bounded on the north by Edison Road, on the south by South Bend Avenue, and on the west by the west line of Twyckenham Drive extended north from South Bend Avenue to Edison Road. Notice of this Resolution shall be published on the 7th day of August, 1970, and on the 14th day of August, 1970, in the South Bend Tribune and the Tri County News. This Board, at its office, on the 17th day of August, 1970, at 9:30 o'clock A.M., will hear and receive remonstrances 00 ` from all persons interested in or affected by these proceedings. AND SPECIFICATIONS ADOPTED - IMPROVEMENT RESOLUTION NO. 3318 - HINGTON AVENUE, GREENLAWN TO IRONWOOD Upon motion made, seconded and carried, plans and specifications for the improvement of East Washington Avenue, from Greenlawn to Ironwood, by constructing a Class C pavement with curbs and curb repair were approved and adopted by the Board, and ordered placed on file in the office of the Board of Public Works and Safety. August 17, 1970, at 9:30 A.M., was set as the time for receiving bids for such improvement, and the Clerk was directed to give notice by publication in the South Bend Tribune and the Tri County News on August 7, 1970 and August 14, 1970. PETITION FILED TO PAVE NORTH -SOUTH ALLEY BE'iWEEN HUEY AND O'BRIEN STREETS - M. P. SMITH, AND OTHERS A petition, signed by M. P. Smith, 1226 N. Huey Street, South Bend, Indiana, and 24 others, to pave the north -south alley between Huey and o'Brien Streets, from Humbolt north to the T alley, was filed and, upon. -Motion made, seconded and carried, was referred to the City Engineer for study and recommendation. PETITION TO REPLACE SIDEWALK - OLIVE STREET, BETWEEN WESTERN AND FORD A petition to replace the sidewalk on Olive Street, between Western and Ford Streets, signed by Rev. John J. Moskal for St. Adalbert Church, 2420 Huron Street, South Bend, Indiana, and 23 residents on S. Olive Street, in which petition the said signers agree to pay 2 % of the cost of such sidewalk re- placement, was filed with the Board and, upon motion made, seconded and carried, was referred to the City Engineer for study and recommendation. COMPLAINT AGAINST STREET DEPARTMENT - MRS. LEE SWAN AND OTHERS Mrs. Lee Swan, 2022 S. Swygart Avenue, South Bend, Indiana, appeared before the Board and filed a written complaint signed by 14 residents of the 1900 and 2000 blocks of S. Swygart Street in reference to the grading of an alley in the 1900 and 2000 blocks of S. Swygart Street by the Street Department. complaining that the hard surface had been graded away and nothing further done, leaving the alley in a worse condition than before being graded. The matter was referred to the Street Commissioner for investigation and report. i 8/3/70 COMPLAINT OF MRS. HELEN PATTY AND OTHERS RE: 821 S. 23RD STREET upon motion made, seconded and carried, the complaint of Mrs. Helen Patty, 829 S. 23rd Street, South Bend, Indiana, and 23 others concerning the con- dition created by nine dogs at 821 S. 23rd Street was referred to the Legal Department for appropriate action. REQUEST FOR TAXICAB STANDS AT MAIN AND WASHINGTON STREETS - INDIANA CAB COMPANY Upon motion made, seconded and carried, the request of Bert Liss for the Indiana Cab Company, 710 N. Niles Avenue, South Bend, Indiana, to relocate taxicab stands at Main Street and Washington Avenue was referred to the Traffic Director for study and recommendation to the Board. REQUEST TO PLACE MOBILE HOME - NORTHERN INDIANA CHILDREN'S HOSPITAL Upon motion made, seconded and carried, the request of Donald M. Hippensteel, Superintendent of Northern Indiana Children's Hospital, T234'N. Notre Dame Avenue, South Bend, Indiana, for permission to place a mobile home in the court yard of the Northern Indiana Children's Hospital, for the purpose of a, -training program for children for a period of two to three years, was granted. REQUEST TO SELL FOR-GET-ME-NOTS - DISABLED AMERICAN VETERANS Upon motion made, seconded and carried, permission was. granted by the Board to the Disabled American Veterans, Chapter #6, 117 William.Street, South Bend, Indiana, to sell forgetmenots in the down town area September 4 and 5, 1970. REQUEST TO CLOSE N. ADAMS STREET FOR BLOCK PARTY Upon motion made, seconded and carried, permission was granted to Mrs. George Filchak, 1736 N. Adams Street, South Bend, Indiana, and nine other residents to close the 1700 block of N. Adams Street August 7, 1970, during a block party from 6:00 P.M. until midnight, with no music and no dancing. REQUEST TO PAINT HOUSE NUMBERS ON CURBING Upon motion made, seconded and carried, the request of Miss Dianne Kovas, 1337 Wall Street, South Bend, Indiana, Scott A. Poelvoorde and George Harris for permission to paint house numbers on curbing,in the residential area of the City was granted, subject to such permission being withdrawn upon objections made by such residents. CONTRACTORS' BONDS CANCELLED Upon motion made, seconded and carried, the request of Western Surety Company for termination of contractor's bond #4272178 for Kay Construction Company was approved for all work done on or after August 3, 1970. Upon motion made, seconded and carried, cancellation of contractor's bond #347154 of the Trinity Universal Insurance Company for Billy H. Lancaster and Leon H. Martin, d/b/a Lancaster -Martin was approved for all work doen on or after the 9th day of August, 1970. CONTRACTORS' BONDS APPROVED Upon motion made, seconded and carried, the following contractors' bonds were approved: Walter N. Nye - 8/ 3/71 Robert V. Reinke and Sons, Inc. to 8/4/71 was approved. EXCAVATION BOND APPROVED 1 Upon motion made, seconded and carried, excavation bond of Herman F. Glaser Construction Company to 7/27/71 was approved. 8/3/70 V-_i 00 iI✓ A� Q 1 1 REQUEST TO HOLD MUSICAL IN PUBLIC PARK Norman Martin, 1430 Woodcrest Drive, South Bend, Indiana, of the Urban League, appeared before the Board in reference'to a musical proposed to be held in a public park in the City. Mr. Martin stated they wished to hold such a musical during the daytime on a Saturday or Sunday the latter part of August or first of September, 1970. Mr. Martin was referred to the Park Department. STREET LIGHT OUTAGE REPORTS Street light outage reports for the period 7/16/70 to 7/30/70 were ordered filed.
