Present were William J. Richardson, City Engineer and Charles A. Sweeney, Jr. City Attorney. CHARGES AGAINST PATROLMAN THEODORE CEASAR NAJDEK This being the date set for hearing charges against Patrolman Theodore Ceasar Najdek, the hearing is now held. Patrolman Najdek chose to represent himself. Upon questioning he stated that he had received a copy of the charges against him, and of notice of hearing. He waived the reading of Burns. Anno. Ind. Statutes. The Chairman asked how he pled on Count 1 and Patrol -- man Najdek pled guilty. The Chairman asked how he pled on Count 11 and Patrolman Najdek pled guilty. The Board now finds that Patrolman Najdek, upon his plea, is found guilty. After reviewing the case, and upon the recommendation of Chief Seals, his penalty is assessed at seven days suspension without pay. Reinstatement to be after seven days. Since seven days have elapsed since he was first suspended, Patrolman Najdek is now reinstated and re- turned to duty. CHARGES AGAINST PATROLMAN LEONARD MICHAL GRUMMELL This being the date set for hearing charges against Patrolman Leonard Michael Grummell, the hearing is now held. Comes now Arthur W. Goulet, Attorney, who appears before the Board to represent Patrolman Grummell. The chairman requested that reading Burns Anno. Indiana Statute Sec. 48-6105 be.waived. Attorney Goulet waived the reading of the statute and stipulated that the Board has the authority to act in this matter. Patrolman Grummell stated that he had received a copy of the charges against him and notice of the meeting. He denied both counts. Mr. Goulet now files an answer to the Board in regard to the complaints, as follows: CITY OF SOUTH BEND ) STATE OF INDIANA ) IN THE MATTER OF ) CHARGES AGAINST PATROLMAN) LEONARD MICHAEL GRUMMELL ) BEFORE THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA ANSWER Comes now Patrolman Leonard Michael Grummell and for his answer to Charges filed against him March 3, 1972 by Robert W. Seals, Chief of Police for the city of South Bend, says: 1. That he denies the allegations contained in both rhetorical paragraphs of Count 1 of said charges. 2. That he denies the allegations contained in both rhetorical paragraphs of Count 11 of said charges. WHEREFORE, said Leonard Michael Grummell prays that this Board find in his favor and against the charges filed against him herein. s/ Arthur W. Goulet Attorney for Patrolman Leonard Michael Grummell 3/6/72 1 Upon motion made, seconded and carried, the Board approved the request of IBM for the use of the trailer for ninety days. HOUSE MOVING - 709 North Olive Mr. West informed the Board that moved to 1849 North Olive Street is required. 736 North Francis Street the house which was to have been had been demolished, so no action Mr. Wallace Mitchell having been instructed to appear before the Board on this date with an occupancy permit showing the structure at 736 North Francis Street was in a habitable condition, and Mr.Mitchell not having appeared, and Mr. Liszewski having taken picture to show that no appreciable work has been done on the structure, the Board now directs, upon motion made, seconded and carried, that the bids previously received should be read. The were as follows: WAIMCO, O'Neal Trucking $525.00 435.00 Upon motion duly made, seconded, and carried, the bid for the demolition of the structure at 736 North Francis Street was awarded to the O'Neal Trucking Company on its low bid. Mr. Richard Liszewski, Sub -Standards Director presented a letter to the Board informing them that 14r.John Vanek has not been performing on his demolition contracts. Two contracts awarded January 6, 1972 have not been completed. Mr. Liszewski recommends that no more contracts be awarded to Mr. Vanek. Upon motion made, seconded and carried the Board accepted Mr. Liszewski's recommendation and directed the Clerk to write Mr. Vanek and tell him no more bids will be awarded to him for demolition if he is unable to perform them. A.C.T.I.O.N. IN -KIND VOUCHERS In -kind vouchers were received from A.C.T.I.O.N. Inc., for Fire Stations #5, #7 and #8 for the month of March, 1972 and were ordered filed. WEIGHTS AND PLEASURES REPORT Mr. Bert Cichowicz, City Sealer, filed his report for the month of February, 1972. PETITION TO VACATE ALLEY - SOUTH OF RIVERSIDE DRIVE FROM LELAND Chris A. Brooks, 914 Leland Avenue, presents a petition to vacate the first East-West alley South of Riverside Drive running East from Leland Avenue to the first North -South Alley, and deposits the sum of $75.00 to cover costs. Upon motion made, seconded and unan- imously carried, the petition _was referred, simultaneously, to the Engineering Department anc'l.the Area Plan Commission for study and report to the Board. CONTRACT CHANGE ORDER -WASTEWATER TREATMENT PLANT. Upon motion made, seconded and unanimously carried, the Board approved a Contract Change Order #3 in the Wastewater Treatment Plant Addition Division A., for Sollitt Construction Company. MAINTENANCE BOND - ARCO ENGINEERING CONSTRUCTION CORPORATION Upon motion made, seconded and carried the Board approved a Maintenance Bond for Arco Engineering Construction Corporation for sewer, concrete curb and asphalt construction in Southeast Estates. 3/b/72 The Board, having reviewed the matter, and having received a recommendation from Chief Seals, now concurs in the recommenda- tion, and assesses the penalty at seven days suspension without pay. Reinstatement to be after seven days. Since seven days have elapsed since the suspension from duty, Patrolman Leonard Michael Grummell is now reinstated and returned to duty. CHARGES AGAINST WILLIAM VESSELS STOYNOFF This being the date set for hearing charges against Corporal William Vessele Stoynoff, hearing is now held. Corporal Sttoynoff stated that he had received a copy of the charges against him, and a copy of the notice of hearing. He now states that his attorney is out of the city, and he appears before the Board with a request that he be granted a continuance so he may obtain counsel. The Board recognizes his right to counsel and continues the case until March 13, 1972 at 9:30 A.M. SPECIAL POLICE COMMISSION - WATSEY GAULDIN Upon motion made, seconded and carried the Board approved the Special Police Commission of Watsey Gauldin, the Environmental Inspector for the City. SPECIAL POLICE COMMISSION - DONALD J. BRUNETTE Upon motion made, seconded and carried, the Board approved a Special Police Commission for Donald J. Brunette who is employed by Don Medow Pontiac. His commission will be sent to him upon the receipt of an appropriate bond. CONTINUATION CERTIFICATE - MANUEL SADURAL Upon motion made, seconded and carried, the Board approved a contin- uation certificate for a bond for Special Police officer Manuel Sadural. BUILDING DEPARTMENT - I. B. M. TRAILER Mr. Forest !Jest, Building Commissioner, appeared beforethe Board and presented the following letter. March 1, 1972 Mr. Forest R. West Building Commissioner City County Building South Bend, Indiana Dear Mr. West: IBM would like permission to renew the permit for location of the Mobile Demonstration Trailer in our parking lot. We request the renewal for an additional ninety day period effective March 1. At the end of that time the trailer will be moved to a new IBM location. The information regarding the specifications of the trailer and its use, is the same as contained in our letter of June 2, 1971, request- ing the original.permit. If there are any questions regarding the trailer and/or its'use, please feel free to call. Please advise me of the disposition of this re- quest as soon as possible. Thank you for your cooperation. Koch Administration Manager 30 3/6/72 STREET LIGHT - 1000 BLOCK NORTH LAWNDALE Upon the recommendation of the Engineering Department and the Traffic Engineering Department and upon motion made,seconded and carried the Board instructed that a 7,000lumen light be installed in the 1000 block of North Lawndale between California and Vassar. STREET LIGHT OUTAGE REPORT Street light outage reports were ordered filed for the period of 2/23/72 to 3/1/72 219 E, Ohlio Street Mr. Liszewski, Sub -Standards Director, requested permission to advertise for bids for the demolition of the structure at 219 E. Ohio Street. Upon motion made, seconded and carred the request was granted and bids will be advertised.
