The minutes of the previous meeting were reviewed and approved. BIDS OPENED - CLEVELAND ROAD SEWER This being the date set for receiving bids for the construction of approximately 700 linear feet of 21 inch vitrified clay sewer on Cleveland Road, the Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri County News on June 19 and June 26, 1970, which were read.and found to be proper. The following bids were received: Cowles Construction Company, Elkhart, Indiana. Non collusion affidavit was found to be proper. The bid was accompanied by a bid bond of 5% of the bid. Financial statement of bidder (Form 96-a) being on file in the office of the Board of Public Works and Safety. Total bid - $14,924.00. Completion time 90 days. Dye Plumbing and Heating, 712 Madison Street, LaPorte, Indiana. Non collusion affidavit was found to be proper. Bid was accompanied by a bid bond of 5% of the bid, together with financial statement of bidders (Form 96-a). Total bid - $18,707.00. Completion time 60 days. Haskins, Inc., 64704 U.S. #31, Lakeville, Indiana, 46536. Non collusion affi- davit was found to be proper. Bid was accompanied by a bank draft in the amount of $800.00, together with financial statement of bidders (Form 96-a). Total bid $15,396.00. Woodruff Sons, Inc., P. 0. Box 315, Michigan City, Indiana, 46360. Non collusion affidavit was found to be proper. The bid was accompanied by a bid bond of 5% of the bid. Total bid - $14,606.00. Completion time 20 days. NO BIDS RECEIVED - THREE -WHEEL MOTORCYCLES This being he date set for receiving bids for four (more or less) three wheel motorcycles for the Police Department, the Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri County News, which were read and found to be proper. No bids having been received, it was moved, seconded and unanimously carried that the Police Department be authorized to seek quotations on the open market for four (more -or less) three -wheel motorcycles. NO BIDS RECEIVED - RADIOS FOR THREE -WHEEL MOTORCYCLES This being the date set for receiving bids for four (more or less) radios for three -wheel motorcycles for the Police Department, proofs of publication of notice in the South Bend Tribune and the Tri County News on June 26 and July 3, 1970, having been read and found sufficient, and no bids having been received, it was moved, seconded and unanimously carried that the Police Department be authorized to seek quotations on the open market for four (more or less) radios for three wheel motorcycles. F1.RE DEPARTMENT - RESIGNATION OF RICHARD L. HEIDRICH Upon motion made, seconded and unanimously carried, the Board accepted and approved the resignation of Richard L. Heidrich from the South Bend Fire De- partment effective July 5, 1970. POLICE DEPARTMENT - EXCUSED FOR MILITARY DUTY Upon motion made, seconded and unanimously carried, upon the.approval of Chief of Police Loren M. Bussert, the Board approved the requests of officers Robert L. Lanchsweerdt and Ernest Nybo to be excused for military duty at Camp McCoy, Wisconsin, from July 11 to July 25, 1970. POLICE DEPARTMENT - APPLICATIONS FOR APPOINTMENT The applications of Dennis Paul Graber and Leonard Michael Grummell for appoint- ment to the South Bend Police Department were filed with the Board and referred to the Personnel Director for further processing. 1 HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3314 - SOUTH BEND RANGE CORP. 7/6/70 This being the date set, hearing was held on the assessment roll in Vacation Resolution No. 3314, being for the vacation of: Part of Napier Street, located immediately south of and ad- jacent to Lot 32 as shown in John F. Kirby's Subdivision of Bank Out Lot 83; and a part of Cherry Street, beginning at the northwest corner of Lot 37 of John F. Kirby's Subdivision of Bank Out Lot 83; thence. north to the northwest corner of Lot 29; thence west to the west line of Cherry Street; thence south along the west line of Cherry Street to a point directly west of the northwest corner of Lot 37; thence east to the point of beginning. Proofs of publication of notice in the South Bend Tribune and the Tri County News on June 12, June 19 and June 26, 1970, were read and found to be sufficient. No remonstrators having appeared and no written remonstrances having been filed, upon motion made, seconded and unanimously carried, the assessment roll was adopted as presented and the Vacation Resolution in all things .confirmed and ratified and the proceedings concluded. X9 HEARING ON VACATION RESOLUTION NO. 3317 - MILL RACE, INC. (30 FT. EASEMENT) Hearing on Vacation Resolution No. 3317 for the vacation of an easement described as that part of the west leg of the East Race which is located northerly of a line parallel to and 30 feet southerly of the southerly line of Hydraulic Avenue and located westerly of the west line of the East Race, which said west leg of the East Race is the -Race located on the southeasterly and east sides of Hydraulic Avenue in Section 1 and in Section 12, Township 37 north, Range 2 east, in the city of South Bend, Indiana, having been continued from June 29, lg70, and the drainage problem having been now resolved, upon motion made, seconded and unanimously carried, the adoption of Vacation Resolution No. 3317 on May 25, 1970, is ratified and confirmed. And the City/Engineer,is directed to prepare an assessment roll showing the assess- ment of benefits and damages to the surrounding property. Attorney Bruce Stewart attended the meeting. PETITION FILED - TO VACATE IVY ROAD, SOUTH BEND AVENUE TO EDISON ROAD - NOTRE DAME UNIVERSITY AND STANLEY PIETZAK Attorney Irving Smith, on behalf of the University of Notre Dame and Stanley and Patricia Pietzak, 302 Ostemo Place, South Bend, Indiana, filed a petition to vacate Ivy Road, from South Bend Avenue to Edison Road. Upon motion made, seconded and carried, the petition was referred to the City Engineer for drawing of the area and referrat to Area Plan Commission for study and recommendation to the Board. :' 7/6/70 CONTRACT WITH ARCHITECT SIGNED - DRAINAGE FACILITIES AND STREET IMPROVEMENT CHIPPEWA AT MAIN Upon motion made, seconded and unanimously carried, the Board approved and executed an agreement (Form 97-A of the Indiana State`Board of Accounts) with Engineering Planning Services, 'Inc., consulting engineers, 1520 N. Main Street, Mishawaka, Indiana, for professional services in the matter of the construction of drainage facilities and street improvement on Chippewa Avenue at Main Street, in the city of South Bend, Indiana. POTAWATOMI PARK DISPLAY BARN Upon motion made, seconded and carried, the matter of -awarding contract for construction of a display barn for Potawatomi Park was further continued one week. COMMUNICATION FROM CITY ENGINEER A copy of report of the City Engineer under date of June 26, 1970, to members of the Common Council in reference to street paving was ordered filed. INDIANA.'; DELUXE CAB 4CORP. - APPLICATION FOR -CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY Application for certificate of public convenience and necessity for the operation of taxicabs for hire on the Streets of South Bend, Indiana, was filed with the Board and, upon motion made, seconded and carried, referred to the City Con- troller for review and recommendation. INDIANA CRIMINAL JUSTICE AGENCY - IN -KIND RENT FOR JUNE, 1970 Indiana Criminal Justice Agency reports in -kind rent of $150.00 for the month of June; 1970, for 1427 County City Building (exchanged for Stowe -Davis executive desk and chair to the office of the Deputy Controller). REQUEST - TO MOVE PORTABLE SCHOOL UNITS - LEWIS MITCHLEN Lewis Mitchlen appeared before the Board and requested permission to move three portable school units (from Jefferson School to Clay, Franklin to Hamilton and Linden School to Hamilton). Upon motion made, seconded and unanimously carried, permission was granted for the moving of such portable school units over the city streets on condition that the routing be worked out with the Traffic Director. REQUEST TO CLOSE CHAPIN STREET FOR ST. ANNE FESTIVAL Upon motion made, seconded and unanimously carried, the Board approved the request of Mrs. Thomas Arch, 823 Sherrill Street, South Bend, Indiana for Chapin Street, from Calvert Street to Bruce Street, to be closed between the hours of 3:00 P.M. and 10:00 P.M., on July 18, 1970, during the annual St. Anne festival of the Our Lady of Hungary Church, providing proper insurance to hold the City harmless is obtained. REQUEST TO HOLD PARADE (1971) - SOUTH BEND SHRINE CLUB, INC. Upon motion made, seconded and unanimously carried, the Board approved the re— quest of John R. Kagel for the South Bend Shrine Club, Inc., 107 Lincolnway East, South Bend, Indiana, to hold a hold a Shrine parade in the downtown area of South Bend on Saturday, June 26, 1971. REQUEST TO BLOCK MAIN STREET - FIRST CHRISTIAN CHURCH Upon motion;made,'seconded and unanimously carried, the Board approved the re- quest of Frank W. Edgerton for the First Christian Church, 320 S. Main Street, South Bend, Indiana, for permission to block South Main Street, between Wayne Street and Western Avenue, on Sunday, July 12, 197.0, between the hours of 8:30 A.M. and 10:00 A.M., in connection with the march of the congregation to their new Church location at 1101 E. Jefferson Boulevard and granted permission for northbound traffic within the block during this time. n 7/6/70 PETITION FOR STREET LIGHT - 800 BLOCK DUBAIL A petition for a street light in the 800'block of East Dubai] Avenue was filed by Winthrop Sharp, 317 E. South Bend Christian Reformed Church - to 6/26/71. STREET LIGHT OUTAGE REPORTS Street light outage reports for the period 6/23/70 to 7/1/70 were ordered filed.
